RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #0900045 AGAINST KOENIG/STAGNER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lee Koenig (heirs of), do James Stagner, ZCV #0900045, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of September, 2010, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Lee Koenig (heirs of), and James Stagner were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Lee Koenig (heirs of), c/o James Stagner, to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. I spoke to him (didn't get a name). I explained that I was trying to close cases that had been passed on by the previous compliance office, but I noted the derelict vehicle (CO WLH-901) on the property. He said the vehicle was on his property (not the street), so it shouldn't matter. I explained if on the street the Sheriffs Office deals with it and if it's on the property, I deal with it. I explained the vehicle needed to be restored or removed from the property. He said he would pass the information along. The other 2 (two) vehicles had current license plates (CO 072-FGS and CO 183-SEB). I left my business card with the guy. No pictures were taken during this inspection.
