RE: GRANT REQUEST CONCERNING EXTENSION OF TIME TO COMMENCE ACTIVITY
FOR USE BY SPECIAL REVIEW PERMIT #1343 - READY MIXED CONCRETE
COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 21st day of December, 2009, the Board was presented with a request
from Ready Mixed Concrete Company, 4395 Washington Street, Denver, Colorado 80216, to
determine that the permit has not been abandoned and to extend the time allowed to commence
activity for Use by Special Review Permit#1343 for Wet Open Pit Mining and Materials Processing
in the A (Agricultural) Zone District, on the following described real estate, to-wit:
Part of the S1/2 SW1/4 and the W1/2 SE1/4 of
Section 28, Township 3 North, Range 67 West of the
6th P.M., Weld County, Colorado, and
WHEREAS, at said hearing, the Department of Planning Services advised the Board that
USR-1343 was approved on October 9, 2002, and the plat was recorded on October 4,2006,and to
date, work has not commenced on said permit; however, staff supported the request for an
extension with the provision that an amendment application be submitted by, or no later than,
October 4, 2010, and
WHEREAS, Mike Hart, Hart Environmental, P.O. Box 1303, Boulder, Colorado 80306, on
behalf of the respondent, has presented a subsequent request to an additional six-month extension,
with the deadline for submittal extended to April 5, 2011, and
WHEREAS, after hearing testimony from those present, the Board deems it advisable to
grant the respondent an additional six-month extension, with the provision that an amendment
application be submitted no later than April 5, 2011.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that an additional six-month extension be, and hereby is,granted to April 5,2011.
BE IT FURTHER RESOLVED by the Board that Ready Mixed Concrete Company shall
submit an application to amend Use by Special Review Permit#1343 no later than April 5, 2011.

SUBJECT: USR-1343 Nix Sand and Gravel Mine
Request for 2nd Extension to submit application
The Department of Planning Services received a letter dated August 24, 2010 from Michael
Hart, Hart Environmental, representative for Ready Mixed Concrete Company requesting
consideration for a second extension of a six month timeframe to prepare the amendment
application to USR-1343.
This letter received August 26, 2010 from M. Hart, Hart Environmental to T. Jiricek, Director of
Planning Services outlines the history of the project to date. Staff requests your acceptance of
their request for a six month extension to submit the required documents for a Site Specific
Development Plan and a Special Review Permit for Mineral Resource Development including a
Concrete Batch Plant, Recycled Concrete and Gravel Mining facility in the A (Agricultural) Zone
District. The application will be submitted on or before April 5, 2011.
Representatives for the Department of Public Works and Planning Services have met with the
applicant and applicant's representative to discuss this issue and support their request.

Re: USR 1343-Nix Sand and Gravel Pit
Dear Mr. Jiricek:
In 2004 my client, Ready Mixed Concrete Company (RMCC), succeeded Owens
Brothers Concrete Company as the owner/operator of the Nix sand and gravel property
located in Section 28; Township 3 North; Range 67 West of the 6th P.M. in Weld County.
On October 4, 2006 the plat for USR 1343 (the Nix Property)was finalized and recorded
in Weld County.
On December 21, 2009,the Weld County Board of County Commissioners granted
RMCC a one year extension,expiring October 4, 2010, by which date RMCC is to have
submitted an application to amend the Nix Use by Special Review Permit# 1343. To that
end,representatives of RMCC recently met with County staff members Kim Ogle and
Don Carroll to discuss the application to amend USR# 1343. As a result of that meeting,
Ready Mixed would like to formally request a six month extension of the current October
4, 2010 deadline for submittal of the application to amend USR# 1343 until April 5,
2011.
Please advise if this request is supported by staff and, if so, when it is likely to be
heard by the Weld County Board of County Commissioners.
