Planning Services research of the current permitting determined that the North Weld County mine has an existing Division of Reclamation Mining and Safety Permit, Number M1976- 018. Staff review of the Special Use Permit 298 case file determined that the intent of the approved facility was to mine sand and gravel, screen, crush and stockpile the aggregate prior to hauling by truck to sites not determined. The questionnaire also indicated that a concrete batch plant was possible, although the Board of County Commissioner's resolution does not so indicate approval of such equipment or site use. As stated in your electronic mail of April 6, 2010, the current operation is permitted to remove up to 70,000 tons of aggregate annually, to a depth of twenty feet. Your inquiry requested consideration to extract gravel at a rate of up to 350,000 tons per year, with all other terms of the current permit remaining constant. Staff discussed this request internally and with representatives with the Public Works department on Friday April 9, 2010. It is the determination of the combined offices that this request is a major change in the current approved operations. Further, the discussion by the Planning Commission at public hearing on April 7, 1976 stipulated "Any changes to the plans, i � 2010-0818 PtoJ52i extraction standards and/or reclamation standards shall require approval of another Special Use Permit before such changes are allowed." Given the increase in extraction, this office will require an amendment to the existing permit. It is important to note that the entire permit will be reviewed under current codes and standards. The first step in this amendment process is to meet with County staff to discuss the application process. As discussed in your voicemail message, please find the following information in direct application to the subject operation. The gravel pit I referenced is entitled North Weld Gravel, which currently operates under DRMS Permit No. M-2009-062 (formerly M-1976-018). This has been a small scale, active operation since the mid-1970's, and was purchased by its current owner in 1991. Name: North Weld Gravel Owner: Leroy Bellmore Previous Owner: Melvin Geib (Original Permitee) Legal Description: That part of the East Half(EY2) of the Northeast Quarter(NE%) of Section 7, Township 8 North, Range 65 West of the 6th Principle Meridian, Weld County, Colorado, being more particularly as follows: Beginning at the Northeast Corner of said Section 8, said point being the True Point of Beginning and considering the East line of the Northeast Quarter (NE%) of said Section 7 as bearing South 01°20'50" East, with all bearings contained herein being relative thereto; Thence South 01°20'50" East along said East line2589.3 feet; thence South 89°08'48" West 1339.67 feet; thence North 01°15'20" West 2585.69 feet; thence North 88°55'53" East 1335.24 feet to the True Point of Beginning. Said described parcel of ground contains 79.45 acres, more or less. Description of Current Operations: North Weld Gravel is a construction gravel supply operation at the above referenced location, and northeast of Ault, Colorado. The existing facility operates a dry mining operation, whereby the depth of mining ranges to approximately 16 feet (the natural extent of the mineable deposit). As such, no groundwater is exposed during mining processes. The current operation plan facilitates the removal of up to 70,000 tons of overburden and aggregate annually, and allows for a total disturbance area of up to 20 acres. The current Reclamation Plan specifies the removal, stockpiling, and replacement of existing topsoil and overburden, prior to reseeding the disturbed areas. Proposed future Operations: North Weld Gravel is proposing to extract gravel at a rate of up to 350,000 tons per year, with all other terms of current permits remaining unchanged. North Weld Gravel will maintain operations within the current mining limits. 1 It is my understanding that the above information provides sufficient detail to facilitate a cursory review by Yourself/and or Weld County Staff,which will take place on Friday April 9, 2010.
