Once drilling is completed, the traffic using the access will return to its original volume. As a part of our USR application which has been approved, Jacqueline has requested that I provide evidence that Kerr-McGee has obtained a permit gain drive access to Hwy 66. How do I go about obtaining a copy of that permit from you? I know that our contractors have pulled a blanket permit from CDOT for all trucks for the drilling process. I will be out of town from June 29-July15, but will be sure to have Kim or Crystal forward that to you once it is received by our office. After this item is submitted, the only thing that remains is approved mylars from Weld County. I know that Kim has been working diligently to get these correct for Weld County. I am requesting a second set of paper copies for review prior to making the mylar. The only remaining condition of approval left is sign off from Public Works which consists of them reviewing the second set of paper plats and approving them. In regards to USR-1664 I only received one copy of the drawings for the SE4 and SW4 but not the NW4 and NE4. I will need two sets of each to review. Section 35: Part of the SW/4NE/4 Weld County, Colorado Parcel#1207-35-1-05-023 Dear Ms. Hatch: This letter serves as Kerr-McGee Oil and Gas OnShore LP's ("KMG") official response to the resolution approved by the Weld County Board of County Commissioners on Use-by- Special Review#1664. Attached please find a copy of the approved resolution for your reference. 1. Prior to recording the plat: A. The plat has been amended to delineate the following items that the Weld County Board required: Attachment of the Development Standards, that the plat shall comply to section 23-2-260.D of the Weld County Code, County Road 28 is classified as a minor arterial road which requires a 100 foot. Right-of-Way. A total of 50 feet from centerline has been delineated on the Mylar plat. The access road has been constructed to provide all weather access and proper drainage. Attached find the two (2) paper copies Weld County has requested. B. The Colorado Department of Transportation(CDOT) did not respond to KMG's efforts to contact them regarding the above referenced oil and gas facility and the CDOT referral dated July 11, 2008. Their presence was not noted at the Weld County Board hearing. KMG has complied with the Stormwater drainage, overweight county permits, and emergency access requirements for this facility as mentioned by Weld County Public Works in their referral of August 11, 2008. There is a negotiated and finalized surface use agreement between KMG and Carma Bayshore LLC. A copy of this surface use agreement has been attached. The production facilities for this location were negotiated with the surface owner. In an accommodation on KMG's part, production facilities have been placed where the surface owner requested. KMG has been in contact with Mr. Boda and he is aware of the production facilities. There was an agreement put in place between KMG and Mr. Boda involving a trailer. A copy of this agreement has been attached. KMG does not feel that there is a need to move the production facilities from their location near Mr. Boda's property. Additionally, there has not been any additional comment from the Town of Mead regarding this matter. The Town of Mead was not present at the Weld County Board hearing for the above referenced facility. E. KMG will furnish the Department of Planning services with a digital/electronic copy of the Use-by-Special Review in one of the acceptable formats requested by Weld County.
