HEARING CERTIFICATION DOCKET NO. 2010-45 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT#1218 FOR ONE (1) SINGLE FAMILY DWELLING UNIT (MANAGER/ CARETAKER'S RESIDENCE) PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A OF THE WELD COUNTY CODE, AND AN ONGOING HOME BUSINESS (STORAGE UNITS AND RV PARKING) IN THE A (AGRICULTURAL)ZONE DISTRICT- CHARLES AND GAIL SCHNUERLE A public hearing was conducted on September 29, 2010, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner William F. Garcia Commissioner David E. Long Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Kim Ogle Health Department representative, Heidi Hansen Public Works representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 20, 2010, and duly published August 25, 2010, in the Fort Lupton Press, a public hearing was conducted to consider the request of Charles and Gail Schnuerle, for a Site Specific Development Plan and Amended Use by Special Review Permit#1218 for one (1) Single Family Dwelling Unit (manager/caretaker's residence) per lot other than those permitted under Section 23-3-20.A of the Weld County Code, and an ongoing Home Business (storage units and RV parking) in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the original application was approved on May 12, 1999, and this amendment will add outdoor vehicle storage and convert one outbuilding into a caretakers' residence/office. He gave a brief description of the location of the site, which is within the three-mile referral area for the Towns of Milliken and Windsor, and the Cities of Evans and Greeley. He stated the City of Greeley provided a referral response expressing concerns with water flow delivery, which is addressed in Condition of Approval #1.E, and the remaining municipalities did not return a referral response. Mr. Ogle stated there are four parcels within 500 feet of the property, with one residence in close proximity to the northeast, and staff did not receive correspondence from any surrounding property owners. He stated the surrounding area is primarily agricultural in nature, and it is surrounded by the City of Greeley. He further stated 13 referral agencies reviewed the proposal, four offered comments which have been addressed in the Conditions of CC Cj 9U N L p li3 2010-2309 PL1302 HEARING CERTIFICATION -CHARLES AND GAIL SCHNUERLE (AMUSR-1218) PAGE 2 Approval and Development Standards, and he requested the deletion of Conditions of Approval #1.A, #1.C, and #1.D, since all of those requirements have been met by the applicant. In response to Chair Rademacher, Mr. Ogle indicated the development to the west of the site is the Promontory Subdivision. Heidi Hansen, Department of Public Works, stated the site is accessed from 95th Avenue, which is under the jurisdiction of the City of Greeley; there should be no substantial change in the traffic impact; and the applicants intend to use an existing low point on the site for the water quality feature. Lauren Light, Department of Public Health and Environment, stated the site will receive water service from the City of Greeley, and there are two existing, permitted septic systems on the site: one for the primary residence, which was upgraded in 1999 to allow for the original 180 storage units, and the second septic permit is for the caretaker's residence, which was approved on September 17, 2010, therefore Condition of Approval #1.G may be deleted. Ms. Light stated the applicant is not required to submit a Dust Abatement Plan, since the original USR permit requires dust suppressant, as needed. She further stated the Waste Handling Plan was submitted and approved and there are two dumpsters on the site which are emptied on a monthly basis, or sooner, if needed. Ms. Light stated Development Standards #7 through #16 address Environmental Health issues, and she has no concerns with the proposal. In response to Commissioner Kirkmeyer, Ms. Light confirmed Condition of Approval #1.G.1 may be deleted. Julie Cozad, TetraTech, represented the applicant and displayed a PowerPoint presentation, marked Exhibit F. She introduced the applicants, who have lived on the subject site for 16 years, and previously owned and operated the Amoco gas station on 8th Avenue in Greeley. She stated they sold the station in 1998, and were granted a Use by Special Review (USR) on May 12, 1999, and have since cleared the site of the remains from an old dairy, planted a substantial amount of landscaping, and they keep the site very clean and organized. She stated, once approved, the applicants constructed some of the storage units, upgraded the septic system, connected to the City of Greeley for water service, paved the driveway areas, and met the drainage requirements of Weld County. Ms. Cozad explained the applicants have each encountered serious health issues in recent years and requested family members come and live with them to assist with the business, which led to the idea of constructing the caretaker's residence. She stated the existing USR footprint will remain unchanged, with the exception of the Caretaker's residence and designating the outdoor parking area for RV's and campers. She further stated, although the site is located near the municipal boundary of the City of Greeley, the five-acre site is zoned A (Agricultural), the surrounding uses in the area are agricultural in nature, and the Promontory Subdivision is approximately one-half mile away. Ms. Cozad stated the site has existing lighting, paving, and landscaping, and although the trees which screen the outdoor storage area are deciduous, they are planted close together for suitable screening, and there have been no complaints regarding the facility. She stated all of the RV's are parked in an orderly fashion and have current licenses, and she displayed photographs of the recent construction work, newly remodeled office, and existing storage units. She further stated the applicants have met staffs' requirements concerning water quality, and they intend to submit a letter to the City of Greeley to ensure the backflow prevention meter is installed and inspected. Ms. Cozad requested Development Standard #3 be amended to allow 2010-2309 PL1302 HEARING CERTIFICATION - CHARLES AND GAIL SCHNUERLE (AMUSR-1218) PAGE 3 up to four (4) employees, with the understanding that all related utilities would be sized accordingly. She also requested an amendment to the second sentence of Development Standard #11 to add the words, "when needed", and to modify Development Standard #27 to add, "with the exception of personal vehicles" to the end of the sentence. Lastly, Ms. Cozad thanked staff for their assistance in completing the permit process. No public testimony was offered concerning this matter. In response to Chair Rademacher, the Board indicated concurrence with the deletion of Conditions #1.A, #1.C and #1.D, and amending Development Standard #3 to allow up to four (4) employees. In response to Chair Rademacher, the applicants decided to increase the amount to six (6) employees. Ms. Light indicated the new septic system for the Caretaker's residence is sized for two people, and the existing home is upgraded to allow for 180 storage units, therefore, she believes there is adequate capacity with the current systems. The Board agreed with the proposed amendments to Development Standards #11 and #27. Responding to Chair Rademacher, Ms. Cozad indicated she and the applicants have reviewed, and concur with, the Conditions of Approval and Development Standards, as discussed and amended. Commissioner Kirkmeyer moved to approve the request of Charles and Gail Schnuerle for a Site Specific Development Plan and Amended Use by Special Review Permit #1218 for one (1) Single Family Dwelling Unit (manager/caretaker's residence) per lot other than those permitted under Section 23-3-20.A of the Weld County Code, and an ongoing Home Business (storage units and RV parking) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Her motion included the deletion of Conditions of Approval #1.A, #1.C, #1.D, and #1.G, a modification to Development Standard #3 to increase the maximum number of employees to six (6), an addition of the words "when needed" to the end of Development Standard #11, and a modification to Development Standard #27 to read, "No maintenance of stored vehicles will occur on the site, with the exception of personal vehicles." The motion was seconded by Commissioner Conway, and it carried unanimously. Commissioner Conway commended the applicants and wished them luck in their future endeavors.
