HomeMy WebLinkAbout780423.tiff RESOLUTION RE: APPROVAL OF LOT SIZE VARIANCE NO. 75 - FRED BECKER WHEREAS, the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 1st day of November, 1978, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Fred Becker, which land is more particularly described as follows : Ten acres square in the southeast corner of the Southwest Quarter of the Southeast Quarter of Section 5, Township 1 North, Range 61 West of the 6th P.M., Weld County, Colorado; being the same parcel of land conveyed to School District #88, Weld County, by Warranty Deed recorded November 20, 1919 in Book 572, Page 393, Weld County Records. WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4.A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4.A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements, be and hereby is, granted to Fred Becker for the above described parcel of land. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 1st day of November, A.D. , 1978. The property is described as Pt . SW4SE4 Section 5, T1N, R61W of the 6th P.M. , Weld County, Colorado. This property is located 9-1/2 miles east of Prospect Valley and is formerly known as the Kiowa School ground. The property contains approximately 10 acres of Class II , III and IV non-irrigated soils. The request is to obtain a variance from the minimum lot size requirement, Section 9-4 A. (6) , so that he can make application to apply for a recorded exemption. If this lot size variance is granted, Mr. Becker will proceed with his application for a recorded exemption to divide the property into two parcels. Mr. Becker wishes to purchase 1-1/2 acres more or less which will include an existing residence and garage. The balance of the pro- perty will continue to be used by the Kiowa Union Sunday School Corpora- tion which has the Kiowa School building located on it . Based upon the information and the adopted policies in the County, the Department of Planning Services Staff recommends this request be ap- proved for the following reasons : 1. The request is in compliance with the intent clause of the recorded exemption procedure (Section 9-2 Weld County Subdivision Regulations) , the intent clause of the Agricultural Zone District (Section 3 . 3 A. of the Weld County Zoning Resolution) , and the Weld County Compre- hensive Plan in that the parcel under consideration does have exist- ing improvements located on it . The proposed use of the property will be compatible with surrounding agricultural uses. No reduction of agricultural land used for production will occur.
