RE: APPROVAL OF LOT SIZE VARIANCE NO. 75 - FRED BECKER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 1st day of November, 1978, in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by Fred Becker,
which land is more particularly described as follows :
Ten acres square in the southeast corner of the
Southwest Quarter of the Southeast Quarter of
Section 5, Township 1 North, Range 61 West of
the 6th P.M., Weld County, Colorado; being the
same parcel of land conveyed to School District
#88, Weld County, by Warranty Deed recorded
November 20, 1919 in Book 572, Page 393, Weld
County Records.
WHEREAS, the owner of said tract of land desires to obtain
a variance from the minimum lot size requirement so that said
applicant may make application to the Board of County Commissioners
for a recorded exemption, as set forth in Section 9-4.A. (6) of
the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, feels that the applicant has shown good cause for
granting a lot size variance under Section 9-4.A. (6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements, be and hereby is, granted to Fred Becker for
the above described parcel of land.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
November, A.D. , 1978.

Dear Commissioners:
The attached letter and related materials are in reference to a re-
quest for a lot size variance from Mr. Fred Becker. The property is
described as Pt . SW4SE4 Section 5, T1N, R61W of the 6th P.M. , Weld
County, Colorado. This property is located 9-1/2 miles east of
Prospect Valley and is formerly known as the Kiowa School ground.
The property contains approximately 10 acres of Class II , III and IV
non-irrigated soils. The request is to obtain a variance from the
minimum lot size requirement, Section 9-4 A. (6) , so that he can make
application to apply for a recorded exemption.
If this lot size variance is granted, Mr. Becker will proceed with his
application for a recorded exemption to divide the property into two
parcels. Mr. Becker wishes to purchase 1-1/2 acres more or less which
will include an existing residence and garage. The balance of the pro-
perty will continue to be used by the Kiowa Union Sunday School Corpora-
tion which has the Kiowa School building located on it .
Based upon the information and the adopted policies in the County, the
Department of Planning Services Staff recommends this request be ap-
proved for the following reasons :
1. The request is in compliance with the intent clause of the recorded
exemption procedure (Section 9-2 Weld County Subdivision Regulations) ,
the intent clause of the Agricultural Zone District (Section 3 . 3 A.
of the Weld County Zoning Resolution) , and the Weld County Compre-
hensive Plan in that the parcel under consideration does have exist-
ing improvements located on it . The proposed use of the property
will be compatible with surrounding agricultural uses. No reduction
of agricultural land used for production will occur.

2. The 10 acre parcel under consideration has low utility for agri-
cultural use due to the small acreage of the parcel .
3. The request is consistent with Section 9-4 A. (6) of the Weld County
Subdivision Regulations.

KNOW ALL MEN BY THESE PRESENTS That the undersigned
SCHOOL DISTRICT NO. 88 in the County of Weld and State of
Colorado, now by consolidation and reorganization S LO,.1, DIS-
TRICT NO. RE-3 (J) in the County of Weld and State of Colorado,
party of the First Part, for the consideration of other valuable
consideration and I 'VE AND NO/100 DOLL, RS, in hand paid , hereby
sell and convey to KIOW'A UNION SUNDAY SCHOOL, INC. of Ro,gen
of the County of Weld and the State of Colorado, Party of the
Second Part , the following real property situate in the County
of Weld and State of Colorado, to wit:
Ten acres square in the southeast corner of the SWi
of the SEi of Section 5, Township 1 North , Range 61
West of the 6th P.M. , Weld County , Colorado; being the
same parcel of land conveyed to School District #88,
Weld County, by Warranty Deed recorded November 20,
1919 in Book 572, Page 393, Weld County Records,
But reserving to the undersigned for a period of Ten
years:
1. The ownership of the Teacherage , the propane storage
tank, the Garage north of the Teacherage; the free use
of the land and the immediate area surrounding the
Teacherage , the propane tank, and the garage building;
together with the full right of ingress and egress to the
teacherage and other buildings and equipment on the present
roadway.
2. The right to sell and remove the teacherage, the J
propane tank and the garage from the gound at any time
within a period of ten years after date;
3. All oil and other minerals and mineral rights,
together with the right of ingress and egress for
exploration development and removal of said oil and
minerals if found ,
with all its appurtenances and warrant the title against all
persons claiming by, through or under the grantor herein named.
IN WITNESS WHEREOF, the said party of the first part
bath caused its corporate name to be hereunder subscribed by
its President , and its corporate seal to be hereunto, attested
by its Secretary , the day and year first above written.

COMMENTS :
There is currently located on the property the Kiowa School, a small
house and garage. Access to the property is off of State Highway 52 on
the east side of the property. Kiowa Creek runs north and south through
the property. The 10 acre parcel is currently in grasslpasturelweeds.
There is one residence located to the north and west of the 10 acre
parcel . There is another residence located on the south side of Colorado
Highway 52, approximately 1/4 mile to the west . Drainage to the property
to be to Kiowa Creek.
