HomeMy WebLinkAbout20101215.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #0900342 AGAINST JESSE THOMAS AND DOYLE THOMAS FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jesse Thomas and Doyle Thomas, ZCV #0900342, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of June, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Doyle Thomas, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 8, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #0900342 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Jesse Thomas and Doyle Thomas to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until July 8, 2010, to allow adequate time for the property owner(s) to bring the subject property into compliance by removing the outdoor storage materials from the site. REMEDY On January 29, 2010 a Pre-Application meeting was conducted to discuss your commercial operation. Michelle Martin (Planner) expressed concern due to your property being situated within the 1-25 "Regional Urbanization Area" (RUA). Furthermore, your property is additionally situated within the "Intergovernmental Agreement" area (IGA)for Longmont. Taking all of this information into consideration, Michelle explained that at this time this type of business is not conducive to the area. Therefore to bring the property into compliance there are 2 (two) options: 1.) Proceed. If you choose this option the first item which would need to occur would be to have the City of Longmont complete the Notice of Inquiry form that Michelle Martin gave you at your Pre-Application meeting. The next step would be to complete the Regional Urbanization Area (RUA) application to modify the RUA map. If the map revision is approved, the last step would be to complete and submit the Planned Unit Development (PUD) application. 2.) Close the business and remove all storage of COMMERCIAL VEHICLES, materials and operations. No pictures were taken during this inspection. 12/29/2009 Phone Call Doyle Thomas (970-566-8824 or 970-535-6100) called. He said he does not operate the actual house moving business from this property (his dad's property) - he has an actual office in Fort Collins. He said he does store the vehicles, beams, etc on a back portion of the property. He said he is also in the process of potentially moving his heating and air business out to this property. He said with the economy the way it is, he needs to move out of the facility where he is paying rent. He explained that his dad has a building out on the property that he is hoping to move into. I explained that he was looking at the Pre-Application Request meeting form. I walked him through the web page and how to pull the necessary information from it. I told him that I would really like to see the Pre-Application form submitted on or before January 8th (my return date). He said he would work on trying to get it done before then. I explained we are basically looking for a hand drawn map showing where they park and store materials, where the buildings are-the shop he is operating out of, a brief narrative explaining what all he stores out there, what he does out there (he indicated light fabrication and it wasn't open to the public), how many employees he would have out there and the application itself filled out with the property information. He said he would get to working on it. 01/29/2010 Office Visit Pre-Application Meeting conducted with Michelle Martin. Client advised that Violation Hearing would be scheduled for April 13, 2010. A complete USR application would need to be submitted or Commercial Operations removed by that time. 03/24/2010 Property Inspected Sign posted for April 13, 2010 Violation Hearing. See pictures dated 03/24/10. 03/29/2010 Telephone call Patrick Groom (Attorney) called. He said he had Doyle 8, Jesse Thomas in his office and he needed to know what Violation Summary Report their options were. He asked if a USR would fix this situation. I explained that since their property was situated within the 1-25 RUA (formerly known as MUD) area and Longmont's IGA. The first step would be to contact Longmont and apply to amend the 1-25 RUA map. The next step would be to complete and submit a PUD application. He asked if they were currently scheduled for a Violation Hearing. I explained that they were (April 13th). I asked if he would be representing them. He said he didn't know yet-they were about to discuss that very issue. I asked him to let me know. 05/17/2010 Phone Call I attempted to contact Doyle Thomas (970-566-8824) to see where he was at with the violation case. I advised him that I would be re-scheduling the Violation Hearing for June 8, 2010. I asked him to call me to discuss this violation. Pre-application reviews are required prior to beginning the application process; however, this review is not an application. Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and and Environment. Pre-Application reviews are held Thursday and Friday of any given week in the Greeley office.
