The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at 9th Avenue and 9th Street, Greeley, Colorado, October 4, 1977 at the hour of nine o'clock. ROLL CALL: The following members were present: Nancy Clark, President Bob E. White, Vice President John T. Martin, Councilman Floyd Oliver, Councilman Robert Martin, Councilman Also present: Mr. Robert Ray; Sheriff Bower; Undersheriff Shockley; Wanda Allen; 5 members of the press; and the secretary, Bev Thomas. Present for a brief time: Commis- sioners Norm Carlson and Ed Dunbar. ADDITIONS TO THE AGENDA: Nancy Clark made two additions to the agenda: 1) Council would be meeting with their lawyer in Executive Session 2) Council's response to advertisement in Greeley Tribune. Bob White added the request for the County Attorneys ' time sheets. r` MINUTES: Bob White made a motion that the September 20, 1977 minutes be adopted. The motion was seconded by Bob Martin and carried. Floyd Oliver made a motion that the minutes of the September 23, 1977 meeting be adopted. Bob Martin seconded the motion and it carried. CORRESPONDENCE: Nancy Clark mentioned memos received from the finance office and buildings and grounds and read an invitation to an Energy Symposium. REPORTS: ENGINEERING: Floyd Oliver stated that the Commissioners are now considering the need for a north-south road east of Ft. Lupton to eliminate schoolbuses having to cross railroad tracks numerous times. He thought this was an important request and that it required careful consideration. PLANNING: Nancy Clark stated that during October the final emissions tests are to be completed on the Rolanda Feed. Company operation. MILLER RESOLUTION: Nancy explained the background of the Bob Miller conflict of interest case handled by the Council in October, 1976. After an Executive Session with their attorney to receive advice • on this matter, the Council reconvened the public meeting. 770970 County Council Minns Page 2 October 4, 1977 Bob White made a motion that the Council instruct Mr. Robert Ray to reexamine the actions taken by the Council previously regarding the Miller conflict of interest case and-that Mr. Ray should draw up a resolution to state the Council 's decision on that matter. Floyd Oliver seconded the motion and it passed unanimously. MEETING WITH SHERIFF AND UNDERSHERIFF: Nancy introduced Mr. Bower and Mr. Shockley. She explained that the Council wished to discuss the 1978 Budget with the Sheriff because of the large increases requested by the Sheriff's Department. Sheriff Bower said that their 1978 Budget request was virtually the same as their 1977 Budget. However, in their proposed supplemental budget (Revenue Sharing money) there were requests to cover new programs. Nancy asked the Sheriff to discuss where he sees his budget increase needs and why the increases are necessary. The Sheriff explained that 54 additional staff members will be required to staff the new jail. He pointed out that the new jail creates 10 new positions, but every position requires 5.1 persons to fill it because of the 24-hour-a-day, 7-day-a-week coverage required. He added that the new jail will provide separate facilities for females and juveniles. He stated that many requirements for housing prisoners, such as health services, recently decreed necessary in the courts are not met in the present jail. It was explained that a complete survey of the cost estimates of the new jail were done by the National Institute of Corrections. The survey had verified the cost estimates were valid and had, in fact, recommended 85 persons by used to staff the new facility. Mr. Shockley stated that the major complaints the Department receives are regarding the Department's ability to get to a given area of the County quickly enough. It was pointed out that the proposed bolstering of the Ft. Lupton Substation would help to solve this problem. An officer at this, location to give briefings would also shorten the transition time required to mobilize a shift change. The groups also discussed: the Department's cooperation with other law-enforcement agencies; use of the Grand Jury; leasing versus owning Department vehicles. It was stated that the supplemental budget request doubles the Sheriff's budget and the Sheriff agreed that at some future time these new items started with Revenue Sharing monies would have to be incorporated into the regular budget. OLD BUSINESS: County Council Mi..ates Page 3 October 4, 1977 HIRING AN INVESTIGATOR The need for the Council to have someone to investigate certain matters was discussed. Bob Martin said that he planned to get some recommendations from persons in private industry as to who might be qualified to assist the Council. Nancy Clark felt unsure what was the best route to take in the matter with the amount of money the Council had to spend. Bob White made a motion that the Council secretary keep a record of the Council 's concerns that need further investiga- tion. Floyd Oliver seconded the motion and it carried. REQUEST FOR COUNTY ATTORNEYS' TIMES SHEETS: Bob White stated that due to the increasing number of resolutions being held over by the County Attorney's office the Council should pursue a review of that Department. He said this was not to be construed as criticism, but possibly more help was needed in that department, or a check should be made to see if time is being used properly. Bob White made a motion that the Council shall request from the County Commissioners the log time of the three attorneys in the Department of Law from June 1, 1977 to October 1, 1977. This request shall also include all policies relating to the use of the Department of Law.and any other pertinent information relating to the Department of Law. This request is made pursuant to the County Council 's review powers. John Martin seconded the motion and it passed. ATTENDANCE AT BUDGET HEARINGS: It was determined that Council- members would attend the Budget meetings according to the following schedule: October 6 AM and PM Bob White/Floyd Oliver October 7 AM Bob Martin October 11 AM and PM Floyd Oliver October 12 PM Bob White October 13 PM Bob Martin October 14 AM and PM Bob White October 17 PM Floyd Oliver October 18 PM Nancy Clark October 19 evening Nancy Clark RESPONSE TO TRIBUNE ADVERTISEMENT: Bob Martin read a statement that he had prepared that reflected his personal response to the advertisement printed by the Executive Committee of the Demo- cratic Party of Weld County. A discussion was held regarding what avenue of response, if any, should be taken by the Council to this advertisement. Floyd Oliver made a motion that the Council put an appropriate answer in a block advertisement in the Greeley Tribune. Bob White seconded the motion. The motion carried 4 to 1 with Nancy Clark stating her objections to the Council paying for an • County Council Mii 'es Page 4 October 4, 1977 • advertisement that would appear to be opinion. John Martin was instructed to edit a statement to be published. Bob White made a motion that the Council write a letter to the Executive Committee of the Democratic Party of Weld County stating that the Council would welcome a chance to talk with any members of that Committee. Furthermore the Council would gladly show them any of the Council 's documents. The letter shall also state the Council feels that the Committee owes them an apology and suggest a meeting time with the Committee on November 1, 1977.
