Verity made comment to on OK for new well; • Although there is a PUD (PZ-1126) covering the drillsite, it was recorded (at Rec. No. 563575) subsequent to drilling operations and does not require a Use by Special Review (USR). They were located in a Weld County PUD when we initially drilled them but we did not get a USR. Do you have any information on this as to why we didn't need one when we first did the operation in 2007. Cole Busha The Weld County Public Works Department has reviewed this proposal. Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: Cherry Avenue (WCR 43) is a paved collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: The existing access drive is surfaced with gravel; therefore, an additional tracking pad is not required. 1. The applicant shall utilize the existing access to the site. 2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. DRAINAGE: A drainage report is not required for this site as it is located within the 100-year and 500-year floodplains of the Cache La Poudre River. The application indicates that there is a grassy area to the south of the building which captures sediment. 3. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. FLOOD HAZARD DEVELOPMENT STANDARDS: Flood Hazard Development Permits were issued for this property (FHDP-227 & FHDP-427).
