RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000113 AGAINST DORIS CUNNINGHAM, C/O PEONIO/CAVALIER/MOSSER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Doris Cunningham, c/o Peonio/Cavalier/Mosser, ZCV #1000113, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of October, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Travis Peonio, Tenant, was present at said hearing and provided testimony, and was also represented by Attorney Chris Matz, Kumin Sommers, LLP, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. He said he received another letter and was calling in to see what was going on. I explained that Peggy sent him a letter dated 09/02/10. I sent him a letter on 09/15/10. I explained that Peggy's is for the building issues and my letter is for the zoning issues. He asked what zoning issues he had left. He said he removed the new guy who started the grow upstairs (with the COLORADO Planning Department ZONING VIOLATION CASE SUMMARY 5 plants) and they are down around the 60 (12 plants per patient per the doctors notes). I told him that I needed do discuss this argument with the County Attorney's Office. I then asked about which one of them was the caregiver. I explained that the new statute states that the Primary Caregiver can not have his/her own Primary Caregiver. He said he would have to see which one of them would be eligible. I told him I would call him back after discussion with the County Attorney's Office. 09/23/2010 Phone call Travis Peonio called (388-6164). He explained he was still a patient, but he was simply his own caregiver. ((After discussion with the County Attorney's Office, I called Travis back)). I explained that was fine, he just would count as 1 (one) of the patients for which he was caring. So, they would still be limited to providing medical marijuana for 5 patients. I asked who he would like to remove. He said he wanted to remove Nicholas Perich. I then explained that it had been determined that 6 plants per patient was what our Zoning Code would allow. The State Statute says that more than 6 plants could be raised as an Affirmative Defense to violation of state law (criminal proceedings), but did not say anything about local Zoning jurisdictions. I explained if they wanted to argue our interpretation, I could schedule them for a Violation Hearing and they could present their argument before the Board of County Commissioners. He indicated they would probably go that route, but he needed to talk to his partners tonight and would get back in touch with me.
