RE: SUBDIVISION EXEMPTION NO. 41 - EXEMPTION OF LAND TRANSFER-
RED TO JERRY AND RENEE STEHMAN FROM DEFINITION OF "SUB-
DIVISION" AND "SUBDIVIDED LAND" .
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Jerry and Renee Stehman
for an exemption of land to be transferred to it from Jess Kohler,
from the definition of "subdivision" and "subdivided land" in Section
30-28-101 (10) , CRS 1973, as amended, and in Section 2-1 of the
Weld County Subdivision Regulations, and
WHEREAS, the Board finds that the contemplated transfer
does not conflict with the intent of the Weld County Comprehen-
sive Plan and will not have an adverse impact on the existing use
of the land, and
WHEREAS, the Board has considered the recommendation of the
Department of Planning Services on this matter and has reviewed
information submitted by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners , Weld County, Colorado, that the transfer of cer-
tain lands located in Section 18 , Township 6 North, Range 64
West of the 6th P.M. , Weld County, Colorado, and being more
particularly described as follows :
A tract of land located in the Southeast Quarter (SE4) of
Section 21, Township 6 North, Range 66 West of the Sixth Principal
Meridian, Weld County, Colorado, being more particularly described as
follows: Courencing at the South Quarter Corner (S4 Cor) of said
Section 21, and considering the South line of the Southeast Quarter
(SEa) of said Section 21 to bear North 88°54'22" East, with all
bearings herein relative thereto: Thence North 00°00'00" East,
along the West line of the Southeast Quarter (SE-1/4) of said Section 21,
a distance of 30.00 feet to the True Point of Beginning, said point
being on the North Right-of-Way Line of a County Road; thence continu-
ing North 00°00'00" East, along the West line of the Southeast Quarter
(SFa) of said Section 21, a distance of 208.71 feet; Thence North 88°
54'22" East, 208.71 feet; Thence South 00°00'00" West, 208.71 feet
to the North Right-of-Way Line of said County Road; Thence South 88°
54'22" West, along the North Right-of-Way Line of said County Road,
208.71 feet to the True Point of Beginning.
Said tract of land contains 1.000 Acres, and is subject to any rights-
of-way or other easements as granted or reserved by instruments or as
now existing on said tract of land.
be and hereby is exempt from the definition of "subdivision"
and "subdivided land" found in Section 30-28-101 (10) , CRS
1973 , as amended, and Section 2-1 of i--he Weld County Subdivision
Regulations.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 23rd day of

Gentlemen:
On January 20th, 1977 an application requesting a variance in regard
to the property described and diagramed on the form for such applica-
tion, together with a letter of explanation for such a request, sign-
ed by the undersigned agent, was recieved by your office.
In this request we also noted that the variance was needed to provide
access to the property for which we were thinking to apply for a re-
corded exemption. Now, because of refinancing by the Owner of the
herein described land, Lots one and two(which has been separated and
described as a separate lot) will be combined into a single unit.
Therefore, since it is desired by the Owners to sell and transfer to
their daughter and son - in - law, another older existing house and
land on which this house is located, approximately one acre, they
are requesting a substitution of exemption in which Lot three would
be recorded as a separate exemption in place of Lot two, which will
be combined into one unit with Lot one, as shown in the accompanying
diagram and surveyors plat, thereby negating the need to seek anoth-
er recorded exemption.
