RE: ACTION OF THE BOARD CONCERNING ZCV #0900298 AGAINST SANTOS
MENDEZ AND ALBERTO MENDEZ FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Santos Mendez and Alberto Mendez, ZCV #0900298, are allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13h day of July, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Santos Mendez, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 13, 2010, to allow adequate time for the property owner(s)
to bring the subject property into compliance by installing additional screening on the property,
and for an additional inspection to be completed by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #0900298 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Santos Mendez and Alberto Mendez to remedy the
violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until August 13, 2010,
to allow adequate time for the property owner(s) to bring the subject property into compliance
installing additional screening on the property.

SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of Planning
Services.
REMEDY
All commercial storage, signs and/or equipment shall be (including, but not limited to oil and gas tanks)
shall be removed from the property or a Use by Special Review (USR) application shall be completed and
submitted to this office.
Additionally, all DERELICT VEHICLE, iron/metal and miscellaneous debris shall be removed, restored or
completely SCREENED from all adjacent properties and public rights-of-way.
RECOMMENDATION
The Department of Planning Services staff recommends that this case be forwarded to the County
Attorney's Office for immediate legal action.

the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation.

however, we have no discretion in this matter if you fail to correct this violation. You have until
11/30/2009, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

On Tuesday, October 27, 2009 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding a current zoning violation. (The legal description is Section
Lot B RE-4214; Part of the N2SE4 of Section 32, T4N, R66W of the 6th P.M.; Situs Address is 29
CR)
Background Information:
The site is currently in violation for leasing space for storage. The applicants expressed desire
to submit a Use by Special Review (USR) permit, however due to financial hardship they are not
able to complete the application and submittal.
The site was turned in for noise issues. Upon inspection of the property, the compliance officer
noted signs on the fence indicating space for lease as well as some possible commercial
storage (oil tanks).
The applicants wish to comply with the Weld County Code and inquired what steps are required
to be in compliance prior to submitting a USR application. Staff stated the following would need
to be removed to return to compliance:
• All signs need to be removed
• Oil and gas tanks need to be removed
• Any derelict or unlicensed vehicles need to be screened from adjacent landowners and
property rights-of-way.
The landowners stated that they have removed all the signs as well as any commercial type
storage. The oil and gas tanks are for personal use. Mr. Mendez commented that he would like
to cut them in half and use them as storage. Staff advised Mr. Mendez to store the oil and gas
tanks in the screened storage area.
Staff directed the landowners to screen the storage area on all 4 sides so it is not viewable from
adjacent property owners or property rights-of-way.
Mr. Mendez inquired about possibly having an auction or flea market every few months. Staff
stated that this type of business would need to have a Use by Special Review Permit. Staff
added that there would be additional issues which would be evaluated such as traffic circulation,
parking and water and sewer sanitation.
Staff informed the landowners that they have thirty (30) days from today to remove all the signs,
clean up the storage area and finish the screening. Ms. Siron will follow-up with written
correspondence.
Staff urged the landowners to contact staff for any questions at 970-353-6100 ext. 3540.

It has come to the attention of the Department of Planning Services staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are as follow:
THE OPERATION OF A COMMERCIAL STORAGE FACILITY WITHOUT A USE BY
SPECIAL REVIEW (USR) PERMIT. ADDITIONALLY THE PRESENCE OF A
NONCOMMERCIAL JUNKYARD CONSISTING OF DERELICT VEHICLES,
CAMPER/TRAILERS, COMMERCIAL VEHICLES AND OTHER DEBRIS NOT BEING
USED TO MAINTAIN THE PROPERTY.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags;
used cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools;
used appliances; used lumber or crates; building materials; fabrication of any material;
used pipe or pipe fittings; used conduit or conduit fittings; used automobile parts;
DERELICT VEHICLES; used tires and other manufactured goods that are so worn,
deteriorated or obsolete as to make them unusable in their existing condition.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
