ASPHALT HOT-MIX F SSION STUDY
ABSTRACT
The findings of this study may be summarized by the statement that
THERE IS NO SERIOUS AIR POLLUTION OR EMPLOYEE HEALTH PROBLEM RESULTING
FROM THE USE OF PETROLEUM-DERIVED ASPHALT IN HOT-MIXES.
The findings are based on eight complete sets of emission samples
taken at two hot-mix plants involving four asphalts from three refineries.
The emission samples were taken following the discharge of the mix from
the mixing chamber. In most of the samplings the immediate area was
shrouded to concentrate the emissions, to exclude extraneous matter and
to provide more uniform sampling conditions.
Most of the air contaminants found in the emissions were at extremely
low concentrations and all fell well within currently applicable limits
established by the Occupational Safety and Health Administration (OSHA) .
Analysis of gaseous substances included carbon monoxide, nitrogen dioxide,
sulfur dioxide, hydrogen sulfide, carbonyl sulfide, mercaptans, ozone,
aldehydes, phenols and C2 to C14 hydrocarbons. Solid particulates were
also collected and found to contain only trace amounts of polynuclear
aromatic hydrocarbons and metal compounds, much lower than are typically
found in emissions from other industrial and commercial sources. The
Threshold Limit Value (TLV) for asphalt (petroleum) fumes of 5.0 mg/m3,
recommended by the American Conference of Governmental Industrial Hygienists
(ACGIH) was also considered and found to be slightly exceeded in one
sampling. However, each sampling was found to be well within this limit
on a time weighted basis (and sampling was made under exaggerated conditions
not typical of a workman' s exposure) . Furthermore, this TLV limit is
intended primarily to apply to substances high in polynuclear aromatics,
whereas it has been shown that asphalt fumes contain extremely low concen-
trations of these compounds and are largely made up of innocuous saturated
type hydrocarbons.
Under the shrouded, concentrated sampling conditions, the amount
of volatile organic hydrocarbons occasionally exceeded the 0.24 ppm limit
set forth in the Ambient Air Quality Standards promulgated by the Environ-
mental Protection Agency (EPA) . However, it is inconceivable that this
limit would ever be reached at the "fence line" of a hot-mix asphalt plant.
The same applies to other compounds considered to be air contaminants.

At the election, and upon the request of the Purchaser, the
Sellers agree to convey direct to GILXSABIND CONVIiA.R, INC. , a tract
of lend containing six (6) acres , more or less , being the North 390
feet of the Last 450 feet of the above described lands upon payment
of Om Thousand Five hundred DOLLARS ($1 , 500.00) for each acre con-
veyed, which payment shall be a part of the $20,000.00-payment to be
made on January 3, 1972.

It is mutually agreed by the parties hereto that the property •
being soli and purchased shall be used for a residential development
comparable to the present covelopuent to the West and South of the
above described property.
It is further agreed by and between the parties hereto that the
Sellers shall reserve an easement for right-of-way in an existing
cement ditch to carry irrigation water along the South side of said
property to the lands reserved by the Sellers and situated in the
Southeast corner of said Northeast Quarter (NE 1/4) of said Section
Two (2).
In the event Purchaser wishes to obtain releases of additional
lands , it is mutually agreed Purchaser may appoint the Cache National
Lank, Greeley, Colorado, as Trustee for the purpose of depositing
funds with the Cache National Lank, Greeley, Colorado, to be held by •
the Cache i.atiartal bank, as agent for Purchaser, under instructions
to pay out moneys to the Sellers in accordance with the terms of this
agreement and the promissory note to be executed by Purchaser and
co-signers . Upon deposit of funds with the Cache National Lank
under proper instructions, Sellers agree to execute request for
partial release in accordance with the provisions of this agreement.
It_ is further mutually agreed title to the above described proi.-
erty shall be transferred by warranty deed, free and clear of all
liens are encumbrances except utility easements, inclusion within the
Northern Colorado Water Conservancy District, the West Greeley Soil
Conservation District, 1972 taxes payable in 1973, and present gravel
minira3 lease. A title insurance policy or abstract of title shall be

furnished to the Purchaser at the election of the Sellers, showing
merchantable title in Sellers, subject to the above matters , and sub-
ject to the exceptions and reservations contained in the United .Status

In the event there shall Le any defect in the title which renders
same urwerchantable,, sellers , at their expense, after receipt of ,
written rotice of claimed title defect, shall have a reasonable addi -
tional time in which to render same merchantable.
The taxes for the year 1972 and water assessments for the year
1/72 .end thereafter shall be paid by the Purchasers.

Possussiors shall be delivered to Purchaser on December 31,1971.
Ti;. e of pdymunt is an essential part of this agreement, and in
the evtnt of failure to make payment of the $20 ,600.00 payment on
January 3, 1972, it is understood and agreed that the money veld
herewith may be forfeited and retained by the undersigned Sellers ,
as li';aivatcd damages.
It is further agreed that the provisions, agreements and cov-
enants contained herein shall continue in full force and effect
following the delivery of warranty deed and execution of note and
deed of trust at closing . ,
IT IS MUTUALLY AGREED AND UNDERSTOOD that all covenants and
agreements herein contained shall extend to and be obligatory upon
the heirs , administrators , executors and assigns of the respective
p'trties .
