RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 29 :77: 6 FOR AN
EXPANSION TO CHURCH ON A TRACT OF LAND LOCATED IN THE
SOUTHEAST QUARTER OF SECTION 20, TOWNSHIP 5 NORTH, RANGE
64 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO - KERSEY
COMMUNITY CHURCH, BOX 158 , KERSEY, COLORADO 80644 .
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 7th day of September, 1977 ,
at the hour of 9 : 00 o' clock A.M. , for the purpose of hearing the
application of the Kersey Community Church, for the granting of
a Conditional Use Permit for an expansion to a church on the fol-
lowing described real estate, to-wit:
A tract of land located in the Southeast Quarter
(SE4) of Section 20, Township 5 North, Range 64
West of the 6th P.M. , Weld County, Colorado, being
more particularly described as follows : Beginning
at the East Quarter Corner (Eq Cor) of said Section
20, Township 5 North, Range 64 West of the 6th P.M. ,
and considering the East line of said Section 20 to
bear South 00 03 ' 30" East, and with all bearings
contained herein relative thereto: Thence South
00 03 ' 30" East along the East line of said Section
20, 1313. 78 feet:
Thence South 89 11 ' 30" West, 50. 00 feet to the
True Point of Beginning;
Thence South 89 11' 30" West, 295 . 00 feet;
Thence South 00 03 ' 30" East, 500. 00 feet;
Thence North 89 11 ' 30" East, 295. 00 feet;
Thence North 00 03 ' 30" West, 500. 00 feet to the True
Point of Beginning.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of the
Conditional Use Permit for an expansion to a church and,
WHEREAS, Section 3. 3.D. 4.C. of the Weld County Zoning Res-
olution authorizes such a use in an Agricultural District on the
grant of a Conditional Use Permit by the Board of County Commis-
sions, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully in-
formed and satisfied that the request for a Conditional Use Permit

for an expansion to a church on the hereinabove described real
estate, complies with all of the conditions as set out in Section
3 . 3 .D. 2. of the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of the
Kersey Community Church, Box 158 , Kersey, Colorado 80644 , for a
Conditional Use Permit for an expansion to a church on the here-
inabove described tract of land, be, and hereby is, granted, sub-
ject to the Development Standards contained in the Conditional
Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the reasons for approval contained
in the Planning Commission Recommendations dated September 6, 1977,
be and hereby are, incorporated as the findings of fact of the
Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
September, A.D. , 1977.

for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the
application for Expansion to Church
covering the following described property in Weld County,
Colorado, to-wit:
See attached
be recommended (favorably) (NIEMO ) to the Board of County
Commissioners for the following reasons:
1. The request is in conformance with the Weld County Comprehensive
Plan in that the proposed church expansion development is located
adjacent to an existing municipality (Kersey) and compatible with
the future land use plans of that municipality.
2. It is the opinion of the Planning Commission that this request is
in compliance with the provisions of Section 3.3.D(2) of the Weld
County Zoning Resolution which states :

September 6, 1977
in approving or denying a Conditional Use Permit :
Compatibility with the surrounding area, harmony
with the character of the neighborhood and existing
agricultural uses, need for the proposed use, its
effect upon the immediate area, its effect on future
development of the area and the health, safety, and
welfare of the inhabitants of the area and the County. "
This determination is based upon the following:
A. The Town of Kersey has indicated they have no objection
to the proposed expansion since the request does not
conflict with the future growth plans of the town.
B. The Weld County Health Department has indicated the existing
sewage disposal system is adequate to accommodate the
sanitary facilities in the proposed expansion.
C. There is more than adequate space available for on-site
parking.
D. The applicant has submitted a petition form signed by most
of the surrounding property owners in support of the
proposed expansion. To date, none of the other property
owners in the area have indicated any opposition to the
request .

Kersey Community Church - CUP
DEVELOPMENT STANDARDS
1 . The permitted use on the hereon described parcel shall be the
church facilities as shown on the Conditional Use Permit Plans.
2. The Conditional Use Permit area shall be maintained in such a
manner so as to prevent soil erosion, fugitive dust , and the
growth of noxious weeds.
3. A minimum of 100 / on-site parking spaces shall be provided.
4. The access shall be limited to the one access point shown hereon.
5. The Conditional Use Permit shall be limited to the plans submitte
and governed by the Development Standards stated above and all
applicable Weld County regulations. Any changes to the plans
and/or Development Standards shall require approval of another
Conditional Use Permit before such changes shall be allowed.

DISCUSSION: Mr . Hubbard explained his request for wishing to place
a two-way radio mobile relay station on Wiggins Hill . The station
will be for commercial use only and will be 150 ' high with a 20 '
antenna. Mr . Hiatt asked if there has been a change regarding the
system of lighting the tower and Mr. Hubbard stated that the tower
was being erected according to FAA standards . Red lighting will be
used . Tom Honn then read the staff recommendations and Development
Standards . Mr. Hubbard stated he agreed with the Standards .
MOTIOI. : Be it therefore resolved to recommend approval with the
Development Standards to the Board of County Commissioners . Motion
by Percy Hiatt , seconded by Ben Nix . A vote of "aye" by Percy

DISCUSSION: As there was no representation from the church, Tom
Honn read the letter received from Pastor John Kingrey which
explained the reason for the request for an expansion of the
church. The letter stated that the present church is not large
enough to facilitate Sunday School and fellowship . They also need
a Sunday School office and a larger pastor ' s study . He then read
the staff recommendation and Dovelopment Standards . There was no
further discussion .

THE WELD COUNTY PLANNING COMMISSION STAFF RECOMMENDS THAT THIS REQUEST BE
