RE: EXPRESSION OF DESIRE TO COORDINATE PLANNING OF THE USE OF FEDERAL
LANDS IN WELD COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has the legal power and authority:
a) Pursuant to Section 29-20-104, C.R.S., to plan for and regulate the use of land by:
regulating the use of land on the basis of the impact thereof on the community or
surrounding areas, and otherwise planning for and regulating the use of land so as
to provide planned and orderly use of land and protection of the environment in a
manner consistent with constitutional rights;
b) Pursuant to Section 30-28-106, C.R.S., "to make and adopt a master plan for the
physical development of the unincorporated territory of the County;"
c) Pursuant to Section 30-28-111, C.R.S., to make and adopt"make a zoning plan for
zoning all or any part of the unincorporated territory within [the] County, . . . for the
regulation by districts or zones of the location, height, bulk, and size of buildings and
other structures, percentage of lot which may be occupied, the size of lots, courts,
and other open spaces, the density and distribution of population, the location and
use of buildings and structures for trade, industry, residence, recreation, public
activities, or other purposes, access to sunlight for solar energy devices, and the
uses of land for trade, industry, recreation, or other purposes;"
d) Pursuant to Section 30-11-101(2), C.R.S., and as a home-rule county pursuant to
Section 30-35-103, C.R.S., "to adopt and enforce ordinances and resolutions
regarding health, safety, and welfare issues as otherwise prescribed by law;" and
WHEREAS,Weld County contains thousands of acres of properties owned by agencies of
the Federal government, and
WHEREAS, the Board of County Commissioners, pursuant to Section 30-11-101(1)(k),
C.R.S., has the legal authority, "to coordinate, pursuant to 43 U.S.C. sec. 1712, the "National
Environmental Policy Act of 1969",42 U.S.C. sec.4321 et seq.,40 U.S.C.sec. 3312, 16 U.S.C.sec.
530, 16 U.S.C. sec. 1604, and 40 CFR parts 1500 to 1508, with the United States Secretary of the
Interior and the United States Secretary of Agriculture to develop land management plans that
address hazardous fuel removal and other forest management practices, water development and
conservation measures,watershed protection,the protection of air quality, public utilities protection,
and private property protection on federal lands within [the] County's jurisdiction," and
WHEREAS, the Board of County Commissioners now expresses its desire to coordinate
planning of the use of Federal properties within Weld County with the Federal agencies owning such
properties.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board hereby expresses its desire to coordinate planning of the use of
Federal properties within Weld County with the Federal agencies owning such properties.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 16th day of June, A.D., 2010.
