HomeMy WebLinkAbout20101609.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 21, 2010 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, July 21, 2010, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner William F. Garcia — EXCUSED Commissioner David E. Long Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Finance and Administration, Monica Mika MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of July 19, 2010, as printed. Commissioner Long seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: R. Chris Eikenberg, Weld County resident, submitted the worksheet which was utilized to calculate the amount of child support her ex-husband pays into the record, marked Exhibit A. She stated that she submitted the worksheet in order to allow the Board to see the poor quality of the print, which she spoke about at the last Board meeting. She stated she wants the Board to eliminate the low-income adjustments for child support calculations because adjustments are also made based on the amount of time the children spend with each parent. Ms. Eikenberg stated the low-income child support adjustment is not acceptable because she will have to apply for a higher food stamp allowance as a result of the reduction in child support, which affects Weld County's tax payers. She stated her ex-husband does not live in Weld County; therefore, she does not understand why he is being given the low-income child support adjustment, since it does not benefit Weld County's citizens. She stated she must provide proof of her address and income; however, the Department of Human Services will not tell her whether her ex-husband is working and the staff has an argumentative spirit. Ms. Eikenberg indicated she pays a $25.00 fee to ensure her child support matter is periodically reviewed and she wants the fee to be divided between her and her ex-husband. She stated she has contacted Chief Judge Hartmann about this matter, and three (3) churches have offered to host a forum to discuss how child support is calculated. She stated she is disabled; however, she is looking for work, and when her income increases, she reports it to the judge. She stated the Board needs to hold her ex-husband accountable for proving his residence and income information. In response to Ms. Eikenberg, Commissioner Kirkmeyer stated staff is working on scheduling a forum about Child Welfare matters for Minutes, July 21, 2010 2010-1609 (1,11 Page 1 BC0016 Ms. Eikenberg's group; however, Judge Hartmann is the appropriate person to speak to regarding how child support obligations are determined. She stated the worksheet Ms. Eikenberg submitted into the record is a judicial form; not a form from the Department of Human Services; therefore, she needs to address that issue with Judge Hartmann as well. CONSENT AGENDA: Commissioner Long moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. PRESENTATIONS: PRESENTATION OF FAIR BOOK TO BOARD —WELD COUNTY FAIR ROYALTY: Deeona Johnston, Weld County Fair Queen, stated she is 17 years old and she will be a senior at Pawnee High School this fall. She stated she is active in Future Farmers of America (FFA), National Honor Society, Student Council, sports, and 4-H. She stated she is serving as the President of both FFA and 4-H this year, and she has been a member of the Grover Guys and Gals 4-H Club for ten (10) years. Ms. Johnston stated her goals are to attend college and major in pre-physical therapy and pre-chiropractics, and to ultimately become a chiropractor. She thanked the Board for its past and present support of the Fair and 4-H, and she provided a summary of this year's Fair events, which will commence June 28, 2010, and end August 2, 2010, and includes the first annual parade on Sunday, August 1, 2010, at 11:00 a.m. Savannah Gallegos, Weld County Fair Attendant, stated this year celebrates 100 years of 4-H. She stated 4-H allows youth to learn responsibility and dedication. She stated the Fair Royalty has participated in the Brush, Estes Park, and Greeley Stampede Parades; the Calves Convention in the City of Colorado Springs; and the Rooftop Rodeo. She stated she has independently volunteered 44 hours at the National Western Stock Show and participated in the Eaton Parade. Ms. Gallegos stated the Fair Royalty has a radio interview scheduled tomorrow morning and they will also be participating in the upcoming Eaton Parade. Megan Thormodsgard, Weld County Fair Princess, stated she is 15 years old and she will be a sophomore at Briggsdale High School in the fall. She stated she is active in her school and the community, and she is the Vice President of the Crow Creek 4-H Club and the secretary for the National Honor Society. She stated she usually shows sheep, beef, and goats at the Fair; however, due to her hectic schedule as Fair Princess, she will only be showing beef and sheep this year. Commissioner Conway thanked all three (3) ladies for their outstanding presentations and being ambassadors for the Fair, which is one (1) of the most important events in Weld County. He stated he will accept the Fair Royalty's invitation to attend the first annual parade. Commissioner Long stated the ladies make their parents and communities proud by serving as Fair Royalty. He thanked Pat Kindvall for working with the Weld County Fair Royalty and teaching them to be great ambassadors for Weld County. Commissioner Kirkmeyer thanked Ms. Kindvall for the many years she served on the Fair Board and working with various committees. Chair Rademacher expressed his appreciation to Ms. Kindvall and stated this year's Fair Royalty is an impressive group of young ladies, and he thanked the Fair Royalty for supporting agriculture and being good ambassadors for Weld County. RECOGNITION OF SERVICES, DEPARTMENT OF HUMAN SERVICES — KENDRA FRITZLER: Chair Rademacher read the certificate into the record, recognizing Kendra Fritzler for 30 years of service with the Department of Human Services. COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated the Board attended a meeting with an Air Quality Control Commission representative, Doug Lempke, on Monday, and the Board did not receive the answers it was looking for; however, Mr. Lempke agreed to further consider the Board's concerns about the Rule Making Hearing. Chair Rademacher thanked Mr. Lempke for participating in the meeting and attempting to mitigate the Board's concerns. Commissioner Kirkmeyer stated maybe the Air Quality Control Commission will consider changing the selection process for Minutes, July 21, 2010 2010-1609 Page 2 BC0016 hearing officers in order to avoid selecting biased officers, in addition to considering possible conflicts of interest. BIDS: PRESENT BID #B1000100, REMODELING OF WELD COUNTY ADMINISTRATION BUILDING (FORMERLY THE SYKES BUILDING) - DEPARTMENT OF BUILDINGS AND GROUNDS: Monica Mika, Director of Finance and Administration, stated said bid will be presented for approval on August 4, 2010, and she recommended the Board conduct a work session to discuss the numerous variables within the bid. She stated all the vendors, except one (1), are located within the State. She suggested one (1) name of the building be agreed on for consistency. OLD BUSINESS: CONSIDER PROFESSIONAL SERVICE AGREEMENT AND AUTHORIZE CHAIR TO SIGN - COLORADO TRACTOR PULLERS ASSOCIATION (CGTPA) (CONT FROM 7/19/10): Bruce Barker, County Attorney, stated this agreement has been updated to the correct form; therefore, he recommends approval. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Long, the motion carried unanimously. NEW BUSINESS: CONSIDER ENTRY UPON VARIOUS LANDS BY WELD COUNTY VEGETATION MANAGEMENT SPECIALIST: Tina Booton, Department of Public Works, Weed Division, stated under the Colorado Weed Management Act and the Weld County Code, she must seek right of entry from the Board to enter onto private lands to carry out weed control measures. Chair Rademacher stated the list of property owners is longer than usual today. He stated Carma Bayshore, LLC, has a significant amount of infrastructure which may be damaged by weed control measures; however, Ms. Booton assured him at a previous meeting that the contractors have liability insurance. Ms. Booton stated there are meetings scheduled with Carma Bayshore, LLC; Asphalt Paving Company; and Consolidated Mutual Water Company; however, she wanted to have approval from the Board in case she needs to move forward with entering onto the properties, since complaints about the properties are being received. In response to Commissioner Conway, Ms. Booton stated efforts to work out a plan of action with the property owners have been occurring since the month of May. Responding to Chair Rademacher, Ms. Booton stated there is one (1) mowing contractor which the County utilizes, and the contractor has multiple machines and several employees. Commissioner Long moved to approve entry upon said lands by a Weld County Vegetation Management Specialist. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER AUTHORIZATION OF SALE OF WELD COUNTY PROPERTY AND EXCLUSIVE RIGHT- TO-SELL LISTING CONTRACT AND AUTHORIZE CHAIR TO SIGN - SEARS REAL ESTATE: Mr. Barker stated Stephanie Arries, Assistant County Attorney, sent an e-mail yesterday to the Board about this matter. He stated the property was obtained by the County through a judicial action against the property owner, and the lot will be listed for $20,000.00. He stated the County has had listing contracts for other properties in the past, and each time the County has listed a property in Hill-N-Park, it has been successfully sold. In response to Commissioner Conway, Mr. Barker stated the County has received the listing price for the properties it has sold and once the County received more than the listing price. Commissioner Conway moved to authorize the sale of said Weld County property, approve said contract, and authorize the Chair to sign. Seconded by Commissioner Long, the motion carried unanimously. CONSIDER GEOSPATIAL INTERGOVERNMENTAL AGREEMENT AND AUTHORIZE CHAIR TO SIGN: Dan Huerter, Geographic Information Systems (GIS), stated there are approximately six (6) active agreements with the State for GIS data, and this agreement will replace all the existing agreements. He clarified this agreement will allow any State agency to be able to gain access to Weld Minutes, July 21, 2010 2010-1609 Page 3 BC0016 County GIS data without a separate agreement; the State agencies will gain access through the State Office of Information Technology. In response to Chair Rademacher, Mr. Huerter confirmed this is the first time the County has entered into this particular agreement with the State, and he indicated he does not have any concerns about it. Further responding to Chair Rademacher, Mr. Huerter stated this agreement will make the process easier for both parties, since he will provide data to just one (1) State agency, and then the State Office of Information Technology will be responsible for providing the information to the other State agencies which require it. In response to Commissioner Conway, Mr. Huerter confirmed the benefit to Weld County is less staff time will be utilized. In response to Chair Rademacher, Mr. Barker stated he has reviewed the agreement and concurs with Mr. Huerter; in the past there were agreements with every State agency which requested the information and it required a great deal of staff time. He recommended approval of the agreement. In response to Ms. Mika, Mr. Huerter stated the County has never charged the State or municipalities for GIS data. In response to Chair Rademacher, Mr. Huerter confirmed staff charges for hard copies to recover its costs. Responding to Commissioner Kirkmeyer, Mr. Huerter confirmed Weld County will be also be able to access the State's GIS data, as a result of this agreement. Ms. Mika inquired as to whether the State can share this information with the Census. Mr. Huerter stated the Census prefers to work with the most local levels of government possible. Responding to Commissioner Conway, Mr. Huerter stated the County previously had reciprocal agreements with the State which were at no cost to either party; however, the County seldom requests GIS data from the State. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. CONSIDER GRANT AGREEMENT TO REHABILITATE PORTION OF GREELEY-WELD COUNTY AIRPORT TAXILANES AND APRON AND AUTHORIZE CHAIR TO SIGN: Mike Reisman, Greeley-Weld County Airport, stated this is the second half of the annual Federal Aviation Administration (FAA) grant funding, and the Board accepted the first half of the grant funding several months ago. He stated the Airport has completed the bid process for the rehabilitation project, and these grant funds will allow it to finalize the payment for the design and engineering plans and to commence construction. In response to Chair Rademacher, Mr. Reisman confirmed the grant amount is $75,000.00, and the County's matching fund commitment is $937.00. Further responding to Chair Rademacher, Mr. Reisman stated the City of Greeley will also provide matching funding in the amount of $937.00. In response to Commissioner Kirkmeyer, Mr. Reisman stated the Airport Board approved the first half of the grant and it will also need to ratify this portion of the grant, and the Greeley City Council will approve the grant at its meeting on August 4, 2010. He stated the City of Greeley and Weld County are co-sponsors of all the Airport's Federal grants and both entities need to approve the agreements. In response to Commissioner Kirkmeyer, Mr. Reisman confirmed both the City of Greeley and Weld County are signatories for the agreement. Responding to Commissioner Kirkmeyer, Mr. Barker stated he will review the agreement. Commissioner Kirkmeyer stated there is a condition in the agreement which indicates liabilities will be pursued in court and she wants to ensure it is consistent with other County agreements. Mr. Reisman stated there is nothing in the agreement which is different from previous years. In response to Commissioner Conway, Mr. Reisman stated the Board has approved approximately 14 or 15 of these agreements over the past ten (10) years, and there are no new terms or conditions. Chair Rademacher stated it would be appropriate to approve the agreement contingent upon the County Attorney reviewing and approving it. Commissioner Conway moved to approve said agreement and authorize the Chair to sign, conditional upon the County Attorney reviewing the agreement and deeming it to be acceptable. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. PHEALTH INSURANCE PREMIUM CALCULATION If the actual amount of the health insurance premium that is attributable to the child(ren) who is the subject of this order is not available or cannot be verified, the total cost of the premium should be divided by the number of persons covered by the policy to determine a per person cost. This amount is then multiplied by the number of children who are the subject of this order and are covered by the policy. This amount is then entered on line 6c on the front of this form.
