Hiner Construction Co., Inc. 11 Austin Road Lamar, Colorado 81052 Subject: Use by Special Review No. 1075 Parcel #: 0803-31-2-00-009 Legal: Lot B, RE-1807, part W2 NW4 31-6-65 Dear Mr. Hiner: The Department of Planning Services sent a letter dated June 29, 2009 and April 6, 2010 to your attention concerning the number of self contained recreational vehicles parked on property generally described as south of County Road 64 approximately one mile east of 25th Avenue on lands adjacent to the Weld County Business Park. The June 2009 letter was provided as the Department of Planning Services was requested to research the above referenced land use case for compliance with the permitted uses allowed per the Board of County Commissioners resolution of April 12, 1995. For reference, excerpts of this resolution are as follows: The Special Use Permit plat is of particular interest to this office as this recorded document sets the rules for use of land as agreed to by you or your representative at a public hearing. This recorded Special Use plat, specifically outlines the numbers of"self contained RVs" permitted on site and the number of outdoor storage structures. For USR-1075, the number of recreational vehicles is limited to six and the number of storage structures is limited to two. As indicated in the June 29, 2009 letter, County staff performed a visual inspection on June 26, 2009 of this property and determined there are substantially more than six recreational vehicles on site and multiple storage structures, many more than the permitted two. Visual inspection of the property on April 6, 2010 determined six vehicles are present on site with multiple storage units and boat canopy structures. Visual inspection of April 12, 2010 determined eight self contained mobile homes, multiple power boats, four port-a-lets and regrading of the northeastern and northern lake bank edge. 2010-0767 rrnaum,cciat-"- -1 i0 PL ogq° As requested in the April 6, 2010 letter, this office requests evidence from the Division of Reclamation Mining and Safety (DRMS) that the property has been released from permit number M1977-151 for RH Hiner Construction Company, Inc. Also, given the modification of the lake edge in two locations, this office seeks written confirmation from DRMS that the site continues to be in compliance with the Reclamation Plan of record on file at DRMS. Given the current condition of too many recreational vehicles on premises as permitted, this office requests you or your representative meet with County staff concerning the future permitting of the property. It is the opinion of this office that an amendment to the existing land use permit to address the additional recreational vehicles, storage structures and physical improvements located on the property is warranted. To facilitate this amendment to the existing permit, this office will require a pre-application meeting with you or your representative to discuss the proposed land uses. Also attending this meeting will be representatives from the Departments of Public Works, Environmental Health and Planning Services, including the Building Division. The purpose of this meeting is to discuss the amendment with County representatives who will provide information on the proposal and potential issues that may be encountered as the application moves forward. The pre-application meetings are held all day on Thursday commencing at 9 AM and occurring hourly and on Friday at 10A, 11A and 130PM in the Greeley Planning office, 1555 No. 171h Avenue, Greeley. Please contact this office within thirty days of the date of this letter to discuss the current condition and also the future opportunities for the site. Failure to respond to this request will result in staff scheduling a Board of County Commissioners hearing to revoke the current Special Use Permit, USR-1075. A new development post the June 2009 letter includes the grading of the edge of the reclaimed lake adjacent to the easternmost shoreline.
