However, there was instruction to have the section line surveyed between Sections 20/21 to determine whether Slawson will need to negotiate with the USDA for a permit or with Mr. Hoeffner, and if that option fails, then the matter may be brought back before the Board for further consideration. Given the recent developments described in the message below, it does not appear any action is necessary at tomorrow's meeting. I will add a copy of this correspondence to last week's documents as follow-up regarding the outcome. Also, Mr. Hoeffner did call our office earlier today, prior to you contacting me, and we informed him at that time that there would not be any action taken tomorrow. We do not have his contact information, so would you please forward this message or provide him with a courtesy call regarding the information described above. Thanks! Esther E. Gesick Deputy Clerk to the Board Weld County, Colorado 915 10th Street Greeley, CO 80631 (970)336-7215 X4226 (970)352-0242 (fax) Original Message From: Donald Carroll Sent: Tuesday, October 26, 2010 10:04 AM To: Jacqueline Hernandez-Barrow; Esther Gesick; David Bauer; Pat Persichino Subject: FW: PLEASE CANCEL Glory Hole Non-Exclusive Agreement Item for 10/27 hearing Importance: High Original Message From: rocky mountain permitting llc fmailto:rmp(alq.coml Sent: Tuesday, October 26, 2010 9:58 AM To: Donald Carroll Cc: Kevin Anderson; Paul Morris; Terry Hoffman Subject: PLEASE CANCEL Glory Hole Non-Exclusive Agreement Item for 10/27 hearing Importance: High Don, 1am,nu,ucaian,o //—/— o/0 1 c20/0 1Sj GtDeao2 Kevin Anderson has had further discussions with Mr. Hoeffner regarding a ROW, and has been in communication with Mary Ashby with USDA regarding access in Section 20 as requested in last week's BOCC hearing. However, Slawson Exploration has obtained a one-year extension on this State lease in Weld County, which includes the Glory Hole 16-10-65 location. Given the lease extension, Slawson will not be pursuing a Weld County Non-Exclusive License Agreement for access at this time; please cancel this for tomorrow's BOCC hearing. Slawson, Kevin and I appreciate all your efforts and assistance, Don. If you have any questions, please do not hesitate to contact me or Kevin Anderson. Thanks so much, Kalen Kalen C.
