ANNEXATION PETITION, AND SETTING A PUBLIC HEARING FOR
AUGUST 3'm, 2010 TO DETERMINE IF THE PROPOSED APPROXIMATE
54.044 ACRE PROPERTY TO BE KNOWN AS THE VESTAS BLADES AND
NACELLE CAMPUS SOUTH ANNEXATION, COMPLIES WITH STATUTORY
REQUIREMENTS FOR SUCH ANNEXATION.
RESOLUTION NO.: 2010-63
WHEREAS, pursuant to the laws of the State of Colorado, there was presented to and
filed on May 24, 2010, with the City of Brighton, Colorado, a written Petition for Annexation to
and by the City of Brighton, Colorado, of the hereinafter-described contiguous unincorporated
territory situated, lying, and being in the County of Weld, State of Colorado, more particularly
described in Exhibit"A" attached hereto; and
WHEREAS, the City Council of the City of Brighton, Colorado, has reviewed the
Petition for Annexation to the City of Brighton of the hereinafter-described contiguous
unincorporated territory; and
WHEREAS, the City Council desires to adopt by resolution its findings in regards to
such Annexation Petition, and to set a public hearing in regard to such petition;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Brighton,
Colorado, as follows:
1. The Petition for Annexation attached hereto and incorporated herein by reference as
Exhibit "B" is in substantial compliance with the applicable laws of the State of
Colorado (Colorado Revised Statutes Section 31-12-107(1), 1973, as amended);
2. The City Council of the City of Brighton, Colorado will hold a public hearing for the
purpose of determining if the proposed annexation complies with Colorado Revised
Statutes Sections 31-12-104 and 31-12-105, 1973, as amended, at the following time,
date, and place:

The undersigned, in accordance with the Municipal Annexation Act of 1965, Chapter
31, Article 12, of the Colorado Revised Statutes, 1973, as amended, hereby petition the City
Council of the City of Brighton for annexation to the City of Brighton of the followi_tg
described land located in the County of(strike non-applicable county) Adams/Weld, State of
Colorado,and further stale:
1. The legal description of the land which the landowner(s) request to be annexed to the
City of Brighton is attached hereto as EXHIBIT "A", hereinafter referred to at the
"Property"
2.. It. is desirable and necessary that the Property be annexed to the City of Brighton,
Colorado;
3. The following requirements of C.R.S. Section 31-12-104 exists or have been met:
A. Not less than one-sixth(1/6)of the perimeter of the Property is contiguous with
the City of Brighton, Colorado;
B. A community of interest exists between the Property and the City of Brighten,
Colorado. The Properly is urban or will be urbanized in the near f=uture, and the
Property is integrated or is capable of being integrated with the City of Brighten,
Colorado;
4. The signers of the Petition comprise the landowners of one hundred percent(100%)of
the Property(exclusive of street_ and alleys) and said landowners attesting to the facts
and agreeing to the conditions herein contained will negate the necessity of any
annexation election;
5. None of the limitations provided in C.R.S. Section 31-12-105 are applicable and the
requirements of that statute have been met because of the following:
A. The annexation of the Property will not result in the Properly being divided into
separate parts or parcels tinder identical ownership without the written consent
of the landowners thereof;
B. No land area within the Property held in identical ownership.whether consisting
of one tract or parcel of real estate or two or more contiguous tracts or parcels of

real estate comprising 20 acres or more and having a valuation for assessment in
excess of S200,000 for ad valorem tax purposes has been included in the arca of

the Property by any other municipality;
D. The entire width of all streets and alleys to be included within the Property are
included;
E. The annexation of the Properly will not result in the detachment of area from
any school district or the attachment of same to another school district;
F. Annexation by the City of the Property will not have the effect of, and will not
result in,the denial of reasonable access to landowners,owners of an easement,
or owners of a franchise adjoining a platted street or alley, inasmuch as
annexation of the Property will not result in annexation of a platted street or
alley which is not bounded on both sides by the City.
6. The annexation of the Property will not have the effect of extending a houndary of the
City more than three miles in any direction from any point of the municipal boundary in
the past twelve(12)months.

Re: Vestas Blades and Nacelle South Campus Annexation
Location: Southwest 1/4 of Section 29, and Southeast % of Section 30, Township 1 North, Range 66
West of the 61h Principal Meridian, County of Weld, State of Colorado
This report has been prepared in fulfillment of the requirements of C.R.S. 31-12-108(2)
concerning annexation impact reports. The annexation involves an approximate 54 acres of land
generally located east of the Union Pacific Railroad and north of New Energy Drive (fka WCR 4).
The Annexor plans to request an 1-2 (Heavy Industrial) zoning designation for the parcels should
the annexation be approved by the Brighton City Council. The Annexor is preparing a zoning submittal,
and the completion of the zoning must take place within 90 days of Annexation approval by City Council,
pursuant to C.R.S 31-12-115(2).
The Annexor, Vestas Blades America, Inc., a Delaware corporation, owns 100% of the property
and is being represented by Mr. Hans Jespersen, General Manager and Vice President of Vestas Blades
America Inc. The Petition for Annexation has been signed by Mr. Jespersen as owning 100% of the
territory to be annexed.
The following have been included as required within C.R.S. 31-12-108.5(1), (a)through (f):
Extension and Provision of Municipal Services
The City of Brighton will provide the requisite public services including, but not limited to water, sanitary
sewer, roads, storm drainage, and police. There is no draft annexation or pre-annexation agreements
available at this time.
Method for Financing Extension of Utilities
The City of Brighton has worked in cooperation with Weld County and the Annexor to receive State and
Federal Grants which have funded the utility and road improvements to this property.
Districts Within the Area to be Annexed
Information obtained through the Weld County Assessor's Office indicates that the following districts exist
within the area to be annexed: School District 27J, Greater Brighton Fire Protection District(FD6), Central
Colorado Water Conservancy District (CCWCD), Central Colorado Water Sub District, High Plains Library
District.
School Impacts
This annexation will not require the modification of any school district boundaries. The property is within
School District 27J boundary. The Annexor is proposing 1-2 (Heavy Industrial) development, so there will
not be any additional residents to be served.
