RE: Request for Partial Release of Performance and Financial Warranties,
Lohmann Sand &Gravel, M-2001-017—French Pit
Dear Eric,
L.G. Everist, Inc. requests a partial release of the financial and performance warranties of the Lohmann
Sand and Gravel mine, DRMS Permit M-2001-017. We are requesting partial release of the area known
as the French Pit. The French Pit is the east section of the Lohmann Sand and Gravel Mine and is
located in Section 6,Township 2 North, Range 67 West, in the 6th P.M., Weld County, Colorado. L.G.
Everist, Inc. is leasing this property from the landowners, James and Dolores French.
The French Pit has been fully mined and reclaimed as per the approved reclamation plan for the mine
site. The reclamation completed at the French Pit includes the construction and certification of the slurry
wall, the backfilling, sloping, grading, and the initial seeding. We request a partial release from all the
performance and financial warranties associated with the reclamation items listed above as being
completed. We realize that we cannot request a full release of this area yet, because we must wait for
the newly seeded areas to reach a fully revegetated and sustainable state_
TheFrench Pit slurry wall was approved and certified by the Colorado Division of Water Resources,
Office of the State Engineer, in a letter dated January 5, 2009. A copy of the certification letter is
attached for your Division files.

The purpose of this letter Is to approve the lining of the above referenced gravel pit. This approval
is based on the information you provided under cover letters dated October 31, 2008, and January
29, 2009 as well as the site inspection conducted on January 14,2009. The estimated pit inflows
from precipitation and groundwater and outflows due to pumping and evaporation indicate that Its
pit has been Ilned to the deslon standard referenced in the August 1999 State Engineer
Guidelines for lining Criteria for Gravel Pits. Meeting the dedign standard requires that all
water inflows and outflows for this pond must be accounted for on a monthly basis.
