RE: ACCEPT REQUEST OF JOHN HOCHMILLER TO WITHDRAW APPLICATION FOR A
SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1323
FOR A BUSINESS (COMMERCIAL JUNK OR SALVAGE YARD) IN THE
1-3 (INDUSTRIAL) ZONE DISTRICT AND RESCIND RESOLUTION 2001-1178, DATED
JUNE 6, 2001
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on June 6, 2001, the Board approved the application of John Hochmiller, 19640
Weld County Road 28, Hudson, Colorado 80642, do Bonnie Rogers, 3894 Olive Street, Denver,
Colorado 80207,for a Site Specific Development Plan and Use by Special Review Permit#1323 for
a Business (commercial junk or salvage yard) in the 1-3 (Industrial) Zone District on the following
described real estate, to-wit, and:
Part of the N1/2 N1/2 SE1/4 of Section 32,
Township 3 North, Range 65 West of the 6th P.M.,
Weld County, Colorado
WHEREAS,on October 4, 2010,the Board was presented with a letter,dated September 7,
2010, from the applicant requesting the withdrawal of the application, stating the property is vacant
and the project has been abandoned, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and all of the exhibits and evidence presented
in this matter and, having been fully informed, accepts said request for withdrawal, and
WHEREAS, after review,the Board deems it advisable to grant Mr. Hochmiller's request and
thereby accept the withdrawal of the application and to rescind Resolution #2001-1178, dated
June 6, 2001.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the request of John Hochmiller to withdraw the application for a Site Specific
Development Plan and Use by Special Review Permit #1323 for a Business (commercial junk or
salvage yard) in the 1-3 (Industrial) Zone District on the parcel of land described above be, and
hereby is, accepted.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County,
Colorado, that Resolution #2001-1178, dated June 6, 2001, be, and hereby is, rescinded.

SUBJECT: Request to withdraw approved Site Specific Development
Plan and Special Review Permit# 1323
The Department of Planning Services received a letter dated September 7, 2010 from John
Hochmiller, applicant, for a previously approved Site Specific Development Plan and Special
Review Permit number USR-1323 for a business (Commercial Junk or Salvage Yard) in the 1-3
(Industrial) Zone District.
Mr. Hochmiller indicates that this property is vacant and currently for sale, therefore this project
has been abandoned.
The Department of Planning Services requests support in the applicant's request to withdraw the
previously approved permit, USR-1323.
