There are two residences located on the property. Water for the property is currently provided by Central Weld Water District. The District will continue to supply water to the various businesses which may locate on the parcel. A new septic system will be installed for commercial use. The commercial system must be designed by an engineer and approved by the Board of Health. All employees, visitors and patrons to the parcel must have access to adequate sanitation facilities. The sizing for the commercial septic system shall include the personnel associated with • the horse boarding and training activities. If one of the existing homes will be utilized for commercial sanitation facilities the septic system must be evaluated by an engineer due to the increased hydraulic load. The two homes are served by separate individual sewage disposal systems (SP-9900524 and G19880014). The commercial building cannot contain floor drains unless it is a self contained system and the fluids are disposed of off site at an appropriate disposal site. A minimal dust abatement plan will be required for on site dust. The plan should include items such as a reduced speed limit and watering, as necessary. A waste handling plan is required which shall include the names, addresses and phone numbers of the disposal companies. In addition, all products must be stored in compliance with manufactures recommendations. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, for on site dust, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. • EXHIBIT $ 2010-1252 • 2. In the event the applicant intends to utilize the existing septic system at either of the existing homes, for employee, patron or visitor use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirement be incorporated into the permit as a • condition that must be met prior to the issuance of the Certificate of Occupancy for the business building: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Z. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. • 2 • • • S. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. /7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. Adequate drinking, hand washing and toilet facilities shall be provided for • employees, patrons and visitors of the facility, at all times. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize Central Weld Water District. 11.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 12. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: Weld County Road Classification Plan (FHU): This section of WCR 6 is under the City of Broomfield's jurisdiction. Access requirements will be addressed by the City of Broomfield. Site Plan: The applicant shall utilize the existing access to this parcel. 1. Parking areas and the access drive shall be surfaced with gravel, recycled asphalt or the • equivalent and shall be graded to prevent drainage problems. 2. Please identify the size of the recycled asphalt tracking apron on the plat(24'x50' min). 3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. Storm Water Drainage: A water quality capture feature to control run-off from your property is required. The area provided for the water quality capture feature is acceptable. 4. The calculations for the water quality capture feature show the required storage volume is 3389 Cu.Ft. The additional calculations are not necessary. Please call out the size of the water quality feature on the plat(e.g. 55'x60'xl'). 5. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 6. Please add a note to plat stating that "Weld County is not responsible for the maintenance of drainage related features." This violation was initiated due to the operation of a commercial business and commercial storage without first submitting and completing the necessary Weld County Zoning Permits. This case was presented to the Board of County Commissioners through the Violation Hearing process on December 8, 2009. At that Violation Hearing,the Board of County Commissioners referred this case to the County Attorney's Office, but delayed legal action for 30 days (01/08/10). This application was submitted prior to January 8, 2010 and therefore no Investigation Fee is required. This application if approved by the Board of County Commissioners will correct the violation. The Fire District does not object to use of the property and existing buildings for storage of commercial equipment and vehicles,auto storage or agricultural purposes. With regard to use of the property and buildings for fabrication or auto repair the Fire District does not object if the requirements of the District can be met. • Water supply and fire apparatus access is be required for new structures or existing structures depending on the use or activity occurring within in the buildings. Water supply for fire protection is not required for private garages, barns, storage buildings and accessory buildings provided the building is not being used as living space and hazardous activity will not be occurring within the structure (i.e. woodworking, vehicle repair garage, spray painting with flammable/combustible liquids,etc.).
