BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
AUGUST 25, 2010
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, August 25, 2010, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of August 23, 2010, as printed. Commissioner Long seconded the motion,
and it carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed.
Commissioner Conway seconded the motion, and it carried unanimously.
PRESENTATIONS:
RECOGNITION OF SERVICES, WELD COUNTY DISPATCHER - MICHELLE HAYNES: Chair
Rademacher read the certificate into the record, recognizing Michelle Haynes for her assistance to
Brian and Tammie Finger through the medical procedure for dealing with a prolapsed umbilical cord
which resulted in saving the life of their daughter Ashley. Dave Bressler, Director of Weld County
Paramedic Service, stated this call was very unique and Ms. Haynes did a remarkable job using the
Emergency Medical Dispatch (EMD) Protocol. He also introduced the arrival of the Finger family and
Ms. Finger held up little Ashley for all to see. Mr. Bressler stated the dispatcher's efforts were joined by
the tiered response of local law enforcement, firefighters, and paramedics. He explained the call was
received from Johnstown, and he acknowledged it takes the Paramedics some time to get there, so the
tiered response starts with a dispatcher who gives care and instruction until emergency responders can
get on the scene. He stated the dispatchers play an important role in keeping a scene calm and
coordinating the team effort of all involved. Michelle Haynes explained the call was actually received as

a 911 hang up call, and the protocol is to call back all hang ups. She stated Mr. Finger explained the
situation and at the time she had no idea how emergent a prolapsed cord is, which was a benefit to her
and allowed her to remain calm on the phone. She stated Brian Finger took every instruction without
hesitation. Mr. Bressler stated the Johnstown Law and Fire were the first to respond and then he
introduced responding paramedics Kimberly Wheelock and David Main. Ms. Wheelock stated
Ms. Haynes did an excellent job of helping the parents remain calm while also coordinating efforts of
the other responders. She stated the EMT's worked to ensure the patients were transported to the
appropriate hospital, since the outcome of a prolapsed cord is typically very grim. She further stated
the call could not have gone any better, which is a credit to everyone involved, including the parents,
and Mr. Main noted the entire event took place on the mother's birthday, which is no shared with her
daughter. Mr. Bressler stated this was definitely a team effort, and it was also the call of a career in
which Ms. Haynes was able to deal with something with high acuity which provided an incredible result.
Commissioner Rademacher stated he has 25 years of experience as a firefighter, with 23 years being
served as a command officer, and he commended all of the highly trained dispatchers. He thanked all
who were involved and he wished a belated happy birthday to Ms. Finger and her daughter Ashley.
Commissioner Kirkmeyer stated approximately 15 years ago the County started discussing the addition
of the EMD to the dispatch system and it is very rewarding, as someone who argued in support of the
idea, to see that it works. She also thanked Ms. Haynes and all of the dispatch staff for all that they do
and thanked the Finger family for attending to recognize this special event. Commissioner Conway
concurred and stated he is glad to see the benefit of all the hard work to bring this EMD system about.
He stated he kept the news article about this story and presented it to Ms. Haynes because he knew
this was something that was special. He stated this story demonstrates the efforts of "Team Weld
County" and how well everything is able to work together and he is proud of all the individuals who were
a part of this. He further stated it is a pleasure to see Ashley doing so well and he is so proud to be a
part of Weld County. Commissioner Garcia agreed and expressed his pride in what this team of
individuals does on any given day. He stated Weld County Government has approximately 1,200
people working hard to put the citizens first, which was very apparent in this very dangerous situation,
and he thanked the family for being in attendance. Commissioner Long stated Ms. Haynes is not a
medical expert; however, she is a dispatcher who had quality procedures which enabled her to
successfully assist the family. He further stated he appreciates knowing there are quality personnel
ready to assist others or his own family should they ever need emergency care.
RECOGNITION OF SERVICES, TREASURER'S OFFICE - SHIRLEY BAUER: Chair Rademacher
read the certificate into the record, recognizing Shirley Bauer for 21 years of service with Weld County.
John Lefebvre, Treasurer, jokingly commented the previous item is hard to follow because the
Treasurer's Office does not save lives; however, they do maintain the money necessary to fund the
emergency response system. He stated Ms. Bauer has worked in three different departments during
her 21 years with the County, which also means she has been required to learn a lot of different
computer systems, as well as meet the expectations of four different bosses and their various
standards. He explained most recently Ms. Bauer has worked in the Treasurer's Office as the
bookkeeper responsible for ensuring that all cash drawers and accounts are balanced, as well as
distributing funds to approximately 300 underlying authorities. He stated she did a good job with
managing her responsibilities and he appreciates all of her hard work. Ms. Bauer thanked Weld County
for all of the invaluable experience and training she received through the years, which she is certain will
support her in the future. She stated she enjoyed her time working in the various departments as part
of a larger team to make the system work for the County as a whole. Chair Rademacher stated
Ms. Bauer is another example of "Team Weld" and Mr. Lefebvre is a great leader with a great staff.
Commissioner Garcia commended Ms. Bauer for meeting the challenge of balancing the Weld County
accounts and wished her the best of luck in her future endeavors. Commissioner Kirkmeyer agreed,
and stated she hopes Ms. Bauer is planning to go and have some fun during her retirement.

Commissioner Conway thanked Ms. Bauer for more than two decades of service as part of the Weld
County team and encouraged her to enjoy her retirement. Commissioner Long stated he is certain
Ms. Bauer's talents will serve her well in her future endeavors and he thanked her for her team efforts
while working for Weld County.
COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated he had the opportunity
to attend a meeting hosted by the Colorado Department of Public Health and Environment concerning
emissions testing requirements. He stated they announced that commencement of the emissions
program will be delayed from November 1, 2010, until December 1, 2010, due to the inability to get it
started without significant inconvenience to the citizens of Weld County. He stated the locators are
indicating between 8,000 and 13,000 citizens will be unable to identify whether they are part of the
program, yet they will still be required to pay the $25.00 fee. In addition, he stated it is apparent the
State does not have enough repair shops signed up to conduct the necessary tests, and construction
for the new locations is not complete. Commissioner Conway stated he intends to discuss this matter
further with the Board, with consultation from the Clerk and Recorder, and he suggested the Board
consider sending a letter to the Colorado Department of Public Health and Environment to postpone
commencing the program until the various issues are resolved, or until after the new Governor and
legislature are in office. He stated the State representatives also discussed lowering the standards in
Larimer and Weld Counties to ensure fewer cars fail the test, because they know they do not have the
infrastructure in place to operate the program. He expressed frustration with moving the program
forward with lowered standards, which defeats the purpose of the program. Chair Rademacher stated
the Weld County Commissioners continue to maintain that the program is not effective, it is expensive,
and it is not warranted. Commissioner Kirkmeyer suggested the Board send a letter directly to the
Governor's Office expressing the Board's issues of concern and requesting an extension of the
commencement date. Commissioner Conway stated it is very clear they are not ready to start the
program, and in these tough budgetary times the State should reconsider hiring a public relations
representative to promote the program in light of the fact that the Governor recently removed $31
million from local government programs in order to balance the State budget. He further stated it is not
wise to implement a program at this time without a great disruption and cost to Weld and Larimer
Counties. Commissioner Long stated it is apparent they just want the money, and Chair Rademacher
agreed.
BIDS:
PRESENT BID #B1000134, COPIER - DEPARTMENT OF PRINTING AND SUPPLY: Monica Mika,
Director of Finance and Administration, stated six vendors submitted bids, which will be presented to
the Board for approval on September 8, 2010. She noted all but one of the vendors are located in
Colorado, and one is a local Weld County business.
APPROVE BID #61000123, AUDIT SERVICES - DEPARTMENTS OF ACCOUNTING AND FINANCE
AND ADMINISTRATION: Ms. Mika stated the bid was originally presented to the Board on August 11,
2010, and Barb Connolly, Controller, has submitted a letter recommending approval of the low bid.
Ms. Mika also referenced Section 5-4-30 of the Weld County Code regarding Bid regulations and the
language which specifies the Board shall give preference to resident County bidders where the bids are
competitive in price and quality. Chair Rademacher stated it appears the local vendor bid is $10,000
higher than the low bid. Ms. Connolly indicated all of the firms met the mandatory elements, and her
recommendation did consider quality of work and quoted price. She stated she did call references for
McGee, Hearne and Paiz and they provided a very high recommendation of the firm. In response to
Commissioner Kirkmeyer, Ms. Connolly stated the auditing firms operate under the same general
principles recognized across the nation, and although the low bidder is located in Cheyenne, Wyoming,
they are licensed to practice in Colorado. In response to Commissioner Conway, Ms. Connolly stated
Bondi has provided auditing services to Weld County for the past four years and the Board is required

to rebid the task. Commissioner Garcia moved to approve said low bid from McGee, Hearne and Paiz,
in the amount of $141,000 for years 2010 and 2011. Seconded by Commissioner Kirkmeyer, the
motion carried unanimously.
NEW BUSINESS:
CONSIDER NONEXCLUSIVE LICENSE AGREEMENT FOR UPGRADE AND MAINTENANCE OF
PORTIONS OF COUNTY ROADS 73 AND 100 AND AUTHORIZE CHAIR TO SIGN - SLAWSON
EXPLORATION (WESTERN DIVISION): Don Carroll, Department of Public Works, stated this request
is for maintenance of County Road 73, running north and south between County Roads 100 and 102,
and for County Road 100, running east and west between County Roads 71 and 73. He stated this
portion of roadway will be used by Slawson Exploration to access the Boomerang well site, and he also
noted staff will likely be presenting several similar requests because Slawson is working on a lot of
state oil and gas leases in the area. He stated the improvements will require the placement of an
18-inch corrugated metal pipe culvert at the access, with adequate gravel surface, as well as the
placement of the standard blue and white access sign at the entrance. He also indicated the
surrounding property owners were contacted and notified of this request. Commissioner Long moved
to approve said agreement and authorize the Chair to sign. Commissioner Conway seconded the
motion. Mr. Carroll stated official Board action is helpful for Public Works staff because it generates
permanent records for future property research purposes, versus a staff approval which does not
require the same standard of record keeping. There being no further discussion, the motion carried
unanimously.
CONSIDER PARTIAL ASSIGNMENT OF LONG-TERM ROAD MAINTENANCE AND
IMPROVEMENTS AGREEMENT (COUNTY ROAD 38) CONCERNING PLATTE SAND AND GRAVEL
MINING AND PLANT OPERATIONS AND AUTHORIZE CHAIR TO SIGN - TOWN OF PLATTEVILLE:
Bruce Barker, County Attorney, stated the Board previously discussed this matter in a work session and
he explained this agreement will assign the enforcement authority for maintenance of certain portions of
roadway from Weld County to the Town of Platteville. He stated Platteville has annexed the portion of
County Road 35, between County Road 5.5 and State Highway 60, and the Town will be responsible
for enforcement against the facility operator. In response to Commissioner Kirkmeyer, Mr. Barker
stated the County has provided notice and a referral request to the Town of Milliken; however, they did
not provide a specific response and are leaving the matter for County determination. He explained the
Use by Special Review Permit was granted by the Town of Milliken, which has the ability to enforce
compliance against the company through the permit, and this agreement deals specifically with the
company and any off-site road issues. Commissioner Conway moved to approve said Partial
Assignment and Agreement and authorize the Chair to sign. Seconded by Commissioner Garcia, the
motion carried unanimously. In response to Commissioner Kirkmeyer, Mr. Barker confirmed a copy of
the finalized documents will be sent to the Town of Milliken.
CONSIDER CONSENT TO ENFORCEMENT BY THE JOHNSTOWN FIRE PROTECTION DISTRICT
OF THE 2006 INTERNATIONAL FIRE CODE, WITH AMENDMENTS, WITHIN THE DISTRICT'S
UNINCORPORATED PORTIONS OF WELD COUNTY: Mr. Barker stated the Johnstown Fire
Protection District has requested authority to enforce the Fire Code within the unincorporated areas of
the District. He stated Ken Swanson, Weld County Building Official, has verified the District's adopted
Code and revisions is consistent with that adopted by the County. Commissioner Kirkmeyer moved to
approve said Resolution. Seconded by Commissioner Conway, the motion carried unanimously.
CONSIDER APPOINTMENT AND REAPPOINTMENTS TO NOXIOUS WEED MANAGEMENT
ADVISORY BOARD: Commissioner Long moved to appoint Shane Hall, and to reappoint David
Droegemueller and Toby Kirsch to the Noxious Weed Management Advisory Board, with terms to
expire August 19, 2013. Seconded by Commissioner Conway, the motion carried unanimously.

RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
