Regarding the possible tracking issue onto the highway,the local CDOT maintenance forces in the area have not observed any tracking in the past few weeks since we've been working on this issue.Therefore,CDOT's position is that additional temporary measures to prevent tracking are not required to be installed currently and that CDOT is fine with waiting until the access is resurfaced in spring. Obviously, should a big storm hit next week and it turns out that the tracking is a problem, CDOT reserves the right to readdress this issue between now and when the access is asphalted. Inc. the Colorado Department of Transportation(CDOT)has conducted an inspection of your access permitted under CDOT Access Permit==409022 and determined this access is not constructed in a satisfactory manner per this permit's terms and conditions and is therefore considered non-compliant.This permit authorized improvements on an existing access to accommodate increased Apollo truck tragic on State Highway 392 at mile post 127.536 on the north side of the highway. Specifically.there are two issues which need to be addressed.which are: 1. The substandard width of the radius-When Apollo obtained their permit from us. it was their own engineers who argued that they needed 102.5 feet of driveway where the access meets the highway to safely accommodate the heavy truck traffic.Currently,there is about 70 feet of driveway.Apollo is responsible for increasing the size of the access' radii to the appropriate size as found in Exhibit"A"of permit=409022. 2. The surfacing of the access-This permit calls for this access to be asphalt,not road base or some other dirt material. Apollo is responsible for asphalting ail of the access in the CDOT right-of-way.Additionally,CDOT has become aware of dirt tracking issues from this access.Asphalting the access is a strong first step to remedying the tracking problem. However,CDOT reserves the right to readdress this issue in the future should dirt tracking continue to be a problem after asphalting. These construction items must be remedied as soon as possible to return Access Permit=409022 to good legal standing with CDOT. Apollo 15-18 I Class II Waste Disposal Dear Tim: I am in receipt of your letter dated January 25, 2010 regarding the above captioned access permit used to access the above captioned facility located on lands owned by JLW Investment, L.L.C. et al ("JLW"). I am writing to formally address the issues raised in said letter and to follow up my voice mail from Wednesday, January 27, 2010; I did receive your returned voice mail on Monday, February 1, 2010 as well. 1. The substandard width of the radius. We intend to enlarge the radius from the current 70 feet to 102.5 feet per Exhibit "A" of Permit #409022. Our intent is to accomplish this at the same time of the asphalt surfacing (see No. 2 below for more details). 2. The surfacing of the access. We intended to surface the access with asphalt last summer, however, there was a snafu with our Weld County USR permit in which they did not recognize the tankage required for the original facility design in turn requiring us to amend the USR to allow the tankage. During the USR amendment pre-hearing last spring the new public works officials from Weld County made me aware they will recommend to the County Planning Department and the County Commissioners Apollo asphalt 300' in from the CDOT ROW to grant the amended USR. Apollo feels this is excessive & unnecessary as the tracking issue will be addressed by asphalting the entry; the original USR did not require this and nothing is changing regarding traffic. Our amended USR planning department hearing is FINALLY set for March 2, 2010 and the County Commissioner hearing set for March 17, 2010. After the commissioners hearing I should know where I stand with Weld County and how to proceed prior to the asphalt plant in Greeley opening up this spring/summer (as you are probably aware most asphalt plants do not operate outside of the "paving season" here in Colorado). I have spoke with my on site facility manager regarding the current tracking issue, he has informed me in his opinion there does not appear to be a problem at this time; I respectfully request Apollo be allowed to determine what the situation with Weld County will be prior to any temporary fixes be instituted. However, if the problem persists prior to the surfacing of the access we would propose to lay gravel or recycled asphalt to address the tracking issue.
