RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV#0900366 AGAINST RRRS, LLP/BEAU CARTER FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, RRRS, LLP, do Ron Hiatt, and Beau Carter, dba Herbal Medix, LLC,
ZCV#0900366, are allegedly in violation of the Weld County Code, and
WHEREAS,despite efforts by the Planning staff to resolve said matter, the violation has not
been corrected, and
WHEREAS, on the 12th day of January, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, RRRS, LLP, c/o Ron Hiatt, and Beau Carter, dba Herbal Medix, LLC, property
owners, were not present or represented at said hearing, although all parties were notified of said
hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to refer said matter back to the Department of
Planning Services, due to an application being submitted for a Use by Special Review(USR)permit
for the operation of a medical marijuana dispensary.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that BCV#0900366 against RRRS, LLP, c/o Ron Hiatt, and Beau Carter, dba
Herbal Medix, LLC, be, and hereby is, referred back to the Department of Planning Services,due to
an application being submitted for a Use by Special Review (USR) permit for the operation of a
medical marijuana dispensary.

REMEDY
As I have indicated a Use by Special Review(USR) permit is required in the C-3(Commercial)Zone
District prior to the operation of a Medical Marijuana dispensary. The first step in this process is a
Pre-Application Request meeting. This step is completely free to the application, but does require 2010-00.

Additionally, my records indicate that the massage parlor permit was previously denied by the Board;
therefore, the operation of the massage parlor(Day Spa) also violates the existing Site Plan Review.
During my last inspection there were numerous pallets and plastic drums, barrels and containers
visible and spread out along the back side of the property.
Lastly, parking has become a re-occurring problem, both in the street(Turner Blvd) and in driving
lanes of the parking lot(in both cases blocking traffic).
RECOMMENDATION
The Department of Planning Services recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

12/21/2009 Property Inspected During an on-site inspection, the following items were
noted: Upon pulling into the parking lot, I noted a sign in
the massage parlor window(Open). There was also a
sign on the door of Unit#3 - Herbal Medix, LLC (w/Store
Hours). They were closed on Mondays (the day of this
inspection). Brian from Truckwash came over and
asked what the problem was. I explained that we had
received a complaint that a Medical Marijuana
dispensary had been opened without first obtaining the
required Weld County Zoning Permits. He asked what
the permit would be. I explained a Use by Special
Review(USR). He asked what that was. I explained it
was a public hearing process and since the businesses
were situated on the 1 (one) parcel, everything would
have to be permitted under this one application. I then
mentioned that I saw an OPEN sign in the window of the
massage parlor. He said yes, but they are permitted. I
said it was denied by the Board. He said oh, really. I
said yes and with both of these operations occurring
without permits, I could foresee an emergency Violation
Hearing sometime right after the new year. I gave him
the Pre-Application Request form and my business card
(I wrote down the main extension and asked him to ask
for a Planner).

representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy
