THIS INDENTURE, Made this twenty-third day of December in the year of our Lord one thousand eight hundred and ninety seven, be- tween the State of Colorado, by Alva Adams, Governor of said State, and L. C. Paddock, Register of the State Board of Land Commissioners of said State, party of the first part ,and the Board of County Com- missioners of the County of Weld in the State of Colorado, party of the second part : Whereas, The said party of the second part has made applica- tion to the State Board of Land Commissioners, having the control of the lands held by the State of Colorado for the Right of Way for a Public Road or Highway through and over school lands, hereinafter de- scribed, to be used by said party of the second part as Right of Way for the construction and maintenance of a Public Road of the party of the second part : And Whereas, The said Board of Land Commissioners has grantee? such Right of Way for the purpose aforesaid, upon the condition that the party of the second part pay the sum of one dollar therefor: And Whereas, The said Alva Adams, Governor,and the said L. C. Paddock, Register State Board of Land Commissioners, are author- ized, in such case, upon the granting of such Right of Way, to exe- cute and deliver on behalf of the State of Colorado, party of the first / OG/q,cJ - 2 - part , proper deeds conveying such Right of Way. when so granted; Now Therefore, These Presents Witnesseth, That the said party of the fir-•t part, for and in con- ideration of the premises aforesaid, and. the further con-ideration of one dollar to the said party of the first part in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, has grartnd, remised, released and conveyed, and by these presents does grant , renise , release and convey unto the said party of the second part, the RIGHT OF WAY over, through and upon the following described pieces and tracts of land, so long as the same may be used as a Public Road, situate in the County of Weld and State of Colorado , to-wit : A strip of land sixty (60) feet wide off the south side of the north one-half of Section Sixteen (16) Township seven (7) North; of Range Sixty-seven (67) West of the Sixth Principal Meridian. Said above described premises to be used by the said p.;.rty of the second part only for the purposes of constructing and maintain- ing a Public Road or Highway. To Have and to Hold The said premises for the pur- poses only aforesaid, together with all and sin- ` gular, the appurtenances and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate , right , title, interest and claim whatsoever of the said party of the first /oo/ivy - 3 - part, either in law or equity, to the only proper use, benefit and behoof of the party of the second part, its suc— cessors or assigns, forever, for the purpose only aforesaid.
