This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. There is an existing metal warehouse and an office building on the property. Water for the business is provided by an individual well (Well permit No. 214950-A). According to the permit, the use of the well is for domestic purposes only. The applicant will need to obtain a permit by the Division of Water Resources for approval of the well for commercial use. There is an existing septic system for the office on the property that is permitted for 4 employees (Permit No. SE-1000008). According to the application, the commercial • facility has 5 employees and serves walk-in customers (average of 10 customers per day). Since there is a proposed increase in hydraulic load, the existing septic system will require an evaluation by a Colorado Registered Professional Engineer for the total number of employees and use by patrons of the commercial facility. If the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. In addition, according to the site plan submitted with the application, there is an asphalt pad in the area of the existing septic system. The septic system must be protected from vehicle traffic. According to the application, draining of all fluids from engines and transmissions is performed inside the warehouse. The waste oil, transmission fluid, coolant, antifreeze, brake fluid, and power steering fluid are then stored in 2-500 gallon composite barrels. Once a month the fluids are removed by a local waste liquid recycling and disposal company. According to the applicant, the gasoline is siphoned out of the used vehicles and stored in 5 gallon gas cans for use in company vehicles. All containers of fluids are stored in a concrete area outside of the warehouse building A minimal dust abatement plan will be required for onsite dust. A waste handling plan is required to ensure materials are disposed of properly. The waste handling plan shall include the names, addresses and phone numbers of the waste handlers and facilities where the waste will be disposed. In addition, all products must be stored in compliance with manufactures recommendations. • • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. In the event the applicant intends to utilize the existing septic system, for employee and customer use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current I.S.D.S. Regulations. 3. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, if • applicable. 4. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. 5. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any vehicle maintenance facility located on the site that is equipped with a \' \ floor drain. Alternately, the applicant can provide evidence from the EPA that \�\ they are not subject to the EPA Class V requirements. (New EPA rule effective '\ they 4/5/2000). IN /6. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. • • 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. • 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. • 3 • 11. Floor drain wastes shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 12.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 13.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Additionally, please note the following: 1 . This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. This violation was initiated due to the operation of multiple businesses and mobile homes without first obtaining the appropriate zoning permits. Since the initiation of the violation,the mobile homes and majority of the businesses (except 2 commercial operations) have been removed from the property. This case was presented to the Board of County Commissioners through the Violation Hearing process on December 09, 2008. At that Violation Hearing, the Board of County Commissioners referred this case to the County Attorney's Office for immediate legal action. Since this violation has already been filed in District Court, investigation fees are required. This application if approved by the Board of County Commissioners will correct the violation. Additionally, an existing permit (BCR09-00868) has been pulled for a roof repair due to a fire. No inspections have been performed on this permit to date. • 1. A building permit shall be obtained prior to the use of the existing structure, change of use permit, or any construction or change to the building for which a permit is required until the permit is pulled, inspections pass and a Certificate of Occupancy is issued to the structure. 2. A plan review is required for each unit for which a building permit is required. Two complete sets of plans are required when applying for each permit. Plans shall bear the wet stamp of a Colorado registered Architect or Engineer. Include a Code Analysis Data sheet for the Weld County Building Department with each building permit. The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building Code. 3. The applicant shall provide to the fire district the total gross square footage (area) of the warehouse. This is necessary to determine, based on the requirements of the International • Fire Code, whether the building will be required to be equipped with an approved automatic fire suppression sprinkler system. 2. The applicant states that oil, transmission fluid, coolant, antifreeze, brake fluid, and power steering fluid are currently stored in "500 gallon composite barrels on site." This is not approved. These fluids are hazardous materials and as such the storage thereof shall comply with the requirements of the International Fire Code. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical availability of water.. According to the submitted information, potable water for the property is supplied by well permit nos. 103372 and 214950-A. Well permit no. 103372, was late registered in accordance with C.R.S. 37-92-602(5) on August 23, 1978 for the historical use of this well, being a well producing 20 gallons per minute and used for domestic and livestock purposes. In addition, well permit no. 214950 was late registered in accordance with C.R.S. 37-92-602(5) on December 29, 1998 for the historical use of this well, being a well producing 15 gallons per minute and used for ordinary household purposes inside one single-family dwelling. On the same date, permit no. 214950- A was approved for the replacement of the existing well on the condition that the old well is plugged and abandoned. The replacement well was constructed on December 14, 1998, under emergency approval 98VE540. Note that the use of the ground water for wells constructed and put to beneficial use prior to May 8, 1972 is limited to the uses that can reasonably be shown to have existed as of May 8, 1972 or the uses that can reasonably be shown to have been intended as of May 8, 1972 (provided such uses do not exceed the statutory use limits for a residential well as specified by CRS 37-92-602(1), which allows for up to three single-family dwellings, the watering of domestic animals and livestock, and the irrigation of not more than one acre of home lawn and garden). According to the information provided it appears that well no. 214950-A, is currently being used for the commercial business. If the well is being used to provide water to a commercial business, the Applicant must obtain a new permit for this well that allow for commercial use. On January 28, 2010 the Applicant submitted a well permit application to change permit no. 214950-A from ordinary household purposes to commercial use. On February 5, 2010 the application was returned to the applicant for additional information. The ability for well no. 214950-A to obtain a new commercial permit will be evaluated at the time that the well permit application is re-submitted to this office.
