We are in receipt of your letter concerning your wish to put an addition onto you
existing building located as shown on the drawing attached to this letter. HRM
Resources, LLC,as Operator of the Prospect Valley 22-9 well and an owner of the oil
and gas leasehold estate in the vicinity of the well has reviewed this information and
believes that there will be no conflict between your wishes as stated above and
HRM's rights under the oil and gas lease. We therefore offer our consent to your
addition as shown. Please feel free to present this letter to Weld County as evidence
of our agreement to your proposal.
Please remember however, that HRM continues to assert its rights to use the surface
of the lands in the vicinity pursuant to the terms of the oil and gas lease(s) covering
the lands in this area.

Anadarko Land Corp. and Anadarko E&P Company LP (the "Anadarko Entities")
received notice of the proposal of Turnpike Limited Liability Company to amend a
special use permit application for property in Weld Count described as a portion of the
S/2NW/4 of Section 9, Township 1 North, Range 63 Wes to include an addition to an
existing building.
The Anadarko entities own the mineral interests that underlie the Property.
Please note that although the Anadarko entities do r at this time intend to object
to the amendment to the special use permit application, the-' continue to assert their rights

On April 1, 2009 the Board of County Commissioners approved your Use by Special Review Application USR-
1686 with specific Conditions of Approval.
One of the required Conditions of Approval grants the applicants sixty (60) days to submit a Mylar Plat. In
addition to the Mylar Plat all conditions outlined in the staff report needs to be completed.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of Approval

On Friday, March 12, 2010 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding a proposed addition to existing office/warehouse. (The
legal description is Lot B RE-1514; Part NW4 of Section 9, T1 N, R63W of the 6th P.M.; Situs
Address is 4626 CR 65)
Background Information:
The applicant is proposing a 40 x 60 foot addition to the existing office/warehouse building to
accommodate more office/storage space. This proposal does not increase the number of
employees.
Building Department
The site plan indicates two handicap parking spaces. These spaces will need to be handicap
accessible with at least 1 space van accessible.
Health Department
The applicants indicated that they believe the septic system should be out of the way of where the
proposed addition is; however if not they propose to move it further away. The applicant should also
check with the health dept. to see if they will need to increase the size of their septic system.
Public Works
The applicants indicated that there would not be any increased traffic. Staff did not have any
concerns with this proposal.
Planning Department
According to Weld County Code, staff determined that an extra five (5) parking spaces would be
required based on the square footage of the addition.
Staff determined that no amendment is required for this addition. However, the applicant must
provide an updated Site Plan identifying the proposed addition as well as the extra five (5) parking
spaces. Because the proposed addition is inside the drilling envelope, the applicant will need to
provide signed letters from the mineral owners/leases granting them permission to build. The
applicant will also need to provide a letter from the SPO who voiced concerns at the hearing
• •
indicating they don't have any concerns with the addition.
Staff urged the applicant to contact staff for any questions:
Planner On Call available Monday through Thursday 7:30 a.m. to 4:30 p.m.
The Planning and Building Department will be moving to 1555 N 17th Ave on March 29, 2010.
The office will be closed on March 29th to allow time for the move and will reopen on March 30,
2010.

EASEMENT AGREEMENT and SHARED WELL AGREEMENT

Please include all line types in the legend on the final plat.
Please show the water quality areas on the final plat as a drainage easement and label as
such. Include the length, width, and depth to match the calculated volume in a note on the
plat.

Hi Michelle,
I met with Corey Huwa this morning on site and all field items for Public Works were
completed. I attached pictures of three different trash dumpsters located on site. The
access work into the site was completed using concrete it is acceptable to Public Works.
No improvements agreement will be required since all items are complete for Pubic Works.
Once the final paper plat is submitted I will need to verify the remaining Resolution
items are shown.

The Weld County Department of Planning Services has granted you an extension of June 1, 2009 to meet all the
requirements in the resolution. At this time there are still several conditions outstanding and I have not review
paper copies of the plat. Please note that the Board of County Commissioners at the hearing indicated they
would like to see this case completed in a timely manner. Give there direction at the hearing if everything is not
submitted by next week I will have to bring this case back before the Board of County Commissioners. Let me

You will need to talk to Lauren Light with the Weld County Health Dept. regarding the
discharge permit.
You will need an improvements agreement if you don't complete all the improvements.
You can elect to show the oil and gas drill envelops on the plat and how your development
is not affect them which would negate the need for an agreement.

I did not think we needed a discharge permit.
Is a improvements agreement applicable?
Do we need an oil and gas agreement since we do not have oil or gas within
the USR boundry?
