forever, all the real property, together with improvements, if any, situate,

Grantor, either in law or equity, of, in and to the above bargained premises,

with the appurtenances, unto Grantee, his heirs, personal representatives, and
assigns, forever. And Grantor, for herself and her heirs, personal
representatives, and assigns, does covenant, grant, bargain, and agree to and
with Grantee, his heirs, personal representatives, and assigns, that at the
time of the enseeling and delivery of these presents, she is well seized of
the premises above conveyed; has good, sure, perfect, absolute and
indefeasible estate of inheritance, in law, in fee simple; and has good right,

Grantor shall and will WAPeaNT AND FOREVER DEFEND the above-bargained
premises in the quiet and peaceable p ion of Grantee, his heirs, personal
representatives, and assigns, against all and every person or persons lawfully
claiming the whole or any part thereof.
Reserved Interest. As aforesaid, the real property being conveyed
hereby is legally described on Exhibit "A" attached hereto end incorporated
herein by reference (the "Property") . The Property includes a parcel of land
(separately the "Land") and an existing double-wide mobile home which is
located on the Land (separately the "mobile Home"). subject to the terms and
condition, hereinafter set forth. Grantor hereby excepts and reserves unto
herself the exclusive right to use and occupy the Property, in its entirety,
as Grantor's personal residence (the 'Reserved Interest"). The terms and
conditions of the Reserved Interest shall be as follows:
1. The Reserved Interest shall terminate on the earlier of
(i) the date of Grantor's death, or (ii) the date when Grantor "abandons" or
is deemed to have "abandoned" the Property, as hereinafter defined. Grantor
shall be deemed to have abandoned the Property, and the Reserved Interest
shall terminate, if Grantor ceases to occupy the Property as Grantor's
personal residence with no good faith intent to re-occupy the Property in the
future as Grantor's personal residence. In further clarification, it is the
intent of the parties hereto that the Reserved Interest shall not terminate,
and Grantor shall not be deemed to have abandoned the Property as Grantor's
personal residence during temporary absences from the Property, including
temporary stays in hospitals or nursing homes, when there is any reasonable
noaaih"llry that. Grantor will be able to re-occupy the Property as Grantor's
personal residence. Grantor shall be conclusively deemed to have abandoned
the Property as Grantor's personal residence if Grantor ceases to occupy the
Property as-Grantor's personal residence for a period in excess.of one hundred_
eighty (180) consecutive days. The recording of an affidavit either (a) from
Grantor's attending physician, who must be duly licensed, certifying that

• hundred eighty (180) consecutive days, shall be sufficient to terminate the
Reserved Interest. Upon termination of the Reserved Interest, Grantor shall
have no further interest in the Property, of any kind or nature, legal or
equitable.
2. The Reserved Interest shall include the Property in its
entirety, including the Mobile Home and all fixtures pertaining to the Mobile
Home and all appliances located within the Mobile Home.
3. During the tern of the Reserved Interest, Grantor shall be
responsible, at Grantor's sole coat mid expense, to maintain the interior of
the Mobile Home, including all mechanical systems and appliances. Grantor during the Ishall nterest not commit

4. During the term of the Reserved Interest, Grantee shall be
responsible, at Grantee's sole cost and expense. (i) to pay one hundred

which Grantor has previously carried, (iii) to maintain the boundary fences
in a good state of repair, (iv) to maintain the structure and exterior of the

owned by Grantor. Grantor shall be responsible, at Grantor's sole cost and
expense, to maintain the dog pens and runs in a sanitary condition and in
compliance with all applicable laws and ordinances. Provided Colorado State

accept the dogs for disposal in a humane manner without expense to Grantor

diligence and act in good faith to reduce the dogs to the Agreed Maximum as
soon as reasonably possible but without any obligation on Grantor to incur

6. The Reserved Interest is personal to Grantor and may not be
transferred, assigned, or conveyed by Grantor.

THAT David Throwner, attorney at law, has been appointed, appeared for
any and all defendants who are in or who may have been ordered to report for
military service as defined in the Solders and Sailors Civil Relief Act, as amended;
THAT this is an action in rem affecting specific real property;
THAT the Court has jurisdiction of all parties to this action and of the
subject matter thereof;
THEREFORE:
IT IS ADJUDGED AND DECREED that Owen Farms, LLP,was and is now the

title or interest in or to those tracts of land or any part thereof and defendants
are forever enjoined from asserting any claim,right, title or interest in or to Tracts

Defendant, Daniel L. Ochsner, and that the Plaintiff and all other defendants
