I;n'� a" i7 - 4a r, 4F�e ,n l.:• C 11 , • �I i .J ' j,7,:-.1, I— I 5 R v ,7G a 2 Ac, .G e a� I ' `)D\U 1 t fj cl� m�C _ 'r m c RESOLUTION WHEREAS, a hearing was held on April 14 , 1976 , in the chambers of the Board of County Commissioners, Weld County, Colorado for the purpose of hearing the petition of Andrews and Company, Harry Andrews, Route 4 , Box 222, Greeley, Colorado 80631, requesting permission to locate a hog farrowing expansion on the following described property, to-wit: A parcel of ground located in the Southwest quarter (SW4) of Section 29 , Township 7 North, Ranger 64 West of the 6th Principal Meridian, Weld County, Colorado, being more particularly described as follows : Beginning at the South Quarter Corner (S4Cor) of Section 29, and considering the South Line of the Southwest Quarter (SW4) of said Section 29 as bearing West; Thence West along the South Line of the Southwest Quarter (SW4) of said Section 29, 1278 . 43 feet to the centerline of an irrigation ditch; Thence along the centerline of said irrigation ditch by the following three (3) courses and distances : North 20°44 ' 45" West, 498 .18 feet; North 08°51' 35" West, 317 . 34 feet; North 01°27 ' 30" West, 419. 69 feet; Thence East, 1528 . 96 feet to a point on the East Line of the Southwest Quarter (SW4) of said Section 29; Thence South 00°41' 36" West, along the East Line of the Southwest Quarter (SW4) of said Section 29, 1199. 07 feet to the Point of Beginning. Said described parcel of ground contains 40. 000 acres, more or less , including a strip of ground 30 feet in width along the South Line for County Road R-O-W purposes , and is subject to any other rights-of-way or other easements as granted or reserved by instruments of record as now existing on said parcel of ground. WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to locate said hog farrowing expansion operation on the above described premises, and WHEREAS, the said requested hog farrowing expansion operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3 . 3 (3) (c) of the Zoning Resolution of Weld County, said hog farrowing expansion operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Andrews and Company, Harry Andrews, Route 4 , Box 222 , Greeley, Colorado 80631, to locate a hog farrowing expansion operation on the premises indicated above be, and it hereby is granted under the conditions following: PL0591 { � 760142 sap a96 The Weld County Planning Commission held a luncheon meeting on Tuesday, March 2, 1976, at the Holiday Inn, Greeley, Colorado at 12:1)0 noon. Water Conservancy District A letter dated February 26, 1976, regarding Parkland Estates from Gary Fisher, Colorado Land Use Commission, was briefly reviewed by Planning Com- mission members. The Weld County Planning Commission held a renularly scheduled meeting on Tuesday, larch 2, 1976, at 1 :30 P. M. , in the County Commissioners meeting room, second floor, Public Health Building, Greeley, Colorado. Roll Call was as follows: Ronald Heitman, Chairman Present Bill Elliott Present Harry Ashley Present Jim Graham Present Chuck Carlson Present Marge Yost Absent J. Ben Nix Absent John Weigand Absent Dean Severin Absent As a quorum was present, the meeting proceeded as scheduled. SUBJECT: Minutes MOTION: By Harry Ashley, to approve minutes of February 3, 1976, as submitted. Seconded by Carlson. A unanimous vote of "aye. " MOTION CARRIED. 1255 APPLICANT: Althen-Boyer (Weld County) Tape 628 (#2.734 - 2.780) CASE NUMBER: Z_-270:76:1 SUBJECT: Zone change "C-UD to A" LOCATION: Pt. SW'4 Sec. 23 T1N R68W APPEARANCE: Fred Althen, Jack Boyer DISCUSSION: Condition #3 of the resolution passed by the Board of County Commissioners on August 7, 1974, approving a zone change from "A" Agricultural District to "C-UD" Commercial District, Planned Unit Development has not been fulfilled. Condition #3 reads: "That said change of zone herein granted is conditional only for a period of twelve months from date hereof, on condition that developer proceed with due diligence to begin development of the area rezoned and submit plans for such development for the approval of the Weld County Planning Commission and subsequent recording of said plans in the office of the County Clerk and Recorder of Weld County, Colorado; and that major construction shall commence thereon within said twelve month period; other- wise, the County may take action to rezone the property to its present classification. " Therefore, the County would normally take action to rezone the property to its former classification. On March 1 , 1976, Althen and Boyer presented plans for a use to be developed on said "C-UD" . The use apparently conforms to develop- ment standards on the PUD. Staff feels the proposed use should be evaluated and possible development reviewed with status reports made to the Planning Commission every two weeks until it is established that the development is proceeding in accordance with the resolution granting the zone classification. MOTION: By Chuck Carlson, to take this matter under advisement and request a progress report to the Planning Commission Board in thirty days from this hearing. Seconded by Bill Elliott. A vote of "aye" by Ashley, Heitman, Graham, and Carlson. Motion carried. APPLICANT: Andrews and Company TAPE 628 (#2780 - 2961 ) CASE NUMBER: SUP 296:76:1 SUBJECT: Hog farrowing expansion APPEARANCE: Harry Andrews LOCATION: SWQ Sec. 29 T7N R64W DISCUSSION: Original farrowing operation was approved in 1971 . Mr. Andrews wishes to expand to about 1600 sows, Sows are to be totally confined in the future. Weld County Planning staff recommends approval for the following reasons: 1 ) The proposed expansion of the hog farrowing operation agrees with the Weld County Comprehensive Plan in that the plan states: Expansion and development of agri-business and agriculturally oriented industry will be encouraged, provided these enterprises do not adversely affect the total economy or environment. " It is felt that with the design and controls proposed in this operation, there is little chance for adverse impact on the surrounding environment; 2) the Weld County Extension Service has re- viewed the application and has commented, "In this Proposed e .- pansion there is adequate space for proposed numbers in the various operations. This expansion appears well planned from a design 1256 v ‘ standpoint. Staff does not observe any problems with this expansion or any detrimental effects on the environment; 3) The Weld County Health Department has reviewed the application and has recommended for approval with the following comments: a) the lagoons be designed according to the number of hogs; b) the effluent of lagoons not to enter the surface or ground water. 4) The Weld County Engineering Department reviewed the application and has commented that the existing access is approved and that any new access would need approval prior to installation; 5) No response has been received from the Gale- , ton Fire District, or the Owl Creek Supply and Irrigation Company; 6) A petition supporting the application has been signed by some of the surrounding property owners and has been made part of the application. Planning Office has not received any objections to this application from any of the other adjacent property owners; 7) the Soil Conservation Service has reviewed the application and has commented that the land in Section 29 already has facilities to prevent the hoglot waste from reaching the stream below the feedlot; and 3) the Eaton School District has no Present objections to the request for the Special Use Permit. SUBJECT TO: 1 ) The Special Use Permit shall be limited to the plans submitted and governed by the development standards as stated on the Special Permit Plat. Any changes to the plans and/or the development standards shall require approval of another Special Use Permit before such changes shall be allowed. There is an existing mobile home on the property now, and Mr. Andrews may possibly request three additional ones (permanent type) in the future. Mr. Heitman explained to Mr. Andrews that the mobile home regulations are in the process of being revised and that it may be a requirement that all mobile homes meet the Uniform Building Code. RESOLUTION: Be it therefore resolved by the Weld County Planning Commission to recommend to the Weld County Board of County Commissioners, that the request of Andrews and Company to expand a hog farrowing operation (SUP 296) is granted subject to staff recommendations, and subject to any additional mobile homes to he placed on the property being in compliance with the Uniform Building Code or the !Weld County Zoning Regulations which are in effect at the time these mobile homes are to be placed on the property. Motion by Bill Elliott. Seconded by Jim Graham. A vote of "aye" by Harry Ashley, Bill Elliott, Ronald Heitman, Jim Graham, and Chuck Carlson. Motion Carried. The confined hog farrowing operation on the hereon described forty- acre parcel located in part of the SW' of Section 29, T7N, R64W of the 6th P.M. , Weld County, Colorado, shall be limited to 1500 - 1700 sows and gilts, 80 - 100 boars, 1600 - 2400 baby pigs, and 1600 - 2400 nursery pigs. 2. All phases of the hog farrowing operation shall be enclosed within buildings with the exception of the sow gestation buildings which will have fenced pens. 3. Dust abatement shall be practiced by maintaining sufficient ground cover to prevent erosion and by preventing internal roads and activities from being sources of vagrant dust. 4. Water shall be supplied by the North Weld County Water District and will be adequate in quantity and quality for all domestic and stock uses. 5. The sewage system for the confined hog farrowing operation shall consist of proposed and existing lagoons as shown on the plat. Each of the three proposed residences shall have an individual septic tank. All sanitary and disposal requirements will comply with Weld County and State Health Regulations. 6. There shall be no discharge from any of the existing or proposed lagoons into streams, other bodies of water, or adjacent drainage systems. 7. An application for a discharge permit shall be filed with the Water Quality Control Division of the Colorado Department of Health prior to any building permits being issued. Proof of the granting of such a permit shall be forwarded to the Weld County Planning Commission within thirty days of issuance of the discharge permit. 8. All buildings shall be set back a minimum of fifty feet from the Special Use Permit area boundary. 9. Access shall be limited to the two existing points as shown hereon. 10. Proposed employment shall consist of eight to ten full time employees 11 . Additional housing for the Special Use Permit areas shall be limited to the three proposed residences as shown hereon. Said residences shall be built in conformance with the provision of the Weld County Zoning Resoltuion with respect to the type of structure. ili; 4111 Building permits shall be secured prior to the construction of said re- sidences as well as for any and all of the structures to be located on the Special Use Permit area. 12. Construction will begin within one year of approval . All construction is expected to be completed by January 1 , 1980. 13. The Special Use Permit shall be limited to the plans submitted and governed by the development standards stated above. Any changes to the plans and/or the development standards shall require approval of another Special Use Permit before such changes shall be allowed. 14.
