This Technical Revision (TR) is intended to satisfy the concerns expressed in the 20 January 2010 inspection report. Two copies of the TR are included along with the required fee and proof of placement with the Weld County Clerk to the Board, and related attachments (see above). As requested in Part 2 of the OMLR inspection report, included with this submittal is a revised Reclamation Plan Map, since extraction is essentially complete, except where necessary to effect complete reclamation of the northwest basin and area fill activity. 1) The boundary determined under Weld County GIS shape file information defines an area of affected land comprising 102.6± acres, and below the original 120.0± acres permitted. The difference appears to be based upon differences in measurement from the original application to the present submittal. The boundary shown with metes and bounds description comprises the known permit boundary as we understand it today. Existing contour information based upon physical survey is shown in red for the southern reservoir; while projected contours for the balance of the affected lands, including areas of fill and the northwest basin are shown in brown and green based upon modified USGS Gowanda Quadrangle contour information. Once the northwest basin is an established reservoir, and fill, soil and revegetation activities are completed, a revised map will be submitted as part of this submittal showing finished contours based upon physical survey at the time of release request for this permit. 2) Previously approved inert fill activity is proceeding over the northeast third of the permit area (areas A & B). While area A fill is nearly complete, approximately 5.0± acres remain to be filled (area B). All fill activity should be completed within the next five (5) years, or approximately July 2015. Since the combined basin areas comprise 45.0± acres, and approximately 0.6± acres comprise permanent routes along the permit boundary and perimeters of basins, the balance of lands will require resoiling and revegetation over a portion of the remaining 57.0± acres, including the area of fill, stockpiling and recycling activities. While resoiling and revegetation will occur within the next year for the southern reservoir, and within five years of completion of the northwest reservoir, correlated resoiling and revegetation activities over the fill, stockpile, and recycling locations will be deferred until all recycling of construction materials and the removal of construction materials stockpiles is completed, which may continue indefinitely. 3) The southern reservoir is a completed basin of apx. 24.6± acres and has met the liner construction and test requirements of the State of Colorado Division of Water Resources Office of the State Engineer. The approval letter from the Office of the State Engineer dated 28 November 2003 is included with this submittal. 4) The northwest basin is a reservoir presently under construction using the same methods and standards approved for the southern reservoir. The reservoir lining is completed over a majority of the location and the liner test is pending. Essentially, construction of the liner utilized the following methods and standards: a. Cut a 3 foot x 3 foot keyway at the toe of the basin outslope. b. Backfill moist to wet shale to the required slope limits or flatter. c. Compact in approximate 1 foot lifts with a sheepsfoot compactor. 5) Reclamation Status and Clarification of Future Activity: a. 2.7± acres surrounding the northwest basin (area 2) will require six inches of soil and vegetation. b. 5.2± acres surrounding the planned farm storage area will be soiled and vegetated as a filter strip. c. 2.6± acres of the current stockpile area on the northeast corner of the completed southeast reservoir (area 4) will require resoiling and revegetation. The balance of the area surrounding the southeast reservoir has been soil and only revegetation is pending. Soil requirement total = 10.5± acres — total soil volume required = 8470.0± cu.yds. Misc. and insitu soils = 500 - 1,000 yards. Total onsite soil is estimated to be 8,600-9,000± cu.yds. — or sufficient to meet the reclamation requirement. Revegetation requirement total = 14.5± acres utilizing the revised mixture as attached. The reclamation planning and design is further clarified to show permanent roads, agricultural scalehouse area (area 1), and farm equipment and agricultural materials stockpile area (area 2). The roadways, scalehouse operations area and farm storage area will be covered by roadbase to a minimum depth of 4 inches. An existing seep will be maintained as shown as area C. The seep channel forms and will retain a near trapezoidal shape with an approximate three foot bottom at varying depths to the extent necessary to maintain positive flows to the point of exit where waters continue to St. Vrain Creek through established drainage ways. The waters and drainage are pre-existing and the new seep segment will essentially assure continued flows through a channel whose volume exceeds incoming culvert sizes and nominal flows. Finally, for clarification, the St. Vrain Sanitation District has plant operations to the northeast of the permit location. Area E is a 50± wide area set aside for the existing access and maintenance of this system by St. Vrain Sanitation District. The area will not be soiled or vegetated to accommodate this system and District access and related activities. We trust our reply adequately addresses the concerns of the Office. Specifically, you posed two questions in your email that I received the morning of April 9, 2008. These questions were: 1) At what point, and by what evidence, will the Division release a portion, or all, lands from a Division Permit respective of an applicable PUD? 2) For greater clarity, must the PUD occupy all permitted lands or a portion, and should it cover all permitted lands, can the release apply to just a portion of those permitted lands covered under a PUD? Generally, the Division of Reclamation, Mining and Safety (DRMS) will release a site from the reclamation plan once a demonstration has been made by the operator through the city or county that a PUD has been filed, reviewed and accepted and that adequate performance warranty has been filed and accepted. This warranty must be sufficient to complete everything that would be required to be reclaimed under the DRMS Reclamation Plan. A portion of the permitted area may be released in this manner. This Technical Revision (TR) is intended to satisfy the concerns expressed in the 20 January 2010 inspection report. As requested in Part 2 of the OMLR inspection report, included with this submittal is a revised Reclamation Plan Map, since extraction is essentially complete; except where necessary to effect complete reclamation of the banks of the completed reservoir, and correlated finished grading, resoiling and other operations necessary to prepare affected lands for revegetation. 1) The boundary determined by physical survey defines an area of affected land comprising 154.4± acres, and below the original 160.5± acres permitted. The difference appears to be based upon differences in measurement from the original application to the present submittal, which includes measured parcels A (153.5 acres), B (0.4 acres) and C (0.5 acres). The boundary shown with metes and bounds description comprises the known permit boundary as we understand it today. Existing contour information survey is shown, as determined by physical survey. 2) The southeastern reservoir (See area (1) as visible in the NE and SE quadrants of the map) is a completed basin of approximately 48.9± acres (refer to cyan color boundary on map — elevation 4830± static water level measured September 2006), that has met the liner construction and test requirements of the State of Colorado Division of Water Resources Office of the State Engineer. The approval letter from the Office of the State Engineer dated 20 June 2003, is included with this submittal. The Office of Mined Land Reclamation inspection report indicates extraction of the reservoir has been completed and requires the lands above the static water level to the perimeter of the surrounding roadway to be resoiled by 28 January 2011. In order to attend to the erosion attendant to the angle of slope as intersected by wave action relative to prevailing winds, we believe the erosion can be mitigated by lower this angle of slopes by flattening those slopes to 5H:1V or flatter. This would entail moving the perimeter road further back while cutting the existing slopes flatter prior to resoiling. Subsequent to this work soiling could commence within the stated time, however, since revegetation should follow, we respectfully request the balance of winter 2011 to complete this task, or by 20 March 2011, followed no later than 20 May 2011 with reseeding of the resoiled banks. Since revegetation may take up to three years to fully express an adequate cover capable of self regeneration, we respectfully request a three to five year extension for completion of reclamation of the embankments of the reservoir, or no later than 20 September 2016. The area requiring resoiling along the reservoir perimeter was determined by estimating 15 linear feet either side of center line (30 foot width total) from elevation 4840 (refer to dark blue color boundary on map) surrounding the reservoir, or 5,764.0± linear feet, or a total of 3,202* cu.yds. of soil, and 4.0± acres requiring revegetation. 3) The remaining lands outside of the completed reservoir basin comprise the balance of affected lands. For purposes of this phase of operations, the areas outside of the completed reservoir bank area (areas 2, 3, & 4 in the NW and SW quadrants of the included map) should be considered a separate phase whose period of reclamation does not commence until the removal of existing stockpiles, finished grading, and resoiling operations are completed. The point commencing the end of this phase of operations would occur either by a statement in the required Annual Report to the Office, or by inspection by the Office at the location consistent with this understanding. Some lands (area 5) were never disturbed and have an established cover of vegetation, however, due to the presence of simple annuals, would benefit from more aggressive weed management. More specifically, these lands occupy those areas south and east of the green revegetation and resoiling line (D), as visible on the included map. No other grading, resoiling or seeding efforts are needed here as the lands are essentially unaffected by past operations. Varra Companies, Inc. Firestone Pit 112 — M1984-079 2 Technical Revision April 2010 4) The balance of acres will require resoiling or revegetation or both. Specifically, Area 2 (red-brown hatch in the NW quadrant of the site) is an active area of operations comprising approximately 12.5± acres, where construction stockpiles and materials will continue to be used either under agricultural or commercial purposes and will not be resoiled or revegetated, but be maintained with an adequate cover of road base. Area 3 (shown in grey-green hatch also in the NW quadrant) comprises 17.0± acres and will require 13,723± cu.yds. of soil to return a depth of six inches prior to seeding. The remainder of lands will require some limited grading and complete seeding for revegetation, and comprise the balance of lands (area 4) lying north and west of the green resoiling and revegetation line (D), comprising as visible on the included map. 5) Oil and gas operations are designated within cyan colored envelopes (Areas A and B) on the included map. These envelopes indicate where existing or future well, support structures, and related activities may occur. Since the operator remains responsible for the affected lands, these areas were not subtracted by previously referenced totals. It is understood that any disturbance by these operations on the surface are the separate responsibility of the oil and gas operation entities, and any agreements existing or future with Varra Companies, Inc., or under the several state and federal laws attending the same, and including any authority under the Colorado Oil and Gas Conservation Commission (COGCC). An incident involving contamination of underground waters by Kerr-McGee, was reported by Kerr-McGee to COGCC on 31 May 2006. The present state of the plume of contaminated groundwater was determined by CGRS Fort Collins in 2009 and is reflected in the included map (area C). 6) The estimated route of urban transportation and development will occur over the balance of lands. As indicated by (E) on the included map, adjacent Firestone streets (street names may change from how they appear on the existing map) will eventually course through the developed permit area. Future urban development of the property for commercial and industrial use is nearly certain, and the location is presently zoned for commercial and industrial uses by the Town of Firestone. Once the operator files and a PUD is approved by the Town of Firestone, the operator will request transfer of the financial warranty to the Town of Firestone and release of the permit by the OMLR, consistent with Office policy detailed in correspondence from Carl Mount, Senior Specialist (OMLR) dated 11 April 2008. 7) Summary: The Soil Stockpile (Area S — in the SW Quadrant of the map) has apx. 22,747.5 cu.yds. as determined by American West's field survey of February 2008. The soil stockpile has not been utilized since it was measured by American West, and should be Varra Companies, Inc. Firestone Pit 112 — M1984-079 3 Technical Revision April 2010 more than sufficient to resoil Area 3 and the reservoir perimeter whose combined replacement requirement to six inches in depth is 16,925* cu.yds. of soil in total for the areas surrounding the reservoir and for Area 3. The lands requiring revegetation along the reservoir perimeter and above the green resoiling and revegetation line (D) is a combined 31.7+ acres in Area 4, plus 17.0± acres in Area 3, plus 4.0± acres surrounding the reservoir; or a combine area of 52.7* acres total to be seeded and revegetated with the included revised seed mixture. Specifically, you posed two questions in your email that I received the morning of April 9, 2008. These questions were: 1) At what point, and by what evidence, will the Division release a portion, or all, lands from a Division Permit respective of an applicable PUD? 2) For greater clarity,must the PUD occupy all permitted lands or a portion, and should it cover all permitted lands, can the release apply to just a portion of those permitted lands covered under a PUD? Generally, the Division of Reclamation, Mining and Safety (DRMS) will release a site from the reclamation plan once a demonstration has been made by the operator through the city or county that a PUD has been filed, reviewed and accepted and that adequate performance warranty has been filed and accepted. This warranty must be sufficient to complete everything that would be required to be reclaimed under the DRMS Reclamation Plan. A portion of the permitted area may be released in this manner.
