WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 8th day of August, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Redorded Exemption No. 404, being the property of George and Mary Beckman, described as part of Section 24, Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: A tract of land, being the North 164. 00 feet of the W1 SW4 of Section 24 , Town- ship 5 North, Range 66 West of the 6th P.M. , County of Weld, State of Colorado and further described as follows: considering the west line of said SW; as bearing North 00°31' 45" West, and all other bearings relative thereto; Beginning at a point, which point is the NW Cor. SWQ of said Section 24 ; thence North 89°55 ' 45" East, 1324. 98 feet along the E-W centerline of said Section 24; thence South 00°38 ' 27" East, along the east line of said W1 SW3 164. 00 feet; thence South 89°55' 45" West, 1325. 30 feet to a point on the west line of said Section 24; thence North 00°31' 45" West, 164. 00 feet along the west line of said Section 24 to the Point of Beginning. Said described parcel of land contains 5. 0 acres, more or less, and is subject to any rights-of-way or other easments as granted or reserved by instruments of record or as now existing on said described parcel of land. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and 790806 WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is now within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by George and Mary Beckman, be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. BE IT FURTHER RESOLVED by the Board that said exemption is granted subject to the twenty (20) foot access easement being recorded for the purpose of ingress and egress to Lot A of said Recorded Exemption. COLORADO July 25, 1979 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE : Recorded Exemption #404 Dear Commissioners : The attached application, plat and related materials are in reference to a request from George and Mary Beckman for a recorded exemption. The parcel of land on which this request has been made is described as the North 164' of the WiSW4 Section 24, T5N, R66W of the 6th P.M. , Weld County, Colorado. This property is located at 3246 35th Avenue, Greeley, Colorado. The property contains approximately 5 acres of Class II and III irrigated soils. The request is to split the pro- perty into parcels of 1. 035 acres and 3.954 acres. The proposed Lot B contains Mr. and Mrs. Beckman' s present residence. Mr. and Mrs. Beckman desire to transfer the smaller parcel , Lot A, to their son to be used as a residential building site. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be denied for the following reasons: 1. It is the opinion of the Department of Planning Services Staff that the proposal is not consistent with the intent clause of the recorded exemption procedure. Said clause states: "The intent in establishing the Recorded Exemption Pro- cedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non-productive agri- cultural lands may be developed for higher or more pro- ductive uses, insofar as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. " (Rev. 4/17/74) Board of County Commissioners Page 2 July 25, 1979 The Comprehensive Plan urges residential development to be closely connected to and served by municipal utilities, and towns should be encouraged to service new developments within a reasonable service area from the town. The Plan further indicates subdivi- sion of land should conform to the overall development goals and policies. The parcel is not prime agricultural land because of past divisions of land creating small residential tracts along 35th Avenue north of the property under consideration. However , the request would not provide for the orderly expansion of urban growth. The Department of Planning Services Staff feels that if the area were to continue to develop, inefficient subdivision development will result . 2. It is the opinion of the Department of Planning Services Staff that the request is not consistent with the basic goals and policies of the Weld County Comprehensive Plan with respect to urban development . Within Chapter 1, Introduction of the Plan under Section A. , Nature of the Plan, it is stated on Page 2 that : "Further urban development and growth will inevitably occur throughout Weld County. This Comprehensive Plan outlines a course of action which assures urban growth in accordance with the concepts and desires of each existing municipality. At the same time, urban develop- ment will take place with a minimum of impact on the environment and with a maximum of economy in providing public utilities and services. The net result is a controlled expansion of our existing municipalities into well planned, coherent communities that blend into and complement the surrounding agricultural environment . " In setting forth the goal of assuring that urban growth is in accordance with the concepts and desires of each existing munic- ipality on Pages 53 and 54, the Plan states: "The Future Land Use Map shows the general distribution throughout Weld County of areas proposed for eventual urban development . These areas are based on comprehen- sive plans prepared by individual municipalities in the County. A more detailed picture of proposed urbaniza- tion within the planning areas of each of the towns can be found in the comprehensive plan for the town in question. Planning for urban development at the County level must be closely coordinated with planning for each of these municipalities. At the same time, in order for these towns to guide their future growth successfully, they must make their goals and objectives known to the County and to each other." • Board of County Commissioners Page 3 July 25, 1979 The City of Greeley Planning Commission has recommended denial of this request at its July 10, 1979 meeting. The following is taken from its letter dated July 19, 1979 : "The Planning Commission referred to the inadequacy of the proposed 20 foot access easement to the rear lot . Development of this nature should conform to the sub- division regulations of the City of Greeley, which require that each lot have direct access onto a public street. The Commission also expressed concern for the lack of public street access to the interior of Section 24. To allow this recorded exemption could result in incremental steps towards landlocking developable parcels from 35th Avenue. " It is the opinion of the Department of Planning Services Staff that in the vicinity of the proposed recorded exemption, continued divi- sion of parcels will not assist orderly, efficient and integrated development nor promote the health, safety and general welfare of the residents of the immediate area or the County.
