MEMORANDUM TO: Michelle Martin, Planning Services FROM: Lauren Light, Environmental Health COLORADO SUBJECT: USR-1725 Brian and Susan Williams DATE: 2/5/2010 Environmental Health Services has reviewed this proposal for a landscaping business. There is an existing house and several outbuildings located on the property. An office is proposed, which will be constructed inside the existing metal pole barn. There will be 4 to 5 employees who would utilize the office for sanitary facilities. An individual sewage disposal system (permit SP-0900018) provides sewer for the site and was evaluated by an engineer in February, 2009. The engineer's evaluation was incomplete and requires additional information to ensure the existing septic system is adequate for the business usage. Potable water is provided by Little Thompson Water District. • A waste handling plan is required and should include the name, address and phone number of the waste removal and disposal companies. The plan should indicate how any waste associated with the business, such as vehicle or equipment parts, garbage ect. are disposed of. As there are also three fuel tanks, the waste plan should include how a spill will be contained and disposed of. A dust abatement plan, for on-site dust, is required. Noise will be restricted to the level allowed in the commercial zone district. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. EXHIBIT • 2010-1310 • • 2. The applicant shall submit a waste handling plan, for approval, to the . Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 3. As the applicant intends to utilize the existing septic system, for employee use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 4. In the event washing of vehicles or equipment will occur on site the applicant shall ensure that any vehicle or equipment washing areas shall capture all • effluent and prevent discharges from washing in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Washing areas should be designated on the plat. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. • 2 • • 4. The applicant shall operate in accordance with the approved "waste handling . plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan" at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 8. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. The facility shall utilize the existing public water supply. (Little Thompson Water District) 10.All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and • volatile organic compounds (VOC's). 11.Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 12.The applicant shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 13.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. • 3 Weld County Referral viipe. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: Weld County Road Classification Plan (FHU): WCR 17 is a major arterial road, which requires a 140- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. A detailed review of these items was not complete at this step in process. Site Plan Review: The applicant needs to place on the plat drawing existing and future right-of-way. Currently, there is 60 feet of right-of-way; however, this portion of WCR 17 is classified as an arterial road with 140 feet of right-of-way at full build out. The future right-of-way consists of 30 feet of existing from the center line plus an additional 40 feet to be reserved for a total 70 feet from center line. This needs to be indicated on the plat drawing and identified. On the plat, it is labeled as "future 70-foot right-of-way easement line". The 70 feet of right-of-way is being identified as an easement line. This is not an easement. It should read "future 70' right-of-way line". Traffic Study: No traffic study will be required. Preliminary Drainage Report: The applicant has provided a water quality feature worksheet. The calculations appear to be adequate for the facility. After discussing the application with the Mr. Williams and the Planning and Zoning Commission I offer the following comments. The landscaping business has been in place for some time (presumably with County approval) and we have not heard of complaints or conflicts. However, the use adjoins undeveloped property that is designated in our Comprehensive Plan as Residential, and is zoned PUD-R and platted (Willow Creek preliminary) for single family detached residential. • This type of use is considered commercial/light industrial and is not compatible with residential. We strongly suggest that the Special Review Use be subject to periodic review and that the USR expire within one year of approval by Johnstown of a residential subdivision final plat on the adjoining property. This violation was initiated due to the operation of a landscaping business without first submitting and completing the necessary Weld County Zoning Permits. This case was presented to the Board of County Commissioners through the Violation Hearing process on June 16, 2009. At that Violation Hearing, the Board of County Commissioners referred this case to the County Attorney's Office, but delayed legal action for 90 days (09/16/09). Since this Use by Special Review(USR)application was submitted after September 16, 2009, staff required the investigation fee in addition to the application fee; however, the Board of County Commissioners later waived the requirement of the investigation fee. This application if approved by the Board of County Commissioners will correct the violation. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit.
