Stamp, am requesting for a special USR permit to allow me to raise and breed dogs on this property. There will only be two breed types, Miniature Dachshund and Bernese Mountain Dogs. I intend to never exceed over 50 adu dogs at one time. This kennel will only employ one or two persons, on a minimal part time, occasional time basis, to help out while I am out of town or as needed. To the South of me is a farm that raises cattle. To the west of me is a far that raises crop. To the east of me is farm land both for cattle and crops. To the North of me is open land. The hours of operation are from 9 A.M. to 8 P.M. by appointment only, Sunday through Saturday. Two more structures are 'potenth buildings' located on the Northwest corner of the acreage. A possible third building to be located at the Southwest con of the property. The building listed as a "shop/garage" is a'potential small engine repair shop'that would be operated 1 my son on a part time basis. Further explanation of the small engine shop will be explained on page 2. The animals on this property will be no more than 50 dogs, no more than 20 chickens and no more than 2 horses. The only vehicles to ADor 's property are personal, customer vehicles and no larger than a one ton pick up, lawn mowers and such. We are the protection of the Johnstown Fire District. The water source is domestic, from Little Thompson Water Distric The sewage disposal is a septic tank located to the west of the house. There will be no storage or warehousing. The landscape is mature but intend to plant more trees for shade along the west fence line. Storm water is natural drainage. The structures are to be completed as the use for such building are needed. The dog waste matter will be put into a dumpster which is removed from the property on a bi-weekly basis. (Waste Management of Northern Colorado). Please note the facilities both present and'potential' as drawn on the page attached. The buildings in existence are insulated, both heated and have air conditioning, concrete flooring and washable surfaces through out. The fences/outside kennels are made of chain link and heavy constructed wire.All potential kennels will be of the same am made with requirements listed by the state of Colorado. Stamp date • • page 2 Small Engine Repair Shop 14e Small Engine Repair Shop hours of operation are 8 AM to 9 PM by appointment only, Monday through Sunday The shop is set up for lawn mower repairs and other small engines like chain saws, rotor tillers and of the like. Wast material would consists of iron that would be taken in for recycle. Any oils or toxic chemicals would be disposed of in proper containers and taken to Mares, 1000 Boad Street, Miliken, Colorado. There is no running water in the shot and therefore would not cause any contamination to the water source. This small business is open on a part time basis with no employees. My son, Kory Wright, a minor(17 years of age) will be listed as the owner/operator and the only one employed. The only vehicles on this property will be personal the vehicles of the customers. Thank you for your consideration, Jane M. Stamp • • SOW PERMIT LETTER • Septic Permit number: SP-9600444 DOPKENNEL The buildings that are used for the dogs do not have any running water in them. The drinking water for the dachshund dog kennel is carried in one gallon containers to the building. The inside of the kennel building is concrete flooring which is swept daily and mopped with a bucket of water once a week, carried in by a separate container. The Bernese Mountain Dogs have containers specifically for drinking water(heated buckets) which is filled by our garden hose as needed.Those containers are swished out with the garden hose about once a month. There is no grooming (bathing) of dogs on this property. The dogs are sent to a groomer for bathing or are taken to a dog bathing center. This kennel averages 2-4 people once a week to visit our kennels who might be interested in buying a puppy. There might be one person a month that asks to use the restroom. Dog waste is picked up daily, put into trash containers and placed in the 2 yard roll off rented by Waste Management o Niiern Colorado bi-weekly. SMALL ENGINE REPAIR SHOP There is no running water in the shop. There is no water used in the shop for any reason. Customers average 4-6 people per week. They are here mostly to pick up or drop off thier lawn mowers or make appointments for their repairs needed. STORM WATER DRAINAGE There is a storm drain located at the south west corner of the said property. All water flows directly to that spot from the west side of the property, There has never been a time of that much accumulation of water to flow off the property. All water from previous storms has been absorbed into the ground. On the east side of the property, where there is law and driveway, the driveway may accumulate very small amounts of water during a storm but is quickly absorbed withi a matter of hours. Stamp 8029 County Road 50 Johnstown, CO 80534 Subject: USR Application submittal Sent via electronic mail May 26, 2010 • Dear Ms. Stamp: The Department of Planning Services is in receipt of an application for a Special Use Permit for a 50 Dog Kennel and small engine and brake repair business. The application is the result of a violation of the Weld County Code, violation number ZCV09-00271 against William Askew property owner and Jane Stamp property tenant. The case has been referred to the County Attorney's office to proceed with Legal action. Ms. Stamp submitted paperwork associated with an application stating the application was incomplete and requesting allowances of time to complete the requested and require documentation. This letter serves as a review of the submitted materials. One original application form (additional copies may be required, on request of the Department of Planning Services) The application has been signed by Ms. Jane Stamp only. An authorization form signed by Mr. William Askew, property owner was not provided. To submit an application, the property owner is required to designate Ms. Stamp as the person of contact for the purpose of this application. With this stipulation, Ms. Stamp will be the point of contact for all matters of interest specific to the Special Use Permit application. Staff is in receipt of a single copy, three additional copies of this sheet is required. Explain, in detail, the proposed use of the property. The proposed facility is for a Breeding Kennel for up to 50 miniature Dachshund and Bernese Mountain dogs. The ratio will depend on litter numbers. Also, a small engine and brake repair shop will operate sporadically during the course of the calendar year. • 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. Section 22-2-20 A.Goal 1 states, "Respect and encourage the continuation of agricultural land uses and agricultural operations for purposes which enhance the economic health and sustainability of agriculture." The parcel on which the Kennel facility is located is a parcel created in November 2003 and consists of approximately 1.2 acres. There are existing improvements: The Askew/Stamp residence, outbuildings and numerous oil and gas encumbrances. The Breeding Kennel is for 50 dogs. Section 22-2-90.E. C.Goal 5. states "Minimize the incompatibilities that occur between commercial uses and surrounding properties." The vehicle service and repair establishment consisting of small engine and brake repair will be within an enclosed garage and will occur intermittently throughout the calendar year. Any outdoor storage will be appropriately screened from adjacent properties and public road rights-of-way. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. The proposed use is consistent with the intent of the A(Agricultural) Zone District. Section 23-3-40.K of the Weld County Code provides for Kennels(to accommodate 50 dogs of two breed types, miniature Dachshund and Bernese Mountain dogs), in the A (Agricultural) Zone District. • The proposed use is also consistent with Section 23-3-40.R of the Weld County Code provides for any use permitted as a Use by Right, an accessory use, or a Use by Special Review in the Commercial or industrial zone districts, (Vehicle 0 • • Service/Repair Establishments) provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions. The property is surrounded by roads on three sides. A single track rail is to the East, properties are agrarian in nature with single family residences and outbuildings.
