Dear Ms. Martin, Country Meadow Estates would like to proceed with the submission of the Planned Unit Development Change of Zone.All outstanding comments received from Weld County in the PUD Sketch Plan comments dated June 2,2009 have been addressed and are discussed in this letter in detail: 1. The applicant shall submit written evidence to the Weld County Department of Planning Services that indicates all of the State of Colorado Geological Survey concerns have been addressed as • stated in their referral dated April 28,2009. Included in the PUD Change of Zone submittal is the Change of Zone Drainage Report.The report indicates a proposed detention pond that will accommodate the 5 year and 100 year storm events. A drainage easement is also proposed to encompass the detention pond. - Prior to construction of structures within any lots, lot-specific design level geotechnical foundation investigations will be conducted to identify specific subsurface conditions. 2. The applicant shall include in future applications a copy of a surface use agreement with the properties mineral owners and lease holders stipulating that the oil and gas activities had adequately been incorporated into the design of the site or show evidence that an adequate attempt had been made to mitigate their concerns. - Since the developer of this project is the owner of the site, a mineral agreement is not applicable. 3. The applicant shall address the requirements(concerns)of Weld County Department of Public Works referral,as stated in the referral response dated May 8,2009. The applicant shall address the requirements(concerns)of Weld County Sheriffs Office,as stated in the referral response dated April 20,2009. - The PUD Change of Zone shows elements required by Weld County Sheriffs Office including sheltered bus stop, mailbox,and subdivision entrance sign. - The subdivision will create a Home Owners Association to maintain roadways and keep in contact with the Sheriffs Office. The applicant shall provide written evidence from the Berthoud Fire Protection District stating that the issues raised in their referral dated April 13,2009 have been addressed. - The PUD Change of Zone addresses the concerns of the Berthoud Fire Protect District including fire hydrant spacing and water sizes.A fire depression system is also addressed. 6. The applicant shall address the requirements(concerns)of Weld County Department of Public Health and Environment dated May 8,2009. - The proposed water system conforms to Chapter 27 of Weld County Code as well as Little Thompson Water District requirements. - Due to the subdivision utilizing a septic system,the covenant shall state that landscaping and construction activities are expressly prohibited in the designated absorption field site. - The Change of Zone drainage report was included in this submittal. - A separate letter has been written to address Ms. Light's environmental impact concerns. 7. The applicant shall indicate how the open space areas including stormwater detention will be irrigated/maintained. - The revised roadway system provides vehicle access to the detention pond as shown in the • submitted Change of Zone.Any disturbed areas shall be re-seeded with a county approved natural seed mix,and temporary erosion control measures shall be installed. 8. The applicant shall submit a recorded copy of a deed that describes the property as Lot B of RE- 4571 being part of N2 SE4 of Section 7,Township 4 North,Range West of 6th P.M.Weld County, Colorado. - A revised recorded exemption is being submitted concurrently with the Change of Zone to Weld County. Because Lot A and B are changing in acreage,a deed will be performed once the revised recorded exemption is approved. 9. The plat shall include detention ponds, bus shelters,mail boxes,and signs. - This item has been addressed in the Change of Zone submittal and will be detailed in the final plat. We are currently working with The Little Thomson Water District to proceed with a signed Water Line Extension Agreement.That agreement will be sent to Weld County Planning as soon as it is received. Sincerely, • James P.Trott, Sr. • SITE SPECIFIC DEVELOPMENT GUIDE FOR COUNTRY MEADOW ESTATES-PK1153 COMPONENT ONE- ERVIRONMENTAL IMPACTS 1. Noise and Vibration — Country Meadow Estates is a residential development and as such there will be no adverse impacts from noise or vibration. 2. Smoke, dust, and odors — As this is a residential development there will not be any impact to the environment from smoke, dust or odors. 3. Heat, light and glare — Lighting will be typical for a residential development. There will not be an adverse impact from heat, light or glare. 4. Visual/aesthetic impacts — Lots and houses will be oriented to take advantage of the views to the west. 5. Electrical interference — There will not be any equipment which will cause undue electrical interference. 6. Water pollution —There will no activities which will cause water pollution. 7. Wastewater disposal — Individual septic systems will be utilized for wastewater disposal. 8. Wetland removal —There are no jurisdictional wetlands located onsite. • 9. Erosion and sedimentation — Construction activities will be conducted in a manner as to reduce potential erosion concerns. 10. Excavation, filling and grading — Construction of foundations and roads will be closely monitored and all regulations will be adhered to. 11. Drilling, ditching and dredging —Will not occur onsite. 12. Air pollution — Is not an issue in a residential development. 13. Solid waste — Individual homeowners will be responsible to remove household trash. 14. Wildlife removal —There are no existing colonies of wildlife that will be disturbed. 15. Natural vegetation removal — Homeowners will be encouraged to leave as much natural vegetation as possible on their lots. 16. Radiation/radioactive material — None. 17. Drinking water source— Little Thompson Water District. 18. Traffic impacts — As the development is for only nine lots, impacts to traffic will be minimal. • COMPONENT TWO- SERVICE PROVISION IMPACTS 411. 1. Schools — The District has approved the utilization of a covered waiting area until the bus stops for pickup and stopping traffic from both directions. 2. Law enforcement — The sheriff's office recommendations will be taken into account and will be adhered to when applicable. 3. Fire protection — Berthoud Fire Protection District will provide service and this development will adhere to their rules and regulations when applicable. 4. Ambulance — Emergency service will be available through the fire district and Weld County. 5. Transportation —The interior roadway will be constructed to county standards and will be collateralized in an improvements agreement as necessary. 6. Traffic impacts analysis — Not required by Weld County Department of Public Works. 7. Storm drainage — A final drainage report will be submitted with the final plat application and will adhere to Weld County regulations. 8. Utility provisions — All utility providers have been contacted and utilities are available to the site. 9. Water provisions — Little Thompson Water District will provide water to the site. 10. Sewage disposal system — Individual septic tank systems will be designed and constructed to Weld County standards. 11. Structural Road Improvements Plan — Roads will be constructed to Weld County specifications. COMPONENT THREE— LANDSCAPING ELEMENTS 1. A landscape plan will be submitted as a separate document. The homeowners association will be responsible for maintenance of landscaping. Evergreen trees will be planted at the entrance to the subdivision. Decorative rock will also be added. COMPONENT FOUR— SITE DESIGN 1. Section 22-2-120.A (R.Goal.1.1) "The land use applicant should demonstrate that adequate sanitary sewage and water systems are currently available or reasonably obtainable to serve residential development proposals." Water will be provided by the Little Thompson Water District. Large lot sizes will reasonably accommodate individual sewage disposal systems that will be designed and constructed to Weld County standards. Section 22-2-60.C (A. Policy 1.4) "The land use applicant should demonstrate that • public service providers such as schools, emergency services, fire protection and other providers are informed of the proposed development and are given adequate opportunity to comment on the proposal." Many agencies have been notified from the PUD sketch • plan and will continue to be informed during the PUD process, including but not limited to the Weld County Sheriff's Office and the Berthoud Fire Protection District. Section 22-2-120.C (R. Goal.3.1) "Mitigation techniques should be considered, to address incompatibility issues." Right-to-farm statements have been added to the exemption plat. 2. As this is a residential development, there will not be any conflicting uses. 3. The development is located in an area which is conducive to low intensity residential uses. COMPONENT FIVE— COMMON OPEN SPACE USAGE 1. The open space will be owned and maintained by the Homeowners Association. The covenants for Country Meadow Estates will address all aspects of the open space such as maintenance, taxes and use restrictions. Homeowners will be required to join the homeowners association and the covenants will be established prior to the sale of lots. In addition, these common space areas will be maintained by the HOA; Bus Shelter, Entrance Sign, Mail Kiosk, and Drainage Ditch along North property boundary. COMPONENT SIX- SIGNAGE • 1. Individual signs will adhere to the requirements of the Estate Zone District. A subdivision sign will be constructed and located near the entrance but not in an area which restricts visibility to either incoming or outgoing traffic. The location will be noted on the plat. COMPONENT SEVEN— RUD IMPACT 1. This component is not applicable as the subdivision is not located in RUD. COMPONENT EIGHT—INTERGOVERNMENTAL AGREEMENT IMPACTS 1. This component is not applicable as the subdivision is not located in any IGA area. VARIANCE FROM REQUIREMENTS OF ESTATE ZONE DISTRICT 1. Provide a copy of the Conceptual Development Guide as described in Article VI,Chapter 27 of the Weld County Code. • a. Included in the PUD Change of Zone resubmittal is the Conceptual Development Guide. 2. Does the applicant intend to comply with all E (Estate)Zone District requirements? a. Yes, Country Meadow Estates will comply to all E (Estate) Zone District requirements. Public Works Site Plan Review 1. Label "Weld County Road 3"on plat drawing. a. WCR 3 has been added to the plat drawing. 2. Provide adequate turning radius and stop signs in the internal road. a. Stops signs have been added in both directions to the plans at the 90 degree turn in the project site. Since this intersection will now be considered a stopped intersection,the radius of the road centerline is adequate per Weld County criteria. 3. Add a drainage culvert across Ridge View Road. a. The properly sized culvert will be added to provide drainage from the proposed detention pond out of the project site. 4. Provide a typical cross section of the internal road a. A typical cross section has been added to the plans on Sheet 4—Details. 5. Add a 15-inch culvert at the entrance of each proposed lot. a. A note has been added to the plans which require a 15-inch culvert to be installed during construction of the driveway for each lot. 6. Length of Ridge View Road exceeds 1,500 feet. a. Letters for approval have been sent to Weld County Fire Department and Weld County Sheriffs Department for approval of a variance to the maximum length of the road. • • • • • Traffic Study 1. Does traffic study need to be completed? a. During the Sketch Plan submittal, David Snyder from Weld County Public Works wrote comments dated May 8, 2009 that"Based on the proposal and minimal impact on surrounding roads, a traffic study is currently not required." Preliminary Drainage 1. The detention pond sizing calculations in the drainage report appears to be using a maximum allowable unit release rate that is based on soil type.Weld County does not allow this type of release rate.Therefore the detention pond appears to have been undersized because the release rate appears to have been over estimated. a. As discussed in the resubmitted Change of Zone Drainage Report,the proposed detention pond is currently sized to conform to Weld County regulations.We have also introduced a "second option" of no on-site detention within the report.The second option still needs further investigation, however both plans as discussed in the submitted drainage report are adequate for this Change of Zone submittal. 2. The drainage report was not stamped,signed,and dated by a registered professional engineer licensed in the State of Colorado. a. The drainage report for this submittal is now stamped, signed and dated by a professional engineer. With all concerns being addressed in the resubmittal package,we would like to continue to move forward with Weld County in providing the Final Plans and Reports in the near future. Sketch Plan Comments from May 8, 2009 Lauren, Per your comments from the PUD sketch plan review for the Country Meadow Estates, L.L.C. development, please find the enclosed revised Preliminary Drainage Report for the change of zone submittal for your review. In addition, per your comments listed in the final paragraph of your review of the PUD sketch plan for Country Meadow Estates, L.L.C.you inquired about Items 4,7, 11, 15-18 under Section 27-6-40 'Component One: Environmental Impacts' of the Weld County Code.The following is an explanatory statement as to how Country Meadow Estates, L.L.C.will plan to accommodate these impacts: • 4. Visual/Aesthetic Impacts:Ground&earth tone color palettes shall be used and written into any applicable covenants,along with general landscaping and exterior construction guidelines,as outlined in Sections 27-2-30'Buffering and Screening',27-2-35 'Buffer Zone or Area', 27-2-40'Bulk Requirements', 27-2-70'Compatibility',and 27-2-100'Landscaping Standards'. 7. Wastewater Disposal: The proposed site is suitable for conventional style septic systems, per the percolation test result data listed in the'Subsurface Exploration Program'conducted by Ground Engineering Consultants, Inc., dated July 11, 2007.As stated in your comments, individual percolation tests are required for each lot when septic permits are applied for to address groundwater level and soil types. In addition,any applicable covenants shall include a statement that landscaping and construction activities are expressly prohibited in the designated absorption field sites. 11. Drilling,Ditching and Dredging: Should the need arise for any drilling, ditching and/or dredging operations, all applicable county and state guidelines shall be adhered to. 15. Natural Vegetation Removal: Natural vegetation disturbance shall be minimized where possible. Where natural vegetation is disturbed and can be replaced,a county approved natural seed mix,along with temporary erosion control measures,shall be utilized. 16. Radiation/Radioactive Material: There is no indication at this time that there is any radioactive material located on or below the proposed site. Any radiation/radioactive materials that are encountered during construction,shall be disposed of per any applicable state and federal regulations. • • • • 17. Drinking Water Source: As stated in your comments,a will serve letter from Little Thompson Water District was included with the sketch plan application. Country Meadow Estates, L.L.C. will continue to work with the Little Thompson Water District to provide water service to the proposed development. 18. Traffic Impacts: Comments from the Weld County Public Works Department stated that this development would introduce 86 additional vehicle trips per day. Based on the proposal and minimal impacts on surrounding roads, a traffic study is not currently required. I hope this addresses any concerns that you may have. I had opportunity to visit the site on 8/25/09 to view the property and adjacent roadway. The site distance to readily view a bus stopped along the frontage of your property appears to be adequate for motorists approaching the site along CR 46 from both the north and south. I would suggest that the actual stop location of the bus be placed at the northernmost corner of the property. In constructing a staging area for students, we recommend that developers provide an all weather surface (concrete, asphalt, well off of the traveled portion of the roadway where students will be directed to wait Some type of bus shelter to protect Milltidents during inclement weather that would allow students to view the bus approaching from either direction would be highly desirable. We suggest that fighting be placed at or near the staging area to illuminate the site during low light conditions. Bus stop ahead signage will be as per county signage requirements.
