RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV#1000007 AGAINST STEVEN AND DOROTHY MULLISON FOR VIOLATION OF
THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Steven and Dorothy Mullison, ZCV #1000007, is allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of April, 2010, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Dorothy Mullison, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners determined the property was in
compliance and deems it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#1000007 be, and hereby is, dismissed due to the property being in
compliance with the Weld County Code.

KENNEL: Any place other than a PET SHOP or veterinary clinic or HOSPITAL, where five
(5) or more HOUSEHOLD PETS of one (1) species, or a total of eight(8) or more household
pets of two (2) or more species, are kept or maintained. Property that is zoned (A)
Agricultural and not part of a platted subdivision or unincorporated town and which is larger
than ten (10) acres shall be permitted to keep or maintain eight (8) HOUSEHOLD PETS of
one (1) species or sixteen (16) HOUSEHOLD PETS of two (2) or more species without
being considered a KENNEL.
REMEDY
In the letter from Ruby Pelton-Roby, dated March 1, 2010, Ms. Pelton-Roby indicated an organization is
willing to come in and spay/neuter all of the cats on the premises. While this is great news, it will not
correct the Zoning violation. I have discussed this case with County staff. It is important to state that
prior to investing the time and resources in this endeavor, maintaining and caring for more than 4 (four)
cats is still the underlying zoning violation.
Either the number of cats shall be reduced to not exceed 4 (four) at any time or a Use by cflani-' °e,,;e,.,
(USR) permit is necessary to bring the property into compliance. 2010-0712

01/20/2010 Property Inspected Upon a visual inspection of the property, the following
items were noted: multiple cats were sitting right around
the front porch of the house. No pictures were taken
during this inspection.
01/28/2010 Phone Call Dorothy Mullison (303-849-5277) called. She said she is
home daily after 3:30 pm every day. She said she
received a letter. I asked about cats. She said yes. I
advised her about the Pre-Application Request
form/process. I told her that the planners would walk her
through the USR process. She asked if that still applied
because the cats roam all around Roggen. They aren't
hers. I asked what the maximum number of cats were
that she provided food for. She said somewhere between
10- 15. She said she also has 3 cats inside her house. I
told her that we had staff tomorrow morning and that I
would call her after 3:30.
01/29/2010 Other I presented her question of these cats being "town"cats
and staffs determination was that she provided food and
care for these animals so she would need to complete a
USR applicaton.
01/29/2010 Phone Call Dorothy Mullison (303-849-5277) called and left a voice
mail stating she had not heard back from me. I attempted
to return her call 4 times and I keep getting "I'm sorry,
you must first dial a 1 before dialing this number"- but I
was dialing 913038495277.

• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process; however, this review is not an application.

Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre-Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre-submittal agenda, the request and required checklist items must be received one week prior to

cats, but will check them and treat them for disease.
Divine Feline would like to schedule their visit after the possibility of snow
has passed, late April or early May. They normally have volunteers who will set
the traps and help handling the feral cats, but they are not sure they can get the
volunteers to come all the way to Roggen. I think with a little effort, we can get
some local folks to help.
It would be nice to get the females spayed before they have more litters.
Perhaps we can try to catch the known female breeders and get them down to
the R.M.A.C.A. before the big round-up.
Through a diligent effort to spay and neuter feral and domestic cats, the cat
population in Roggen will abate. Since the Mullisons are committed to solving
the feral cat problem for the long term, I hope you will allow them to resume
feeding the stray and feral cats that have come to depend on them. It is not these
kitties' fault their owners died or moved away, they should not have to starve to
death as a consequence.

Weld County Code are as follow:
In order to maintain or care for more than 4 (four) cats (HOUSEHOLD PETS), a Use by
Special Review(USR) permit is required. The first step in this process is a Pre-Application
Request meeting. This step is completely free to the application, but does require

PRE-APPLICATION REVIEW REQUEST
• The pre-application request is the preliminary review of a land use proposal. Pre-application reviews are required
prior to beginning the application process; however, this review is not an application.
• Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre-Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre-submittal agenda, the request and required checklist items must be received one week prior to
the review date, and shall include at a minimum, a description of the property including surrounding lands and land
uses, property owners name and contact information, a brief narrative and a map delineating the property location,
in addition to the other items listed.
• The Property Information required below can be found on the Weld County Assessor website at www.co.weld.co.us
Please print a copy of the Assessor's page and submit it with your pre-application review request.
• Mail,fax or drop off the request and required checklist items to the address listed below, a minimum of one week
