The Weld County Public Works Department is in support of relocating the main access from the gravel pit to
the north of the Nix recorded exemption parcel. Access shall be gained on to WCR 19. The approved
approach, acceleration lane, left turn slot, and the additional paving at the plat site are still in place.
The applicant need to submit for review and approval the revised plat drawing identifying the access point and
all approved improvements at that location.

Dear D'on:
As you may be aware, as representative for Ready Mixed Concrete, owner of the Nix Sand
and Gravel (USR-1343) site, we have recently discussed with Weld County officials
changing the location of access to the USR-1343 site. Specifically, Chris Gathman in the
Department of Planning Services has been consulted, and Don Stang of Public Works was
contacted to administer any necessary paperwork. Don Stang advised us to address
specific questions and documentation regarding USR-1343 to you.
For your information, I will briefly describe the background of this request: For reasons
unknown, the point of access originally defined on USR-1343 drawings was not
memorialized in an access easement. The owner of that land, not a part of USR-1343, who
sold the USR-1343 property to Ready Mixed Concrete's predecessor in interest, presently
refuses to provide the access easement across his property.
The point of access shown originally on USR-1343 documents is located on the west side of
WCR 19 at the Quarter-Section line one-half (1/2) mile south of the intersection of WCR 19
and Colo. Hwy 66. The revised point of access will be on the property of the USR-1343
permit, one-quarter (1/4) mile north of the original proposed access. This revision would
align the entry drive with the Quarter-Quarter line and a driveway across the street.
Enclosed are drawings from the USR-1343 plat set, revised to show the entry drive in the
new, permittee-owned location. These revisions are being forwarded to you, as well as
Chris Gathman, to provide a record of this change.
Should there be additional requirements to effect this change, please do not hesitate to
contact me at Banks and Gesso, LLC. For your reference, I have attached an October 5,
2005, memo regarding the planned road improvements for access to USR-1343. The plans
referenced in that memo will be implemented in the new access location. Again, please call
me if any clarification is necessary.

• A copy of the Long Term Road Maintenance and Improvements Agreement as
signed by Ready Mixed Concrete Company, Rick Parkes, VP. Please note that
we have not yet received a copy with the signatures of the Board of County
Commissioners and have not yet been informed if they have or have not signed
the document.
• An original mylar again signed by Rick Parkes, VP of Ready Mixed Concrete
Company and a check for any required fees for final recordation.
These items were all that remained of the conditions contained in USR Permit 1343 to
our knowledge as all other documents have previously been submitted to you.

On December 12, 2005, the Board of County Commissioners approved the Long-Term Road Maintenance and
Improvements Agreement for the new owner of the Nix Gravel Pit dba Ready Mixed Aggregates.
This meets our requirement in the development standards, Item No. 2-I, The applicant shall enter into a Road
Maintenance and Improvements Agreement with the Weld County Public Works Department.
The applicant shall contact the Weld County Public Works Department prior to upgrading and paving of the entrance to
the Nix Gravel Pit so that we can oversee the operation associated with WCR 19 and the entrance.

As a condition of the USR-1343, Item #2, L has been submitted and approved. A detailed construction
drawing has been reviewed showing the improvements for the access on to WCR 19 including acceleration
and a left turn slot. The drawing submitted is dated 9/14/2005, entitled Road Improvement Layout Plan.
This meets the requirement prior to recording the plat for Item #2, L.
The applicant's attorney is working with Lee Morrison on completing the Long-Term Road Maintenance and
Improvements identified as Item #2, I in the Conditions. This document has not been signed by neither the
applicant or the BOCC.

Dear Planning Staff:
On behalf of our client, Owens Brothers Concrete Company, we would like to inform you
that we are in receipt of your letter, dated August 6, 2003, regarding the above
referenced USR application approval. Thank you for the reminder that the plat still
needs to be recorded and that there are still outstanding conditions that need to be met
prior to plat recordation. We can assure Staff that we are currently working towards
finalization of the Use by Special Review process and fully intend to see the process to
completion. As noted in your letter, there is often difficulty and delay encountered in
meeting the Conditions of Approval placed on applications by Staff. There is no
exception to this in the case of USR-1343.
Again, thank your for the reminder that work still needs to be done to complete the USR
process. We look forward to continuing working with Staff to provide the County with the
needed mylar plat and satisfying all conditions.

Re: USR 1343-Nix Sand and Gravel Pit
Dear Kim:
In 2004 my client, Ready Mixed Concrete Company (Ready Mixed), succeeded
Owens Brothers Concrete Company as the owner/operator of the Nix sand and gravel
property located in Section 28; Township 3 North;Range 67 West of the 6th P.M. in
Weld County. On October 4,2006 the plat for USR 1343 (the Nix Property)was
finalized and recorded in Weld County.
This letter is written on behalf Ready Mixed to confirm the"active" status of USR
1343 (Nix). It is my understanding that under Zoning Code Section 23-2-200,to maintain
the "active" status of the Nix USR, sand and gravel mining must commence"within three
(3)years from the date of approval". Since mining could not be commenced until the plat
was recorded, we believe the 3-year clock began on October 4, 2006 (i.e.,the date the
plat was recorded)and that it will therefore expire on October 3, 2009, unless Ready
Mixed is granted an extension of time by Weld County.
Kim,we've talked about this subject, in one fashion or another, several times before
but I thought it best to confirm my understanding of the County's requirements. If the
local/regional demand for sand and gravel products does not rebound in 2009 Ready
Mixed will request Weld County to extend the current October 3, 2009 deadline for
mining to commence. In such case, Ready Mixed would likely seek a minimum
extension of 3 years (i.e.,until October 3,2012). Please advise if this request is one that
staff can act on administratively, or whether it will need to be heard by the BOCC.
