RE: APPROVAL OF RECORDED EXEMPTION NO. 348 - MR. AND MRS. DAVID
MILLER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 20th day of November, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 348 , being the property of
Mr. and Mrs. David Miller, described as Pt. Northwest Quarter
(NWa) Section 13, Township 6 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as follows :
A tract of land located in the Northwest Quarter of
Section 13, Township 6 North, Range 67 West of the
6th Principal Meridian, Weld County, Colorado and
being more particularly described as follows:
Beginning at the Northwest corner of said Section 13
and considering the North line of the Northwest Quarter
of said Section 13 to bear North 88°59'02" Fast with
all other bearings contained herein being relative
thereto;

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA (3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Mr. and Mrs . David Miller, be and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 20th day of
November, A.D. , 1978.

Dear Commissioners :
The attached application, plat and related items are in reference to
a request for a recorded exemption from Mr. and Mrs. David Miller.
The parcel of land under consideration is described as Pt . NWl Section
13 , T6N, R76W of the 6th P. M. , Weld County, Colorado. The property
contains approximately 87 acres of Class II and VI irrigated soils.
The request is to split the property into parcels of 4. 887 acres and
82 . 555 acres. This property is located approximately 3 miles east of
the Town of Windsor and 2-1/2 miles south of the Town of Severance.
As indicated in a letter submitted by the Millers, Mr. Miller is no
longer physically able to farm or manage this farm. They wish to sell
the property retaining the 4. 887 acre parcel which has the existing
improvements located on it . The prospective purchaser of the property,
Dr. Edwin Kadlub, has indicated that his tenant farmer who will farm
this property already lives in the immediate area and has no need for
the existing improvements.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1. The request conforms with the Intent Clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the Intent Clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the uses will be compati-
ble with the surrounding agricultural uses. The request will
allow agriculturaland related uses to be the predominant land uses.
There will be no reduction in the amount of land currently being
used for agricultural production.

2. The Town of Windsor Planning Commission has recommended approval
of this request .
3. The Town of Severance has set forth no objections to this request .
4. The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.

Gentlemen:
Pursuant to their application for a Recorded Exemption filed
with your office, the undersigned hereby submit this letter of
explanation detailing the situation indicating the reason why
the request for a recorded exemption has been made.
The undersigned would show that due to the health of David Miller,
they are no longer physically able to farm or manage said property.
That because of said health problems, they have heretofore entered
into a Contract of Sale of the farm to Dr. Edwin D. and Marjorie A.
Kadlub with the exception of approximately five acres of land con-
taining all the improvements on said farm. Since the undersigned
have lived in the house located on said farm for more than 33 y,ars
last past, they wish to continue to occupy said house as their
home. This contract of sale is contingent upon sellers obtaining
the requisite approval from the County of Weld and any other
political subdivision having jurisdiction over said property.
It is not the intent of the undersigned by requesting this recorded
exemption to change the use of said property from its present use,
and that any change in USA of said property hereafter would be
subject to the approval of Weld County.

property which runs to the west and northwest . Accesses 'to the

located at the crest of a hill! There is a small subdivision with at
