RE: APPROVAL OF SERVICE PLAN FOR THE PROPOSED NORTHMOOR ACRES
METROPOLITAN DISTRICT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Northmoor Acres Homeowners Association is
seeking to form the Northmoor Acres Metropolitan District
pursuant to Section 32-3-101, et seq. , CRS 1973 , in order to
provide the financing necessary and construct a system whereby
116 lots , of approximately one acre in size, may be provided
irrigation water and possible fire protection, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 30th day of May, 1979 at
the hour of 2 :00 o 'clock p.m. in the Chambers of the Board of
County Commissioners for the purpose of hearing the service
plan of the proposed Northmoor Acres Metropolitan District.

WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those
present, has studied the request of the petitioner and the
recommendations of the Weld County Planning Commission and all
of the exhibits and evidence presented in this matter, and having
been fully informed, is satisfied that the service plan of the
proposed Northmoor Acres Metropolitan District should be
approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the service plan for
the proposed Northmoor Acres Metropolitan District be, and
hereby is, approved conditional upon the utilization of Plan
No. 4 of the Irrigation Study for the Northmoor Acres Home-
owners Association (Engineer' s Report) which involves the
gradual purchase of water rights over a period of years ,
thereby decreasing the amount of water that would have to be
rented.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
May, A.D. , 1979 .

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS
REQUEST BE Approved FOR THE FOLLOWING REASONS :
Colorado Revised Statute sets forth provisions for review of the
service plans . Based upon the information submitted and a review
of the criteria set forth in the statutes, the Department of
Planning Services Staff feels the following criteria have been
satisfied :
1 . There is sufficient existing and projected need for organized
service in the area to be serviced by the proposed district ; and
2 . The existing service in the area to be served by the proposed
district is not adequate for present and projected needs ; and
3. Adequate service is not , nor is not anticipated to be , available
to the area through municipal annexation by other existing muni-
cipal or quasi-municipal corporations within a reasonable time
and on a comparable basis ; and
4 . The proposed special district is capable of providing economical
and sufficient service to the area within its proposed boundaries ;
and
5 . The facility and service standards of the proposed district
appear compatible with facility and service standards of adjacent
municipalities and special districts.
The Department of Planning Services Staff is not equipped with the
expertise to review one additional criteria . The criteria requires
satisfactory evidence that the area to be included in the proposed
district does have , or will have, the financial ability to discharge
the proposed indebtedness on a reasonable basis .
The Financial Feasibility Report submitted by Bosworth-Sullivan
indicates the proposed district can financially meet its obligations .
The report appears to rely on future population and membership to the
district , however,

NOTICE is hereby given of a hearing before the Board of
County Commissioners of Weld County, Colorado, on the
14th day of March , 1979 at the hour of 2 : 00 P.M.
in he Weld County Commissioners hearing room, first
floor, Weld County Centennial Center, 915 10th Street,
Greeley, Colorado, for the purpose of considering the
service plan of the proposed Northmoor Acres Metropolitan
District. This notice is given pursuant to the Special
District Control Act, Section 32-1-201 , et seq. , CRS
1973.
Copies of the Service Plan are on file at the Office of
the Clerk to the Board of County Commissioners located
on the 3rd floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado and may be inspected during
regular business hours .
Within 20 days after the completion of the hearing, the
Board of County Commissioners will consider the approval

SERVICE PLAN FOR PROPOSED
NORTHMOOR ACRES METROPOLITAN DISTRICT
PURPOSE
This service plan has been prepared by the Northmoor
Homeowners Association to comply with the Special District
Control Act, C.R.S . 1973 , 32-1-201 et. seq. , and to provide
the Weld County Commissioners, property owners within the
proposed district, and other interested parties with infor-
mation pertinent to the establishment of the proposed Northmoor
Acres Metropolitan District. The purpose of the District is to
supply water by any available means for said District and
the inhabitants thereof by providing a complete water supply,
storage, transmission and distribution system, together
with all necessary incidental and appurtenant facilities
for the uses of irrigating lawns , gardens, and greenbelt
as well as other outdoor uses, by the use of, but not limited
to, the following water rights owned by Northmoor Acres
Homeowners Association, a non-profit corporation organized
pursuant to Section 7-20-101, C.R.S. 1973 , et. 5e3. : Five (5)
shares of the capital stock of the Supply Irrigation Ditch
Company, Twelve (12) shares of the capital stock of the Bunyan
Lateral Ditch Company, Eleven (11) shares of the Farmers Ex-
tension Ditch Company, and Eleven (11) shares of the capital
stock of the Ish Reservoir Company. A further purpose of the
District is to provide fire protection by means of development
of the water supply for that purpose. Therefore, pursuant to
the provisions of the Metropolitan District Act, Section 32-3-101
et. seq. , C.R.S. 1973 , the two purposes of the District will
be to act as a water district and fire protection district.
DESCRIPTION OF PROPOSED DISTRICT
The proposed District encompasses the lots and common
area within the Northmoor Acres Subidivison first and second
filings which are described as follows:

POPULATION AND ASSESSED VALUATION
The current estimated population of the proposed
District is 140 and it is projected that the population
will increase to approximately 480 . Based on the current
records of the Weld County Assessor' s Office, the assessed
valuation of real property and improvements in the Proposed
District is $455, 610. 00 .
FACILITIES
The proposed irrigation system was designed by H. & S .
Irrigation of La Salle, Colorado, pursuant to government
regulations. The system provides a two inch outlet to each
lot with each outlet designed to deliver 50 g.p.m. at a
minimum pressure of 60 p. s. i. and a maximum pressure of 80
p. s. i. The pumping stations for the irrigation system con-
sist of two twenty-five (25) horsepower and one Thirty (30)
horsepower pumps. The pumps will be set in dry wells with
perforated inlet pipe and rock filter beds. The system is
supplied with the ditch water described above, and the
filtered inlets will protect the pumps and the sprinkler
heads from abrasive wear from silt and sand.

FINANCIAL FEASIBILITY
Operation of the District is feasible as shown in
Exhibit "B" , a financial feasibility report prepared by
Bosworth-Sullivan.
CONCLUSION
The formation of the Northmoor Acres Metropolitan District
will allow members of the District to irrigate the lawns,
gardens and greenbelt, within the District and make other
outdoor uses including future fire protection, and will en-
able each member to make full and maximum use of the
water owned by the Northmoor Acres Homeowners Association.
The proposed irrigation system will preserve and enhance
property values throughout the entire District.

NOTE 1 - The electrical expenses of the system are based on estimates by Public
Service Co. of Colorado of the costs to operate one 30 horse power and
two 25 horse power pumps. PSC estimates the electrical expense to
operate these pumps for 1978 to be $3,695.67. The Company also suggests
allowing for increases in these expenses at the rate of 62% annually
for the first 5 years. It should be noted that while PSC anticipates
increases after 5 years, it is impossible to estimate the rate of the
increase. For purpose of this analysis, the electrical expense remains
constant from 1984 through 1999. Any increase or decrease in this
expense could be reflected in the charges or mill levy.
NOTE 2 - While this type of system is somehwat unique, H & S Irrigation Co.
estimates that the maintenance cost should not exceed $1,000 annually.
As with the electrical cost, an inflation factor of 61/2% was used for
year 1980 through 1984 with no provision for increase after 1984.
NOTE 3 - The estimated annual paying agent fee is based on current fees for
bond issues of this type being charged by paying agents in the area.
NOTE 4 - The District will incur various miscellaneous expenses associated with
the operation of the systems i .e. billing, postage, legal , etc.
NOTE 5 - See Table No. 5
Any increase or decrease in the estimated expenses to be incurred by
the District in the operation of the system will be passed on to the
residents of the District in the form of fees as shown on Table No. 4.

feasibility of the proposed $180,000 water system:

The financial tables attached hereto set forth the various expectations
and assumptions for payment of the District' s estimated financial obligations.
Based upon information currently available, they demonstrate the general
financial feasibility of the proposed District operations.
This study contemplates the issuance of general obligation bonds and the
utilization of a tap fee, service charge, and standby charge for the repayment
of bonds and operating/maintenance of the system. Although a mill levy was not
utilized in the projections we would suggest that the District impose a token
levy (under one mill ) on the land owners .
The maximum net effective interest rate on the bonds issued will be ten (1C%)
percent and the maximum discount from par will be five (5%) percent. Municipal
bond financing is feasible for the program set forth in this service plan pro-
viding a favorable response is received from the' questionnaire as discussed abotie.

*It is anticipated that the District issue general obligation bonds. The
intention is that the majority of operation, maintenance and debt service
costs would be funded from rates and charges of the system. If, however,
the rates and charges were insufficient to meet costs, the District would
have the ability to levy a general ad valorem tax to provide for these
payments.
Because the intention is to pay the expenses of the system with revenues
of the system it is recommended that the District establish a reserve fund
from bond proceeds in an amount equal to one year' s principal and interest
($25,000) . The reserve fund can be invested at a rate at least equal to
the rate of the bonds thereby not increasing the estimated charges to the
users. Because the interest earnings of the reserve fund should at least
equal the interest cost, the projected debt service requirements are based
on a par amount of $215,000 not $240,000.

NOTE 1 - The electrical expenses of the system are based on estimates by Public Service Co. of
Colorado of the costs to operate one 30 horse power and two 25 horse power pumps. PSC estimates
the electrical expense to operate these pumps for 1978 to be $3,695.67. The Company also sug-
gests allowing for increases in these expenses at the rate of 6≥% annually for the first 5
years. It should be noted that while PSC anticipates increases after 5 years, it is impossible
to estimate the rate of the increase. For the purpose of this analysis, the electrical expense
remains constant from 1984 through 1999. Any increase or decrease in this expense could be
reflected in the charges or mill levy.
NOTE 2 - While this type of system is somewhat unique, H & S Irrigation Co. estimates that the
maintenance cost should not exceed $1 ,000 annually. As with the electrical cost, an inflation
factor of 6=% was used for the years 1980 through 1984 with no provision for increase after 1984.
NOTE 3 - The estimated annual paying agent fee is based on current fees for bond issues of this
type being charged by paying agents in the area.
NOTE 4 - The District will incur various miscellaneous expenses associated with the operation
of the systems, i .e. , billing, postage, legal , etc.
NOTE 5 - Water rental amounts are based on estimates of the consulting engineer. A 10% infla-
tion factor was used for years 1981 through 1985.

Job Description
On March 20, 1979, this company, Resource Consultants, Inc. , was
employed to investigate the feasibility of incorporating an irrigation
system into the Northmoor Acres Subdivision. At a meeting among two members
of the Homeowners Association, Suzie Ruof and Jeannie Glanz; the legal
adviser, Kim R. Lawrence; and the Engineer, the project was outlined. The
following requirements were established:
I. Existing water rights should be analyzed.
A. As to maximum yield
B. As to minimum yield
C. As to average yield
II. Irrigation requirement should be established.
A. The size lots should be determined.
B. The area each lot would irrigate should be established.
C. The average size home, drive, and garage should be established.
D. Type and area of typical crops should be determined.
III. A quantified water analysis should be made. It should be determined
if enough water is available, and, if not, how much additional water
is needed.
IV. Cost figures for the system should be supplied. The value of
water owned by Northmoor Acres and costs of additional water should
be estimated.
A plat of Northmoor Acres is shown in Fig. 1.

I. Existing Water Rights
Northmoor Acres owns the following water rights :
A. Ish Reservoir (Certificate 616) - 11 shares of capital stock.
B. Supply Irrigating Ditch Company (Certificate 1880) - 5 shares
of capital stock.
Below is the analysis of these rights:
A. Ish Reservoir (see Fig. 2)
This reservoir has a capacity of 7,061 acre-feet when full at gage
height of 36 feet. Two companies own water in this reservoir. The Old Ish
Reservoir Company owns the first right up to gage height of 21 feet which
represents 2470 acre-feet. The New Ish Reservoir Company owns all water
between gage heights 21 to 36 which represents 4591 acre-feet. If the
reservoir does not fill up during the non-irrigating months to a gage height
of 21 feet, the New Ish Reservoir Company has stored no water at all; thus
the plan is never activated for that year.
On Fig. 2, note the Ish Reservoir,which is stippled. Water is released
from this reservoir about July or August when Ish surface water is no longer
available. The water proceeds to the Mead Lateral (Highland Ditch) , then
into Farmers Extension to Bunyon Lateral, and thus to Northmoor Acres.

The amounts shown in the last column are theoretical amounts. An ele-
ment that is neglected is the workability of the system. Consider these
facts:
1. During the average year at Ish Reservoir 41" of water evaporates.
This figure multiplied by the average surface area gives a significant loss.
2. Whereas the figures in the last column are 100% effective, a more
realistic effectiveness is 80% to 85%. Problems concerned in this area
are: (a) the inability to transport small quantities of water as effec-
tively as large quantities, and (b) having more water than is needed at
some times and less than is needed at other times.
B. Supply Irrigating Ditch Company
Northmoor Acres does own water rights in the Supply Irrigating Ditch
Company. This ditch picks up water from the St. Vrain River and delivers
it into the Little Thompson drainage area. Out of a total of 400 rights,
Northmoor Acres owns 5, or 1.25% of the water. In addition to the surface
right depicted in the diversion records below, Northmoor Acres, by virtue
of owning shares in the Supply Ditch, does also have storage in Beaver Park
Reservoir.
In the very early years, the Supply Irrigating Company owned the entire
reservoir. In the flood of 1893, the reservoir was washed out and this
virtually bankrupted the company. The Highland Irrigation Company rebuilt
the reservoir for one-half interest. The total storage is 2,161 acre-feet.
There is dead storage in the reservoir of 685 acre-feet giving a usable
storage of 2161 - 685 = 1486 acre-feet. Thus, the Supply Irrigating Company
owns 743 acre-feet of storage water when the reservoir is full. This is
1.86 acre-feet per share.
Note on Fig. 2, a label "Private Transfer Ditch." This ditch is 1700
feet long and is well plugged with grass, debris, and is bordered for a
short way with trees. There is a huge ditch loss of water in this section.
All quantitative amounts are based on an unconfirmed ditch loss of 60%.

l/The 40% figure at the head of this column is a judgment call by a ditch
rider. Whereas this may be off by a large amount, there is certainly
no better data. This could be measured at a later date; however, this
Engineer has looked at the portion of the ditch that claims this huge
loss and he concurs that regardless, this section should be cleared.

water per year is 47 acre-feet, with a maximum of 97 acre-feet. The
Supply Irrigating Ditch Company claims 65.5 acre-feet is available at the
river. The ditch loss used above (81%) would give 54 acre-feet compared
to the calculated 47 acre-feet. This discrepancy is unexplainable. The
calculated Beaver Park Reservoir quantities come out to be the same as the
company declares.

II. Irrigation Requirement
Several assumptions were made in establishing the irrigation require-
ment.
1. The actual acreage owned by the individual was used, less the
3700 square feet, which was termed adequate for the house, drive, barn, and
garage areas. The square-foot areas are shown on Fig. 1.
2. Five of the 120 lots were omitted, since there are oil and gas
leases which prevent building at these five locations.
3. All area in the roadway easement was omitted.

4. The greenbelt area is treated separately so the client can omit
or add this item as he wishes.
5. Of the remaining area, 1/2 was judged to be pasture, 1/4 lawn,
and 1/4 garden. Very little variation occurs if the percentages are
changed.
6. The amount of water a plant uses is called the "consumptive use."
The amount of rainfall a plant uses is called "effective precipitation."
The "irrigation requirement" is the amount of water the plant needs over
and above the effective precipitation. The amounts of both rainfall and
effective precipitation are shown below.

Comments
1. The rights owned by Northmoor Acres are not dependable rights.
The Old Ish Reservoir Company must satisfy 100% of their right in Ish
Reservoir prior to your right starting to fill. The year 1954 was dry for
surface supply. Four years out of 27 yielded almost no water. Your rights
in Beaver Park Reservoir are very dependable, but unfortunately they
account for only 7.5 acre-feet per year. These dependabilities should be
accepted by each user.

2. These demand figures given above are a result of a reliable com-
putation method called the Blaney-Criddle Method. This Engineer believes
there will be very little loss of income if only 80% of the water (arrived
at by the computation) is received. An irregular supply can leave the
owners with a 100% loss on their garden, but the lawn and pasture become
dormant and probably would not die. Thus a 50% shortage of water may not
drastically affect the user.
3. According to one homeowner in Northmoor Acres, about 40 acre-feet
of water is available (on the average) from runoff. If this water is
stored, it can be used when no call is on the river. If there is a call
on the river, this water may have to be released.
IV. Costs
Following are preliminary cost figures for the above project:
1. Improvement of transfer ditch = $ 12,5001/
2. Two ponds @ $12,000 = 24,000
3. Irrigation system = 125,000
4, Electrical facilities (2400 ft. of 3 ph line) = 18,500

$500 for cutting small trees yourself.

Use:
$8,500 if new location is used.
This plan is 120 acre-feet short of a reliable amount of water. This
amount of water can be rented today for $5 to $12/acre-foot, or $600 to
$1,440 a season. This same water, if available to buy, would cost $1,000
to $2,000/acre-foot, for a total of $120,000 to $240,000. It seems reason-
able to rent water for the near future; but in about 20 years, it is very
doubtful that water will be available to rent.

Plan No. 4
This plan sets a monthly charge at, say, $35/month. Referring to
Plan No. 3, this will give you an excess of $18,263. This should buy 9 to
10 acre-feet of additional water rights, thus lowering the rental require-
ment to 180 acre-feet. The next year you should be able to buy 10 to 11
acre-feet, again lowering the rental requirement by about 20 acre-feet, etc.
Comments
Plan No. 1 requires more investment than does using the present system.
Plan No. 2 is a break-even plan. It has a very good option, which is
that it would require only 47 users to augment the plan. This would give
the dissenters the privilege of being omitted. (If you had a choice between
a $75,000 home with no water or a $78,500 home with water, what would it be?)

Plan No. 3 has certainly tripped the financial balance toward instal-
ling the system and renting water. Renting water at $12/acre-foot and
buying water at $2,000/acre-foot seems incongruous. A normal payback
period is 7 to 10 years. Keep in mind you are helping a water owner keep
his water usage active.
It is doubtful there will be any water to rent in about 20 years.
The last plan addresses this problem. You could save money over irrigating
through the water system. You could have your own water when rental water
is gone. Costs would progressively decrease from $30 per month to $21.82
per month at the end of 16 to 20 years. At the end of 20 years, the cost
would drop to $4.74/month. All the above is based on today's prices.
Other considerations
Be aware that the year after the system is complete, there may be 1 or
2 dry years. Opponents will be aware of their payments to pay for a dry
system.
Be aware that if Supply Ditch is running water and Mead Lateral is
dry, the water cannot physically be transferred. The plan described herein
does not reflect this.

Recommendations
1. It is recommended that you do not install the irrigation system
if you run only the water you now own through it.
2. Running rental water through the irrigation system is very
attractive; the only problem being that at times rental water will not
be available. If you select this method, be sure you also accept the
idea that in extremely dry years, there is a strong likelihood you will
have no water at all.
3. This Engineer especially likes Plan No. 4 which increases your
water holdings as the rental water decreases. At the end of 20 years
the water will be economical, and the property will have increased in
value more than its cost.
4. Plan No. 2 is especially attractive if there is a lot of opposi-
tion to the system. It is highly probable that 47 landowners would want
to invest in the total layout and own 100 percent of the water, and the
others could remain under the present water system.

The Petitioners and Proponents of the proposed NORTHMOOR
ACRES WATER DISTRICT, Weld County, Colorado, by their attorney,
Kim R. Lawrence, pursuant to the provisions of the "Special
District Control Act" , Colorado Revised Statutes 1973,
32-1-201, et seq. , respectfully petition the Board of Commis-
sioners of the County of Weld, State of Colorado, for a Resolution
of Approval and certain other preliminary actions relating thereto,
for said proposed District.
In support of said Petition your petitioners state:
1. That on the ism day of , 1978 , there was
filed with the Board of Commissioners of Wel County, a Service
Plan for said proposed District, with additional copies for con-
sideration by the County Planning Commission.
2 . That such Service Plan fully complies with the
provisions of the "Special District Control Act" , as to all of
the information required to be therein contained.
3. That petitioners have also accompanied said Service
Plan with a processing fee as provided by law in the amount of
$200. 00.
4. That petitioners have also submitted to the Board
of Commissioners, a copy of the proposed form of Petition to
the District Court for the organization of said proposed District.
WHEREFORE, Petitioners pray that this Honorable Board will
enter such orders as may be necessary or proper preliminary
to and in connection with a Resolution of Approval of the
Service Plan of said proposed District.

NORTHMOOR ACRES HOMEOWNERS ASSOCIATION
ATTORNEY'S PRESENTATION TO WELD COUNTY COMMISSIONERS
May 30 , 1979
The purpose of this written presentation is to briefly summarize
the points that will be made at the May 30 , 1979 , hearing before the
Weld County Commissioners in the attorney' s presentation for the
Northmoor Acres Homeowners Association.
1. The Northmoor Acres Homeowners Association is seeking to
form the Northmoor Acres Metropolitan District pursuant to Section
32-3-101, et seq. , C.R.S. 1973 , in order to provide the financing
necessary and construct a system whereby 116 lots , of approximately
one acre in size, may be provided irrigation water and possible fire
protection.
2 . The Association presently owns certain water rights as set
forth in the Service Plan which deliver on the average 93 . 5 acre
feet. At present, only a few members are able to utilize the water
rights owned by the Association as these members have direct access
to the storage ponds . There is no means of delivering other lot
owners their proportionate share and therefore they derive no benefit
whatsoever from the Association' s water rights.
3. In order to form a metropolitan district, Section 32-3-105,
C.R.S . 1973 requires that ten percent (10%) of the taxpaying electors
of the proposed district file Petitions with the District Court
requesting the Court order an election concerning the formation of
the district. It is important to note that a mere ten percent of the
taxpaying electors may request an election and that it is implicit
that the right to an election is not one that should be summarily
denied or one that should be pre-judged based on the number of persons
in opposition or in support of the ultimate formation of the district.
4 . Immediately after any election in which the formation of
the district is approved by a majority of taxpaying electors , the
precise details of construction will be determined and bids will be
taken to determine the exact cost of construction and financing of
the project. The question of the bond, will be submitted to the
electors of the electors of the water district for their approval.
5. Section 32-1-201, C.R.S . 1973 , the "Special District Control
Act, " requires that any proposed special district file a Service Plan
with the Board of County Commissioners in which the district is
located.
"32-1-204 . Filing of service plan. . .
The service plan shall consist of a
financial survey and a preliminary
engineering or architectural survey
showing how the proposed services are
to be provided and financed. The
service plan shall include a map of
the proposed district boundaries and
an estimate of the population and the
valuation for assessment of the pro-
posed district, and it shall describe
the facilities to be constructed, the
the standards of such construction, an
estimate of costs , including the cost
of acquiring land, engineering services,
legal services, proposed indebtedness ,
including proposed maximum interest
rates and discounts, and other major
expenses related to the formation and
operation of the district. . . . "
(Emphasis added)
It is important for the Commissioners to understand that the Service
Plan is not the final plan which is binding on the proposed district.
To use the words of the statute, its elements are "preliminary" and
are mere "estimates" . To be sure the basic features of the Plan must
remain the same for it to have any meaning but changes and variations
in the Plan are clearly anticipated in the Special District Control
Act.
6. The Special District Control Act does not require the
County Commissioners to determine if the electors within the proposed
district should be allowed to construct a project and float a bond.
The question of whether the electors wish to form a district, wish to
provide the proposed services and wish to pay the cost of those
services is one only for the electors to decide. The review of the
County Commisisioners is limited to certain areas as set forth in
Section 32-1-205, C.R.S. 1973 .
"32-1-205. Service plan critera. (1)
The Board of County Commissioners may
disapprove the service plan submitted
by the petitioners of a proposed
special district upon satisfactory
evidence that:
(a) There is insufficient existing and
projected need for organized service in
the area to be serviced by the proposed
district; or
(b) The existing service in the area to
be served by the proposed district is
adequate for present and projected needs; or
(c) Adequate service is, or will be,
available to the area through municipal
annexation by other existing municipal or
quasi-municipal corporations within a
reasonable time and on a comparable basis; or
(d) The proposed special district is
incapable of providing economical and
sufficient service to the area within its
proposed boundaries; or
(e) The area to be included in the proposed
district does not have, or will not have, the
financial ability to discharge the proposed
indebtedness on a reasonable basis; or
(f) The facility and service standards of
the proposed district are incompatible with
the facility and service standards of adjacent
municipalities and special districts; or
(g) The proposal is not in substantial com-
pliance with a master plan adopted pursuant
to Section 30-28-110 , C.R.S . 1973 ; or
(h) The proposal is not in compliance with
any duly adopted county, regional, or state
long-range water quality management plan for
the area. "
7 . In its recommendation of March 6 , 1979 , the Department of
Planning and Services staff recommended approval of the Service Plan
based on each of these standards. At the time of the hearing, certain
questions arose concerning (d) , whether or not the district was cap-
able of providing economical and sufficient service to the area. The
Association asserts that there is no question that the proposed Plan
is economical since the estimated cost of providing the same amount
of water through the Little Thompson Water District would be $43 . 63
per month per homeowner and the cost through the proposed irrigation
system would be $21. 82 per month, as set forth on page 14 of the
Irrigation Study prepared by Resource Consultants, Inc. Even should
the Association experience increased costs over the next months and
even if the Association should determine that they wish to purchase
additional water rather than rent it, the estimated costs remain well
below the $43. 67 per month per lot owner. Further, it is important

to note, that Little Thompson Water District which supplies domestic
water to members of the Association will not allow the use of large
quantities of domestic water for yard irrigation. While individual
members of the Association may succeed in utilizing large amounts of
water for such purposes, if the entire Association were to proceed in
such a manner, the Little Thompson Water District would immediately
require the curtailing of such uses.
8. Section 32-1-209 (2) (3) provide as follows:
"32-1-209 (2) Upon final approval by the
district court for the formation of
the special district, the facilities,
services, and financial arrangements of
the district shall conform so far as
practicable to the approved service plan.
(3) After the organization of a special
district pursuant to the provisions of
this part 2 , material modifications of
the service plan as originally approved
may be made by the governing body of
such special district only by petition
to and approval by the Board of County
Commissioners in substantially the same
manner as is provided for the approval
of an original service plan; except that
the processing fee for such modification
procedure shall not exceed one hundred
dollars. Such modifications shall be
required only with regard to changes
of a basic or essential nature and shall
not be required for changes of a mechanical
type necessary only for the execution of
the original service plan. " (Emphasis
added)
This Section is cited to underscore the fact that the Service Plan
may be modified at a later date. Material modifications must be
approved by the County Commissioners while other types of changes
need no approval. It has been the purpose of this Service Plan to
provide high estimates of the cost of the project and its financing
in order to avoid an additional hearing before the County Commissioners.
It is obvious that if the system can be built or financed for less
than the projected amount, there would be no need for an additional
hearing but if the system were to cost more than originally planned,
an additional hearing would be required. Therefore, as the Special
District Control Act requires, the Service Plan consists of "prelim-
inary estimates" concerning the elements of the Plan as well as the
cost of construction and financing and no one should be misled into
thinking that these are the actual costs that will be incurred. It
is not the duty of the Association to provide the actual cost that
will be incurred at this time, the Special District Control Act only
requires preliminary estimates.
9 . The Association believes that it has satisfied the require-
ments of the Special District Control Act and answered all questions
of the opposition that must be answered at this time. Those opposing
the district have raised one additional argument that the Association
believes has no place whatsoever in any hearing before the County
Commissioners. It is the claim of these objectors that the Board of
Directors of the Association and members of the Association who sup-
port formation of the metropolitan district act without authority.
The Board of Directors of the Association deny this and assert that
these objectors have the remedy of petitioning for an election to
remove the Board of Directors if this is in fact the case. This
issue is an internal one within the Northmoor Acres Homeowners
Association and the Board of County Commissioners has no power to act

upon such an allegation nor does it have the right to act upon such
an allegation under the Special District Control Act. While it will
be the Association' s position that these arguments are totally
irrelevant to these proceedings, the Board of Directors has taken the
liberty to circulate a Petition to the County Commissioners which
speaks on behalf of those members of the Association who could not be
present for the hearing. Unfortunately, as with all circulated or
mailed Petitions, only 83 were returned but 77 of those 83 request
approval of the Service Plan while 6 oppose approval. At present,
the Association believes there are 155 qualified electors within the
proposed district. Furthermore, it should be noted that under the
Metropolitan District Act ten percent of the qualified electors of
the proposed district may request an election.
To summarize, the Association is requesting that the Board of
County Commissiones approve the Service Plan which is admittedly and
purposefully preliminary and estimated in nature and that they approve
such plan so that the members of the proposed district may exercise
that inalienable right, the right to vote.

Dear Russ:
In view of the Planning Commission' s concerns about the
availability of water, the Board of Directors of the Northmoor
Acres Homeowners Association have decided to request that
their engineer prepare a report on the expected delivery of
water under the water rights presently owned by the Association
and the actual consumptive use expected by the uses proposed.
As you may know, determining average delivery for any water
right is a time consuming endeavor, and therefore, the
Assocation will need additional time before they make their
complete presentation to the County Commissioners.
The engineers have estimated they will need at least until
the middle of May, 1979 , to complete the report and therefore,
I am requesting this matter be tabled until May 16, 1979, or
May 23 , 1979 , at the convenience of the County Commissioners.
I presume it will be necessary for me to appear at the March 14 ,
1979 , hearing, but would appreciate it if you would confirm this
with me. In interest of saving the time of the County Commissioners
and my time, I would appreciate it if you could put this item
at the top of the agenda March 14 , 1979 , if my appearance is
necessitated.

1. That on the t day of February, 1979, there was
filed with the Board of Commisisoners of Weld County, a Service
Plan for said proposed District, with additional copies for con-
sideration by the County Planning Commission.
2 . That such Service Plan fully complies with the
provisions of the "Special District Control Act" , as to all of
the information required to be therein contained.
3 . That petitioners have also accompanied said
Service Plan with a processing fee as provided by law in the
amount of $200. 00.
4 . That petitioners have also submitted to the Board
of. Commissioners, a copy of the proposed form of Petition to
the District Court for the organization of said proposed District.

so that Petitions may be filed with the District Court and an

The Farmers Extension Ditch Co. is a carrying ditch only. It is the
main water carrier for the farms serviced by it, and the laterial ditches
running from it.
The Bunyan Laterial Ditch Co. is also a carrying ditch servicing fauns
with water from the Farmers Extension Ditch.
Ownership of stock in the Farmers Extension Ditch Co., and the Bunyan
Laterial Ditch Co., constitutes carrying rights only and does not involve
the ownership of any water itself.

Dear Mr. Olson,
The Supply Ditch can issue fifty inches of water
per share , if Beaver Lake is full . There is usually a
ten per cent ditch shrink taken. This would make
approximately 45 inches per share.
In normal seasons , you could possibly receive
10 - 12 A.F. per share from direct flow ( river water) if
you are able to handle the water at the time it is
available. The amount of direct flow depends on runoff
and heavy rains and also the demand by senior ditches .

4,797.7 acre feet of water from the Little Thompson River.
At full capacity the company issues 125 inches or approximately
6.25 acre feet of water per share of stock.
The company records show the following amounts issued for the
years indicated.

1971 - 125 inches 1976 - 50 inches

The total assessed value of Northmoor Acres is $455,610.00 (per service plan)
and the mill levy is 77.08, therefore, the taxes generated are $35,081.97
which includes General, School District, Jr. College, Water District and
existing Fire District.
The total cost to the members of the Proposed district as shown in the service
plan is $21,045 for the first year or 60% of the Ad Valorem taxes or the
equivalent of a 46.19 mill levy.
CONCLUSION:
1. There is not adequate water to supply the district as proposed.
2. The proposed Northmoor Acres Metropolitan District would not be capable of providing
an economical water supply system as compared to the existing Little Thompson
Valley Water District .
3. The Northmoor Acres area does not have enough Tax base to justify $180,000 indebtedness.

Homeowner, in regard to an unbiased opinion by a Water
Broker to the value of the water owned by Northmoor Acres
Homeowners Association.
In research, Northmoor Acres Homeowners Association owns
5 shares Supply Ditch, 11 shares New Ish , 12 shares Bunyon
Lateral and 11 shares Farmers Extension. The last two ment-
ioned being carrying rights only and does not constitute the
ownership of water.
New Ish has a record of being sold for $300,00 per share in
1978, (2 shares). The average delivery of New Ish is app—
roximately 2 acre feet, however there have been many years
when New Ish has delivered little or nothing, therefore averages
can be very deceiving with New Ish. Also, New Ish owners are
liable and must assume all responsibility of Ish Reservoir.
Supply sold last year for $5,000.00 per share, (2 shares).
Supply is a fairly good water right only if an owner has good
carrying rights and storage. In the case of Northmoor Acres
which is located towards the end of the ditch, this makes Supply
of less value to subject land because said land would typically
receive less water than these properties closer to the river.
On the otherhand, to those who have ditch rights that can have
the water delivered when it is available and have a need and/or
storage, Supply could average approximately 12 acre feet per
share. You see, Supply is a river right and delivers water
only when the river is up and generally no later than June 30th,
in any given year.
