A summary of the discussion is found below. Summary of Discussion In order to interconnect the power generated at the Cedar Creek II Wind Farm with the Keenseburg Substation, an additional two to three capacitor banks are needed. Cedar Creek II, LLC would obtain a long term lease or easement adjacent to the Keenseburg Substation and would not purchase the land outright. One alternative site is on land owned by Cedar Creek I, and the other two alternatives are on land owned by Public Service Company of Colorado (PSCo). For all three alternatives, the following permits would be required: • Subdivision exemption • Building permits for everything within the fenced capacitor area/ Leasehold area as applicable • Electrical permits • Grading Permit, as more than one acre will be disturbed i:13 f-,,/ :' 3y.e F ce Gi 3 3 t .d[ 4; .ii in . Tel ` eee, H a(ic,F C a 1 6 i.xScs a 130``- 3'ao R Meeting Notes Cedar Creek II Wind Farm Project Page 2 of 2 • Drainage permits, if Water Quality Feature,as required by Public Works • Geotechnical reports • Environmental due diligence • Amendment to Long Term Road Maintenance & Improvements Agreement(reference Reception No. 3438391)—CR 55 Section Line Access Setback requirements would include the following: • Twenty feet from the edge of the future Highway 76 Frontage Road right-of-way • Twenty feet from CR 55 Section Line—see above • One foot for every three feet of building height from offset property lines The timeframe for processing the subdivision exemption is 60 days; it is possible to expedite this timeframe to 45 days depending on availability of staff. It is possible to request an early release of the building permits. BPWENA is planning to install the equipment in November or December of this year. BPWENA is planning to submit the required application materials in mid to late August. We have undertaken the following actions and research in this regard and believe that building the proposed wind farm will result in little to no impact on third parties' rights to drill for and produce oil and gas in the wind farm area. As you know, we provided notice of our Weld County wind farm permit application to all mineral rights holders within the project area in accordance with applicable State of Colorado notice statutes. Anadarko Petroleum Corporation and U.S. AgBank, FCB were the only two parties that responded with any concerns. We have communicated with both of these parties and addressed their concerns. We have agreed to relocate our proposed transmission line outside of a possible future drilling location identified by Anadarko in Section 35-11N-60W. U.S. AgBank owns mineral rights in the E/2 of Section 7-10N-58W; our proposed transmission line runs 80 feet south of and along the northern section line and AgBank has concurred that it would not impede their ability to develop the mineral estate in the future. This letter is intended to satisfy Condition of Approval 2.P of USR-1723 (written evidence from applicant indicating that all requirements and agreements between the surface developer and the mineral owners and/or lessees have been completed or evidence that an adequate attempt has been made to mitigate their concerns).
