GRANT OF EASEMENT

THIS GRANT OF RIGHT-OF-WAY EASEMENT made and entered into this 15`h day of
February in the year 2006 by and between Chad Mann, 22991 Weld County Road 43, La Salle,
Colorado, 80645 (hereinafter referred to as the "Grantor"), and Alicia Vasquez, 23037 Weld
County Road 43. La Salle, Colorado, 80645 (hereinafter referred to as the Grantee).
BACKGROUND OF GRANT OF RIGHT-OF-WAY EASEMENT
The following background statements are provided to aid in the understanding and
interpretation of this document:
A. Grantor is the owner of the described Lot A of Recorded Exemption 41650; being
part of the N2NE4 of Section 9. Township 4. Range 65 Weld County, Colorado
("Property A")
B. Grantee is the owner of the described Lot A of Recorded Exemption #1970; being
part of the S 1/2SE1/4 of Section 4, Township 4 North, Range 65 West of the 6th
P.M.. Weld County_ Colorado ("Property B' )
C. Grantor desires to grant Grantees and landowners on and to the north of Property
A an easement and right-of-way for ingress, egress and for the placement of
utilities as needed for benefit of afore mentioned landowners located on or to the
north of Property A.
GRANTOR HEREBY GRANTS. SELLS AND CONVEYS. TO GRANTEE. their heirs and
assigns an easement and right-of-way for ingress and egress over Property A as an access to
Property B under the following terms:
For One Dollar ($1.00) and other good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged. the Grantor has this date bargained, conveyed,
delivered, transferred, and sold, and by these presents, does bargain. convey, deliver, transfer,
and sell unto the grantee, its successor's and assigns. a non-exclusive easement for access_ said
easement being described as the presently existing access road on the north edge of Property A
which shall be used by the grantee. The Easement shall not be wider than 30 feet and shall
connect Property B to Weld County Road 43.
The Easement is for the benefit of and appurtenant to that land described above as
Property B and Property A.
The Grantee and all other users of the Access Road shall jointly maintain the Easement in
good condition and further shall be responsible for adequate snow and trash removal.
Any liability for personal injury to Grantee. its employees, agents. and invitees, as a
result of or arising out of or relating to the use or occupancy of the Easement by Grantee shall be
borne by Grantee. Further. Grantee agrees to indemnify and hold harmless Grantor, its

attributable to the use of the L_sement whether or not such use is permitted hereunder.
At such time and in the event the Easement shall be abandoned for a period of one (1)
year that property interest of Grantee therein shall immediately terminate and shall therefore
revert to Grantor, its successors and assigns.

Dear Ms. Vasquez:
On October 3, 2005, Pam Smith of this Department reviewed the engineer evaluation of the
septic system for your proposed home and office use for your Use by Special Review
application, USR-1485.
Based on the engineer evaluation, the existing individual septic disposal system is not of
sufficient size and capacity to adequately handle the proposed 104. The system was evaluated
for a residence with 5 bedrooms and office space with a maximum of seven office workers.
According to the Weld County ISDS Regulations, the tank is undersized by 500 gallons.
This Department requires that a repair permit be obtained and the tank capacity be increased to
1750 gallons or replacing the tank with one made of an approved material.
Based on all available data, the field is undersized by an estimated 52 percent. This Department
requires that a repair permit be obtained and the field size increased to a total of 1544 square
feet.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume
any liability to the owner of the above property, to any purchaser of the above property or to
any lending agency making a loan on the above property or in the report.

This inspection was conducted for the purpose of determining compliance with current regulations
and for detecting health hazards observable at the time of inspection. This does not constitute a
warranty that the system is without flaw or that it will continue to function in the future.
Inspections requested during periods of snow cover and high soil saturation may be of questionable
value to potential buyers due to adverse conditions. Evaluations based on Statements of Existing
(S.O.E.) relies on information the property owner provides, under oath, indicating current status of
the system and representing to the best of his/her knowledge the system is not failing to function
properly.

Here is the latest on the Rick Torrez permit. Thomas Surveying has made all the site plan changes that you had
indicated on the map, but we are waiting to see if the septic tank area is going to change. Let me know if you
would like to see what he has done so far. I have been in contact with Tom Cope at Total Engineering, and he
hasn't gotten anything to me in writing, but right now he feels the septic may be 250 gallons short. He told me he
will have something for me in the next week. I have talked to 2 building engineers. Neither one wants to sign off
on an existing pole barn. I have a call in to Wernsman Engineering to see what they can do. Rick Torrez was
wondering what else he needs to do to the concrete slab that he poured. He mentioned to me that you needed
some changes done to it. Rick told me that Don Carroll said it looked o.k. so he wasn't sure what else needed to
be done. I haven't had a very good experience with Total Engineering up to this point, as I feel they have had
plenty of time to take a look at this septic system. But at this point I feel it will take even longer to get someone
completely new involved. Please call me with any questions or information at 352-8111. Alicia Vasquez was
supposed to send you some of the information that you were requesting, I don't know if she ever followed through
with that.

The Weld County Public Works Department has researched the section line right-of-way with the title company
for WCR 48 (west of where WCR 43 would be) right-of-way. Our research has determined through the title
company that the land patent date of July 15, 1874, predates our 1889 resolution. Therefore, Item No. 1-B-5,
prior to recording the plat, can be removed.
The Weld County Public Works Department asks for a Non-exclusive License Agreement for the Upgrade and
Maintenance of the Weld County Rights-of-Way shall not be required.
WCR 48 is a section line access with no county maintenance.
