The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Road Classification Plan (FHU): The Colorado Department of Transportation (CDOT)
has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley
office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that
may be needed to obtain or upgrade the permit. (State Highway 392)
Site Plan: The applicant shall utilize the existing access to this parcel.
Camping/parking spaces and the access drives shall be surfaced with gravel, recycled asphalt or the
equivalent and shall be graded to prevent drainage problems.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in
such a manner that it will reasonably preserve the natural character of the area and prevent property
damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration
and/or unplanned ponding of storm run-off.
Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for a water ski club and a
commercial hunting club. There are currently 25 members of the ski club and no
employees. However, the ski club may be expanded to 50 members based upon the
lease agreement with New Cache La Poudre Irrigation Company who owns the lake.
No information was provided regarding the hunting on site other then the outfitters
name, license number and the months of operation. It appears that the water ski club
and the hunting club are independent of each other and although both are seasonal
uses, this application combines the two uses which causes the use of this facility to
become a year round occurrence.
There is no water or sewer service on the site. The lessors currently provide portable
toilets for skiers and the individual camper units are self contained. There is not a dump
station on the property. The application did not state what the hunters use for sanitary
facilities. The following section is from Environmental Health Services, Weld County
Department of Public Health & Environment, Septic Policies.
Policy 2.2.K Use of Portable Toilets
Purpose: To define when Portable Toilets may be used in lieu of a vault or
septic system.
Policy: Portable toilets may be utilized on sites for temporary and seasonal use
for up to six months as part of the Temporary Seasonal Permits issued by Weld
County Planning for situations such as fireworks stands, Christmas tree stands,
seasonal recreational facilities, etc.
As noted above, it is the policy of this department that portable toilets are allowed when
a use is temporary or seasonal for a time period of six months or less. The applicant
states the water ski activities will occur from April through Labor Day and the hunting
club will use the facility from September to February. As the time period exceeds 6
months in duration, the use of portable toilets cannot be allowed as the facility is not a
seasonal use.
This Department will require the installation of a permanent restroom facility. The
installation of the restroom will require a septic permit through this Department. As this
is a commercial facility the septic system must be designed by an engineer and
approved by the Board of Health. A permanent water supply is also required.
A waste handling plan is required and should include the name, address and phone
number of the waste removal and disposal companies. The plan should indicate how
any waste associated with the facility, such as garbage, is contained and disposed of.
A dust abatement plan, for on-site dust, is required. Noise will be restricted to the level
allowed in the commercial zone district.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. Submit documentation, to Environmental Health Services, Weld County
Department of Public Health & Environment indicating that a permanent water
source is available for the facility.
3. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations. Submit documentation, to Environmental Health
Services, Weld County Department of Public Health & Environment indicating a
septic system designed by a Colorado Registered Professional Engineer.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
7. RV units that have self-contained sewage disposal, shall dispose of sewage at
an approved off-site facility.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
personnel using the facility.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.A permanent restroom facility shall be provided for the public.

11.In the event the facility's water system serves more 25 persons on a daily basis
the water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1).
12.This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
13.All potentially hazardous materials, such as fuel, must be stored and handled in a
safe manner in accordance with product labeling.
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
Additionally, please note the following:
1. The applicant should be made aware the lake water may not meet all water
quality standards for natural swimming areas as defined by the Colorado
Department of Public Health and Environment. We strongly encourage the
applicant to periodically test the lake water.

Upon review of the submitted Planning documents presented to our elected Board of Supervisors at our
January 2010 Board Meeting, it was voted upon to refer the following concerns about the above
referenced Plan to the Weld County Planning Office.
We are concerned about measures that need to be taken to ensure that any invasive aquatic species, there
are several of specific concern to Colorado water bodies that allow boating, waterskiing and other
motorized watercraft activities. Specifically of concern, but not limited to, are Quagga and Zebra Mussels
that have a devastating effect upon water supply and irrigation systems, causing extensive damage. Their
infestation is most prominently found in bodies of water with uninspected water craft.
It is also noted that the District has received other concerns about the activities of the body of water in
question:
• access to local residents for fair access and use
• notification of zoning change proposal to local residents affected by the changes
• Release of water from the lake into the stream which is encountering a frozen barrier
compounding saturation and flooding
• Seepage of water into local farm lands
It is noted that some of the complaints do not directly impact the zoning question being proposed, but we
did tell the complainants that we would make note of the concerns.
