RE: PURCHASE OF ABANDONED UNION PACIFIC RAILROAD
RIGHT OF WAY FROM UNION PACIFIC RAILROAD COMPANY
WHEREAS, it has come to the attention of the Board
of County Commissioners, Weld County, Colorado, that the
Union Pacific Railroad Company has abandoned a right of
way in Galeton, Colorado, and
WHEREAS, the Board is desirous of obtaining said
abandoned railroad right of way for road purposes and to
convert same into its county road system, and
WHEREAS, the Union Pacific Railroad Company has
offered to sell said abandoned railroad right of way con-
taining approximately 2. 43 acres to Weld County for the
sum of Eight Hundred Fifty Dollars ($850. 00) , per letter
dated August 5, 1975, from H. R. Williams, Union Pacific
representative, to Cynthia Joan Telep, Assistant County
Attorney, Weld County, copy attached hereto and made a
part hereof by reference, and
WHEREAS, the Board believes it to be in the best
interest of Weld County to purchase said abandoned Union
Pacific Railroad right of way for the sum of Eight Hundred
Fifty Dollars ($850. 00) as offered.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said offer of
Union Pacific Railroad Company to sell the abandoned railroad
right of way at Galeton, Colorado, for the sum of Eight Hundred
Fifty Dollars ($850. 00) be, and it hereby is accepted.
BE IT FURTHER RESOLVED, that the Chairman be, and
he hereby is authorized, to consumate the transaction on
behalf of Weld County, Colorado, and that title to the
property be taken in the name of Weld County, Colorado, a
municipal Corporation.
The above and foregoing Resolution was, on motion
duly made and seconded, adopted by the following vote on
the 13th day of August, 1975.

et title and interest in and to the real estate situate in the
O County of Weld, State of Colorado, described in Exhibit A,
hereto attached.

This deed is made SUBJECT to the following:
All taxes and all assessments , or, if payable in
installments, all installments of assessments, levied
upon or assessed against the premises described in Ex-
hibit A which became or may become due and payable in
the year 1975 shall be prorated as of the date of this
deed between the Grantor and the Grantee, and the
Grantee assumes and agrees to pay, or to reimburse
the Grantor for, if paid by it, all such taxes and
assessments and installments of assessments applicable
to the period subsequent to the date of this deed and
assumes all taxes and all assessments and all install-
ments of assessments which may become due and payable
after such year.

It is expressly understood that the subjacent support
• of the premises described in said Exhibit A may have been im-
paired by mining operations heretofore carried on beneath the
surface thereof, and the quitclaiming of said premises is upon
the condition that the Grantor, its successors and assigns,
shall not be liable for damages resulting therefrom.

Beginning at the northwest corner of said Section 5;
• thence easterly, along the north line of said Section 5, a
distance of 119.0 feet;
thence southerly, along a line parallel with and 216.0 feet
distant easterly, measured at right angles, from the centerline of the
abandoned main track of the Pleasant Valley Branch of the Union Pacific
Railroad Company, as formerly constructed and operated, a distance of

Dear Ms. Telep:
Reference is made to my letter of July 23, 1975,
concerning the County's desire to purchase approximately two
acres of our abandoned right of way in Galeton, Colorado, and
a 60-foot extension of Third Street running east to west across
our right of way.
Our Engineering Department is being requested to
prepare a legal description covering that area shown yellow on
the attached print. The area to be conveyed will contain
approximately 105,860 square feet, more or less , or 2.43 acres.
As previously stated, the Railroad Company desires to
obtain $350.00 per acre. Consideration, therefore, covering the
approximate 2.43 acres will be $850.00. Final computation will
be made upon receipt of legal description.
If the above proposal is satisfactory, will you please
have the authorized official so indicate by signing the attached
copy of this letter. Also, further indicate how the County
desires to take title.

Subject:
On site inspection of R. R. property at Galeton was made
Monday 6-24-75 with U.P. representative . (Doug Rice )
It is recommended that the County submit a request to U.P.R.R.
to purchase the north 275 ' m/1 as shown on attached copy of
aerial photo. This would be a parcel of 2 acres m/1 located in
the NW corner of Sec 5-T6N-R64W and the NE Corner of Sec 6-T6N-
R64W all within the town of Galeton .
Mr. Fagerberg, owner of improvements on R. R. property , asked if
entrance to Great Western Beet dump from County Road #51 could
be moved north to be in line with 3rd Street as shown on attached
map.
Also we would recommend to contact Mr. Fagerberg to purchase the
building located on the above described property (old gas and oil
bulk plant ) . Mr. Fagerberg would like to hear from you in the next
few days as he is going to tear said building down if County doesn ' t
want it .
If more information is needed let me know and I ' ll see if I can
get thee answers.

Dear Mrs . Moore:
Reference is made to your phone conversation on May 13
with Mr. Rice of my office concerning the Railroad Company selling
the abandoned Pleasant Valley Branch in Weld County, Colorado.
Enclosed herewith legal description of our abandoned
Pleasant Valley Branch and two prints identifying the separate
parcels with reference to an additional attachment identifying
the prospective purchaser and other pertinent information.
Upon your review of the above-mentioned attachments ,
will you please advise me what steps the Railroad must take
before proceeding to be in compliance with the County Subdivision
Regulations . A copy of said regulations will also be appreciated.
Also located within the County of Weld we have an
abandoned line identified as the Puritan Branch. Initial proceed-
ings have begun to convey a portion of this property to Mr. Fred
Mock, Jr. Print is attached identifying same. Will you please
advise as soon as possible if this sale is permissible under the
Subdivision Regulations in order that I may proceed in this matter.
Copy of legal description of Puritan Branch is also attached.

Dear Mr. Honn:
Reference is made to your conversation of July 9 with
Mr. Douglas Rice of my office concerning our abandoned Pleasant
Valley Branch at Galeton, Colorado.
As requested, I have enclosed herewith a legal descrip-
tion of the abandoned right of way located in the NW' of Section
5 and the SZ of the NEt of Section 6 , Township 6 North, Range 64
West. It is this property that the Railroad Company is requesting
exemption from the Weld County Subdivision Regulations. We have
entered into negotiations to sell portions of this property to
Messrs. Ray Nix and Richard Fegerberg. Concerning the remaining
area, our first attempt will be to contact the adjoining land
owners in an endeavor to enter into negotiations with them. To
date, these people have not been contacted and will not be until
exemption is granted.
I will appreciate your advising me at the earliest
possible time concerning the Railroad ' s request for exemption
in order that we may proceed with our negotiations with Messrs .
Nix and Fagerberg. At the same time, I would also like to be
informed of the exact area that the County is interested in
purchasing.
