THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260
of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect.
Section 22-2-150D.A Goal 4 states: "Conversion of agricultural land to nonurban
residential, commercial and industrial uses will be accommodated when the subject site
is in an area that can support such development. Such development shall attempt to be
compatible with the region." The surrounding development pattern East of CR 1 is
residential with outbuildings and similar development patterns exist in Boulder County.
Section 23-2-240.A.10 of the Weld County Codes states "...that buffering or screening of
the proposed use from adjacent properties may be required in order to make the
determination that the proposed use is compatible with the surrounding uses." The
applicant is proposing to plant a natural windbreak of plant materials adjacent to the
• North property line. Additional screening is requested as a Condition of Approval.
B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the Agricultural
(A) Zone District. Section 23-3-40.R of the Weld County Code allows for A Site Specific
USR-1738—MAYER, Page 2
Development Plan and a Special Review Permit for a business permitted as a use by
• right or accessory use in the Commercial Zone District (Landscaping Business) in the A
(Agricultural)Zone District.
Currently the property is in violation (ZCV09-00295) for the operation of a tree trimming
business without an approved and recorded Use by Special Review permit (USR). If the
USR is approved, the violation will be closed. If denied, the case shall be referred to the
County Attorney's office but delay legal action for 30 days in order to give the applicant
time to ensure that the business is removed from the property.
C. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the
existing surrounding land uses.
The property to the north, south, and east are in Weld County and are predominately
small to medium acreages with single family residences and outbuildings. To the North is
a residential development, the Bohrer PUD. West of the Mayer property is Boulder
County with a similar development pattern.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the
future development as projected by Chapter 22 of the Weld County Code and any other
applicable code provisions or ordinances in effect, or the adopted Master Plans of
affected municipalities.
The property is not located within an Intergovernmental Agreement Area but does lay
within the three mile referral area for the City of Longmont and the Towns of Firestone
and Mead. The City of Longmont is their referral dated March 1, 2010 indicated no
conflicts with their interests. The Towns of Firestone and Mead did not return a referral.
• It is the opinion of Staff that the Conditions of Approval and Development Standards will
ensure that the use will be compatible with existing surrounding land uses.
E. Section 23-2-220.A.5 -- The application complies with Article V of the Weld County Code.
The existing site is within the County Road Impact Fee Area, Capital Expansion Impact
Fee, and the Stormwater/Drainage Impact Fee area.
Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
Effective August 1, 2005, Building permits issued on the subject site will be required to
adhere to the fee structure of the Capital Expansion Impact Fee. (Ordinance 2005-8,
Section 5-8-40)
F. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use.
The subject site is classified as "Prime If Irrigated Farmlands of National Importance" as
delineated on the Important Farmlands of Weld County map, dated 1979. This size of
the parcel (1.32 acres) is currently developed as a residential property therefore it is not
conducive to farming.
G. Section 23-2-220.A.7 — There is adequate provisions for the protection of health, safety,
and welfare of the inhabitants of the neighborhood and County.
The Design Standards (Section 23-2-240, Weld County Code), Operation Standards
(Section 23-2-250, Weld County Code), Conditions of Approval and Development
•
Standards can ensure that there are adequate provisions for the protection of health,
safety, and welfare of the inhabitants of the neighborhood and County.

37. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural
counties in the United States, typically ranking in the top ten counties in the country in total
market value of agricultural products sold. The rural areas of Weld County may be open and
spacious, but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with long-standing agricultural
practices and a lower level of services than in town. Along with the drawbacks come the
incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness,
wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County would quickly
be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; slow-moving
farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor
•
from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes;
hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of
pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice
USR-1738—MAYER, Page 8
for agricultural producers to utilize an accumulation of agricultural machinery and supplies to
• assist in their agricultural operations. A concentration of miscellaneous agricultural materials
often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-
102, C.R.S., provides that an agricultural operation shall not be found to be a public or private
nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that
are commonly or reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to
assume that ditches and reservoirs may simply be moved "out of the way" of residential
development. When moving to the County, property owners and residents must realize they
cannot take water from irrigation ditches, lakes, or other structures, unless they have an
adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles in size
(twice the size of the State of Delaware) with more than three thousand seven hundred (3,700)
miles of state and County roads outside of municipalities. The sheer magnitude of the area to be
served stretches available resources. Law enforcement is based on responses to complaints
more than on patrols of the County, and the distances which must be traveled may delay all
emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to emergencies.
County gravel roads, no matter how often they are bladed, will not provide the same kind of
surface expected from a paved road. Snow removal priorities mean that roads from subdivisions
to arterials may not be cleared for several days after a major snowstorm. Services in rural areas,
in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be
more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban setting.
Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps
• and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs
and livestock, and open burning present real threats. Controlling children's activities is important,
not only for their safety, but also for the protection of the farmer's livelihood.

Hello Kim.
Aere is the PDF of the Plat Map. I'm using Cad Pro in order to create these plat maps. In order for it to fit onto a
8.5"x11" sheet of paper, the software will not allow me to change the scale of this smaller version to 1"=20'. When I
make changes to the larger version, I can make that into the scale size.

Hello Kim. Here are some of the items we addressed in the conference call;
Dust abatement: We will be wetting down the dirt driveway when we see that our vehicles are throwing up too much
dust. Our water comes from Longs Peak Water District.
Mulch containment: We will pile the mulch no higher than 4' to prevent the mulch from blowing away. This height also
favorable for preventing spontaneous combustion.
Stormwater Control: In the event of a storm we have a low point where the water collects, evaporates, and percolates
into the soil. This area is located on our southern most part of our property. If we have really significant precipitation, it
may puddle in the area of 40'x30'. In addition, along the south property line, we have a berm that raises up about 1' to
protect water flow from going over to the neighbors.
Restrooms for Employee(s): At the moment I have one employee I may acquire one more employee this year.
However, if my employee needs to use the bathroom, he will use our residential facilities. He seldom uses our bathroom
because we don't work on our property. It is very rare that he is on the property for more than a half hour per day.
Normally, we just meet here to drive to jobs.
"piste handling:The business only acquires waste from our lunches. We throw our trash away, at the end of the day, in
our residential trash cans. Western Disposal provides our waste disposal service.

Kim. Sorry for not replying sooner. ,

I'd like to discuss my situation with bathroom facilities. In the 6 years of us living her and operating our business from
our home,we have never had one person ask us to use a restroom. So, if the county wants me to spend a lot of money
that I don't have)to make a facility, I think it is asking way too much. Even with the warmer weather and people doing g
rd work, the demand for mulch and firewood is down. We see a couple of people per week at this moment. I truly
ink that my peak season volume of persons coming on my property is May through September. That is less than 6
months per year I may see,on average 1 or 2 people per day on my property seeking free mulch or wood. So, please,
I'm asking from some more consideration of the request of having a portable toilet here on my property.
I have looked into the service and I'd be willing to pay$96 dollars per month to have it cleaned out weekly. And like I
mentioned above, in 6 years,we have never had someone ask to use our bathroom. So, I'd most likely be paying$96
dollars per month for the possibility someone in a small window of time may need to use the restroom. Otherwise, I'd
be paying out thousands of dollars for nearly nothing.
As far as storm water goes... I don't know if a Weld County employee has been on my property, but the water
percolates into the ground just fine. We park 2 vehicles outdoors. That's it. Many of my neighbors do the same or have
more vehicles parked on their properties. Our personal car is in our garage. I highly doubt a small drop of oil here and
there is going to upset the ecology in the event of a storm bringing a lot of water here. We have a clean operation here.
That is our storm water plan. What else needs to be done? — L-(' On sik 1 ,jyr,A Lt`n kI(in unA 10
Dust abatement? Hmm... Our dust abatement plan is that we don't create much at l all in the first place. Once again: my
employee arrives in the morning. We then leave to work. We then arrive in the late afternoon. As far as dust goes. I'm
pretty sure there are many many people who kick up more dust than I do. - . static
ark" '
And the mulch doesn't blow away. It never has and never will. In fact,we will typically mulch our driveway to control
dust for the brief seconds of driving in and out. However, with the moisture we had this winter, it has opened my eyes
adding gravel to our driveway. I don't know if this would contribute to dust in the air or not. Can I put gravel down?o ?
do I have to asphalt everything? But, if I did asphalt, I'd for sure have to have a storm water plan...

The property as we know it will pretty much stay the same for many many years. don't/can't do the stuff I put in
my USR. I was advised to put down whatever I thought I may do some day. And, I did that. So, I believe things are being
taken out of proportion a little. Or, I simply don't understand the formalities. Because I feel as if there are all sorts of
•ad blocks being thrown my way to scare me out of our property. Correct me if I'm wrong.
I'm sorry for the long e-mail. With the season getting busy, my days are long. I'm the owner/operator of the business,
so I'm not home until the evenings these days.
I'll have my wife, Beth call Heidi tomorrow.
Thank you,
Jamin

A single family residence with attached garage is sited on a 1 . 32 acre parcel with a single point of access
adjacent to the north property line is graveled and grades and accesses with good sight distances in each
direction onto CR 1 approximately 0. 5 miles North of SH 66. County Road 1 is a two lane paved road
posted at 45 MPH . The surrounding property to this proposal is predominately residential, on a range of
acreages. Boulder County is to the West and has a similar land use. The property is has a farm fence at
the perimeter.
The use of the property is to bring the chipped wood material and larger materials to the property for the
public to obtain for free. Significant outdoor storage of mulch and larger diameter woody material is
present. Similar material is located to the East, away from the road, including a large lower profile wood
chip berm. The site's low water detention area is located in this general area.
• Vehicles are typically parked to the rear adjacent to the north property line.

Thank you for informing me that I may not be in compliance with the Weld County
Code, Chapter 23. Yes, I do operate a tree service business from my residence, and I
have been since 2002. I was unaware that I would have to obtain a Use by Special
Review(USR)permit. I apologize for this misunderstanding.
The usage of my property is twofold; first, it is our primary residence. Second, I park my
two work trucks here. I also dump mulch and wood at my location. I give away free
mulch and free wood. As of this year, I have processed firewood to be sold. The
processed firewood has been delivered to customer's homes, not sold at my location.
(This has also been some what of a test to see if I want to sell firewood as supplemental
income).
• I'll be more than happy to comply with Weld County with this matter.
Thank you,
Jamin Mayer v "^ AAC '

• This is how I have my property laid out. The west side fence is about 30' from the road.
This space between the road and the fence is unknown(to me as to who owns it). It
would be nice to know who's it is, since I maintain it.
The drive way entrance is about 21' in width. There is plenty of space for people to drive
around on. The property has no landscaping done to it at all. So, parking and driving
around isn't an issue.
I have been parking my work vehicles in the front of my home lately to be seen by
potential customers. (With the slower economy, I felt necessary to get exposure). I used
to park out of sight in the past.
