This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Weld County Road Classification Plan (FHU): WCR 50 and WCR 17 are arterial roads, which require a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access: • Road Access Policy (Policy Established Sec. 8-2-10): Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within the unincorporated areas of the County The applicant has multiple dangerous accesses at the intersection of WCR 50 and WCR 17. These are busy arterial roads with high traffic volumes. Our most recent traffic counts for WCR 17 were taken in August of 2009 and show 3,137 vehicles/day south of the intersection and 4,025 vehicles/day north of the intersection. On WCR 50 there were 1,522 vehicles/day in April of 2009. 1. The applicant must permanently close the access at the corner of WCR 50 and WCR 17 as well as the proposed access onto WCR 17 that appears to already be in limited use. This may be done with landscaping materials, fencing, a chain or the equivalent. Photographic evidence of the closures must be submitted to Public Works. 2. The existing access and gravel driveway shall be graded and drained to provide an all-weather access to the facility. 3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs tc be maintained at a maximum height of 12 inches until the area is completely developed. Storm Water Drainage: • 4. Water is supplied by Little Thompson Water District (tap 1625). The district did provide a letter stating the existing tap can be transferred to a commercial tap. The kennel may have one or two employees. There will also be clients who come to the site and they must have access to potable water, restroom and hand washing facilities. Either a septic system will need to be installed for kennel usage or the existing restroom must be made available for use. There was also no mention if any water will be used in the daily sanitation of the kennel and/or supplies (bowls, bedding ect). • There is an existing septic system (permit SP-9600444) that was permitted for a 3 bedroom residence (6 people) and will require an engineer's review to ensure there is sufficient capacity to serve the proposed kennel operation as well as the small engine repair shop if the usage exceeds 6 people and/or wastewater from the kennel operation is disposed of in the existing septic system. The application indicates that waste is cleaned from the kennel on a daily basis and placed in a dumpster which is picked up bi-weekly by Waste Management of Northern Colorado. Waste from the small engine repair shop will be recycled by Mares located in Miliken. The waste handling plan should contain the name, address and phone number of the Waste Management office that is responsible for servicing the dumpster. A minor dust abatement plan is required for on site dust. Noise will be restricted to the level allowed in the non-specified zone district. A copy of the 2010 Pet Animal Care Facilities Act license is required. • • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: The following requirements are recommended to be met prior to allowing the plat to be recorded: 1. In the event the applicant intends to utilize the septic system at the existing home for clients, engine repair shop personnel and/or kennel sanitation needs, the septic system shall be reviewed by a Colorado Registered Professional Engineer if the usage exceeds 6 people and/or wastewater from the kennel flows into the septic system. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. Alternately to item #1 above, the applicant shall install an individual sewage disposal system for clients and kennel sanitation needs and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional • Engineer according to the Weld County Individual Sewage Disposal Regulations. 3. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • 2 • 5. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any vehicle/equipment maintenance facility located on the site that is equipped with a floor drain. Alternately, the applicant can provide evidence that they are not subject to the EPA Class V requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least bi-weekly from the facility and disposed by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. • 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 6. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. . 9. Adequate drinking, handwashing and toilet facilities shall be provided for employees and clients of the facility, at all times. • 3 • 10.Sewage disposal for the facility shall be by septic system. In the event the applicant intends to utilize the septic system at the existing home for clients, engine repair shop personnel and/or kennel sanitation needs, the septic system shall be reviewed by a Colorado Registered Professional Engineer if the usage exceeds 6 people and/or wastewater from the kennel flows into the septic system. If the system is found to be inadequately sized or constructed the system shall be brought into compliance with current regulations. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing public water supply. Case Number: USR-1751 Parcel Number: 0957 33 000031 • Narrative: According to Weld County records, three (3) of the proposed buildings to be used have never been permitted. One (1) building that was permitted in 1996 is a 24'x32' detached garage. 1. Building permits shall be obtained prior to starting. A plan review is required for each building or structure for which a building permit is required. Two complete sets of plans are required when applying for each permit. Include a Code Analysis Data sheet for the Weld County Building Department for each structure that requires a permit. Submittal plans shall include a floor plan showing the specific uses of each area for the building. Plans shall bear the wet stamp of a Colorado Licensed Architect or Engineer. 2. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2008 National Electrical Code; 2006 International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. 3. The facility passed the inspection and the corresponding license was mailed. The only concern I had pertained to drainage. During a February (non)-compliance visit, there was an accumulation of ice in the northern most Bernese Mountain Dog enclosure.
