RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ANNA KELTIE FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Anna Keltie, ZCV#0900343, is allegedly in violation of the Weld County Code,
and
WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not
been corrected, and
WHEREAS, on the 9th day of March, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Anna Keltie, property owner, was not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to
the Weld County Attorneys Office for legal action,with an instruction for delay of action upon such
referral until April 9, 2010, in order to allow adequate time for the property owner to remove the two
(2) derelict vehicles and for an inspection of the property by the Department of Planning Services
staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0900343 be, and hereby is, referred to the Weld County Attorneys
Office for legal action against Anna Keltie to remedy the violation of the Weld County Code,and any
other persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties, with an instruction for delay of action
upon such referral until April 9, 2010, in order to allow adequate time for the property owner to
remove the two (2) derelict vehicles and for an inspection of the property by the Department of
Planning Services staff.

STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of Planning

Violation Summary Report
As I have indicated in my previous letters, while the presence of a NONCOMMERCIAL JUNKYARD
consisting of derelict vehicles, appliances, buckets, concrete blocks and bricks,tires and miscellaneous
debris is an allowed use within an Agriculturally zoned subdivision, such as Hudson Heights, it must be
completely SCREENED from all adjacent properties and public rights-of-ways; otherwise, any Derelict
Vehicles shall be operational at all times and evidence of current registrations shall be submitted to this
office.
RECOMMENDATION
The Department of Planning Services staff recommends that this case be forwarded to the County
Attorneys Office for immediate legal action.

12/16/2009 Property Inspected Upon a visual inspection of the property, the following items
were noted: furniture (couches), derelict vehicles, buckets,
concrete blocks and bricks, tires and miscellaneous debris.
No pictures were taken during this inspection.
02/03/2010 Property Inspected Upon a visual inspection of the property, the following items
were noted: derelict vehicles, air conditioner or some other
appliance, concrete slabs/blocks and miscellaneous debris.
There appeared to be little or no progress. They do
appear to be installing a new sidewalk going up to the
house. No pictures were taken during this inspection.
02/09/2010 Phone Call Anna Keltie (303-536-4278) called. She said she received
a letter in the mail. She said there is a date highlighted
and wanted to know what that date was for. I explained
that is the scheduled Violation Hearing date before the
Board of County Commissioners. She said well I can't
make it that day. She said she doesn't have a car and
can't make it to Greeley. I explained that while
considerable progress has been made, the property
remains in violation. She said is it the car. I said if my
recollection serves correctly there was a vehicle parked on
the south side of the house. She said they were getting
ready to tow it to the back yard (in the fenced area)when
the city dug a trench making it impossible to move it. I also
explained there was like an air conditioner or appliance on
the North side of the house. She said that has been
removed. I explained there were concrete paver stones
and a small amount of miscellaneous debris in the front
yard. She said as it un-freezes from the ground they are
cleaning it up. I explained that the Board would more than
likely grant additional time to make it through till spring. I
explained that I wouldn't just cancel the hearing though.

Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation.
Our records indicate that you were made aware of the nature of the violation including the action
necessary to correct the violation, and that you were given sufficient time to remedy this violation. If
