HomeMy WebLinkAbout20100192.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT#1695 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING OIL AND GAS SUPPORT AND SERVICES (WATER SUPPLY AND STORAGE, POTASH MIXING AND STORAGE,WASHOUT FACILITY, REVERSE OSMOSIS FACILITY,AND PRODUCTION PIPE AND EQUIPMENT STORAGE AREA)IN THE A(AGRICULTURAL)ZONE DISTRICT -A&W WATER SERVICE, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of December, 2009, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the application of A&W Water Service, Inc., 1892 Denver Avenue, Fort Lupton, Colorado 80621, do Lind, Lawrence, and Ottenhoff, LLP, Attn: Chrysten Hinze, 355 Eastman Park Drive, #200, Windsor, Colorado, 80550, for a Site Specific Development Plan and Use by Special Review Permit#1695 for a Mineral Resource Development Facility, including Oil and Gas Support and Services (water supply and storage, potash mixing and storage, washout facility, reverse osmosis facility, and production pipe and equipment storage area) in the A (Agricultural)Zone District on the following described real estate, to-wit: Part of the E1/2 of Section 31, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on December 23, 2009, the Board deemed it advisable to continue said matter to January 27, 2010, to allow the matter to be reviewed by the Planning Commission at a hearing continued from December 1, 2009, to January 5, 2010, and WHEREAS, at said hearing on January 27, 2010, Planning staff requested a continuance of the matter because the proper notice sign was not posted on the property at least ten days prior to the hearing date, and WHEREAS, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant to continue the matter to March 3, 2010, due to scheduling conflicts experienced by the applicant's representative, and, having been fully informed, finds that this request be approved and the matter should be continued to March 3, 2010, at 10:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado,that the abovementioned matter be,and hereby is,continued to March 3,2010,at 10:00 a.m. 2010-0192 PL2035 RE: CONTINUANCE (USR-1695) -A & W WATER SERVICE, INC.
