HomeMy WebLinkAbout20103471.tiff MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, February 11, 2010 at 10:00 a.m., in the Hearing Room of the Weld County Planning Department at 918 101h Street, Greeley, Colorado. Members Present Don Posselt, Robert Fleck, Jerry Adams, Heidi Hansen, Don Somer. Don Magnuson, and Doug Melby. Members Absent: Al Trujillo, and Lyle Sheeder. Also Present: Michelle Martin, Department of Planning Services and Kris Ranslem, Secretary. CASE NUMBER: PF-1079 APPLICANT: Schrage Living Trust PLANNER: Michelle Martin REQUEST: Final Plat for a PUD (The Meadows Estates PUD)for five(5) residential lots with E (Estate) uses and 9.4 acres of common open space. LEGAL DESCRIPTION: Lot B RE-4042 being Part of the E2 NE4 of Section 6,T4N, R68W of the 6th P.M.,Weld County, Colorado. LOCATION: South of and adjacent to State Hwy 60 and west of CR 3. Michelle Martin, Planning Services, stated that Schrage Living Trust, in care of Ted Schrage, has applied for a Final Plat for a Planned Unit Development(The Meadows Estates PUD)for five (5) residential lots with Estate uses and 9.4 acres of common open space. The site is located south of and adjacent to State Highway 60 and west of County Road 3. The proposed PUD will be serviced by: Little Thompson Water District Septic Systems Gas: Xcel Energy Electric: Xcel Energy Phone: Qwest The Department of Planning Services is recommending that the applicant provide utility easements in compliance with Sections 24-7-60 and 27-9-40 of the Weld County Code. Sec. 24-7-60. Easement standards. A. Easements shall follow rear and side lot lines whenever practical and shall have a minimum total width of twenty (20)feet apportioned equally on abutting properties. B. Where front line easements are required, a minimum of fifteen (15) feet shall be allocated as a utility easement. There is an existing residence and some outbuildings that are on Outlot 5. The applicant has proposed a 20 foot utility easement along Schrage Way. Right now the perimeter easement is shown at 10 feet for the exception of a portion which is a 20 foot easement. Ms. Martin commented that after speaking with the applicant he is willing to increase the perimeter easement to 20 feet. There is a drainage easement that encompasses primarily all of Outlot B. Right now the applicant is showing a 10 foot easement along those perimeter boundaries. J.L Walter, J.L. Walter Consulting, stated that he is representing Ted Schrage. Mr. Walter said that they didn't put the extra 10 feet along the perimeter just because it is adjoining agriculture ground; however they are willing to increase the perimeter easement to 20 feet. Mr. Walter commented that there are easements around the detention ponds. The entire pond will have a blanket drainage easement. Don Magnuson recalled an irrigation canal that runs through this property and asked if we are relying on historical documents or are we checking to make sure that access through there is adequate for the irrigation canal. Ms. Martin stated that the Home Supply Ditch runs along the southern boundary of the e?of0 -S97/ property. She added that a referral was not received from the Home Supply Ditch and that the concerns and issues were worked out at the Change of Zone stage. Ms. Martin commented that she is assuming that the recorded easements that were established prior to the final plat are adequate for access. Don Posselt said he didn't see any labeling of the utility easements and wanted to make sure that it is clear on the plat. Ms. Martin stated that staff will ensure that the applicant makes that clear on future documents. Don Somer asked if the easement along Highway 60 is 10 or 15 feet. Ms. Martin said that currently it is indicated as 10 feet; however staff has asked the applicant to increase that to 20 feet and the applicant has agreed to make that change. Heidi Hansen clarified if the right-of-way shown along Highway 60 is the ultimate future right-of-way and that the bus shelter is outside of that future right-of-way. Ms. Martin replied that was correct. Jerry Adams summarized the changes which include increasing the perimeter easement to 20 foot, all utility easements should be labeled on the plat, and increase the easement adjacent to Highway 60 to 15 feet. Don Magnuson moved to approve the final plat along with the recommended changes, seconded by Don Somer. Motion carried unanimously. Jerry Adams commented that he has been the Chair of this Board for a number of years and added that it is time for someone else to fill this position. No one wished to make any nominations and agreed that Jerry should continue to facilitate the meetings. Jerry said that he would continue to be the Chair; however he asked that the members continue thinking about filling this position. Robert Fleck said that he would fill the Vice-Chair position. Schrage 23505 WCR 5 Loveland, CO 80537 Dear Ted: This letter is in response to your request for an updated water service commitment for up to 4 additional residential lots, in the location described as follows: PORTIONS OF NE 1/4, SEC.6, T4N,R68W--WELD COUNTY, CO The District provides water service within its service area as defined by the District. The provision of water service by extension of existing water lines of the District to the above property and the installation of taps for lots is done under the terms of the Rules and Regulations of the District established by the Board of the District from time to time. You may obtain a copy of the Rules and Regulations from the District. This letter outlines the provisions of the Rules and Regulations; however this letter does not change any provisions of the Rules and Regulations. The Board of the District may alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to alteration and amendment based on changes in the Rules and Regulations of the District. We currently serve the proposed lot 5 through tap # 1587 and have a 10" diameter water line located along Hwy. 60 with additional capacity available. We can commit to provide service to the above property, subject to the limitations in this letter, for one standard residential 5/8" X 3/4" water tap per lot; and the following additional limitations on the provision of water service are: 1. All improvements to District facilities required to provide service will be the financial responsibility of the developer in accordance with the District Rules and Regulations. All improvements must conform to District Specifications. 2. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that needs to be paid prior to installation of the fire hydrant. You will be responsible for any improvements or upgrades needed to meet the required fire flows in your subdivision. Y , 3. In order to provide service to the proposed subdivision you will be required to install a minimum 6" diameter water line from the 10" line along Hwy. 60 through the proposed subdivision, the line maynot be longer that 800' without a loop to help maintain water quality. Plan and profile engineered plans for the subdivision waterline will need to be updated and submitted to LTWD for review and approval. 4. Prior to initiating water service, you will need to provide evidence that the property is included in the Northern Colorado Water Conservancy District as well as the Little Thompson Water District. You will also need to have the property included in the Municipal Sub District of the Northern Colorado Water Conservancy District. 5. You will be required to provide the needed water lines in the proposed subdivision. The design, installation and total cost of the project will be the responsibility of the developer. This commitment letter will expire two years from the date of this letter if the taps have not been purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8" X 3/4" tap is $23,000.
