The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-2-220 of the Weld County Code as follows: A. Section 23-2-220.A.1 -- The proposed use is not consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-2-20.1 states: "Reduce potential conflicts between varying land uses in the conversion of traditional agricultural lands to other land uses." Primarily the surrounding property to the North, South, East, and West are agricultural with residences in close proximity. Seven property owners were notified of the proposed development based on the applicant's certificate list of surrounding property owners • within 500 feet. More than 50% of the property owners sent letters in opposition of the proposed flea market and sport fields. Some of their concerns are as follows: decreased USR-1742 Lo Page 3 property values, increase of traffic, trash blowing onto neighbors property, lack of • sanitation, no medical assistance, lack of monitoring of hours of operation and number of people to the facility, lack of screening/landscaping, and the lack of enjoyment of their own property. The applicant hosted a neighborhood meeting on August 14, 2010 where 6 neighbors attended. Many of the neighbors indicated they would prefer to see the applicant relocate the facility further west towards the motocross track. The neighbors continued to voice their concerns regarding the traffic, noise, and trash. The applicants have indicated they do not want to relocate the facility further west on the property because they will lose visibility along County Road 13 (Colorado Boulevard). The applicant also stated he will have trash cans around the site to handle the waste. The applicants also indicted they will only be in operation 6 months out of the year and only on weekends; as opposed to the motocross track to the north of the property. The applicant has also not proposed to install any landscaping/screening for the proposed facility. The proposed flea market will operate on the weekends from 8 am — 8 pm, April to October. During these hours of operation many of the surrounding property owners will be at home. According to the letters from the surrounding property owners and the comments from the neighborhood meeting the proposed flea market and sport fields will negatively impact their quality of life. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. • Should the Planning Commission approve this request, the Department of Planning Services recommends that the following conditions of approval and development standards be attached: 1. The plat shall be amended to delineate the following: A. All sheets of the plat shall be labeled USR-1742. (Department of Planning Services) B. The attached Development Standards. (Department of Planning Services) C. The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code. (Department of Planning Services) D. The sign shall be relocated to meet the 20 foot setback from County Road 13. (Department of Planning Services) E. The sign detail shall include the exact size of the sign and its height from the natural grade of the ground. (Department of Planning Services) F. Parking areas and the access drive shall be surfaced with gravel, recycled asphalt or the equivalent and shall be graded to prevent drainage problems. (Department of Public Works) G. The applicant shall enter into a Private Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera) and non-transportation (fencing, screening, drainage et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. The applicant shall either submit a copy of an agreement with the property's mineral owner/operators stipulating that the oil and gas activities have been adequately incorporated into the design of the site or show evidence that an adequate attempt has been made to mitigate the concerns of the mineral owner/operators. The applicant shall submit to the Weld County Department of Planning Services a screening plan for review and approval. The screening plan shall screen all outdoor activities and parking areas from adjacent rights of way and surrounding properties. (Department of Planning Services) • 5. Upon completion of 1 - 4 above the applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within thirty (30) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 6. In accordance with Weld County Code Ordinance 2006-7 approved June 1, 2006, should the plat not be recorded within the required sixty (60) days from the date the Board of County Commissioners resolution a $50.00 recording continuance charge shall added for each additional 3 month period. A Site Specific Development Plan and Special Review Permit for A Use Permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts, (flea market and sports fields) in the A (Agricultural) Zone District and subject to the Development Standards stated hereon. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. The hours of operation for will be limited to Saturday's and Sunday's from 8:00 am — 8:00 pm April 15—October 15. (Department of Planning Services) 4. Five hundred (500) is the maximum number of people on-site per day; this includes vendors, employees and patrons. (Department of Planning Services) 5. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. A minimum of six portable toilets are required for any event that occurs over a 6 hour time frame. USR-1742 Lo Page 6 Eight portable toilets will be required for any event that exceeds a 6 hour time period. At least • one unit should be handicap accessible. A minimum of two portable hand washing stations shall be provided. The Stanford Event and Labor Services portable toilet chart shall be adhered to as a minimum guideline. Records of maintenance and proper disposal shall be retained on a seasonal basis. (Department of Public Health and Environment) 15. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. Neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. Personnel from Weld County Government shall be granted access onto the property at any • reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 29. Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3- 20.B.13 of the Weld County Code do not require building permits, however, a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. (Department of Building Inspection) 30. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Residential Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy Code; 2003 ICC ANSI 117.1 Accessibility Code; 2008 National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building Inspection) 31. All building plans shall be submitted to Mountain View Fire Protection District for review and approval prior to issue of Building Permits. (Department of Building Inspection) 32. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. (Department of Public Works) 33. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the • applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. (Department of Public Works) 34. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 35. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 36. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural • practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving USR-1742 Lo Page 8 farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor • from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5- 102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be • more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. The south, west, and north side of the flea market site will be fenced by barbwire with 5 feet metal fence post and possibly with metal grills; as they only face towards open space with no neighbor and open to the motorcycle business field. The front or west towards Colorado Blvd will be fenced with three stage wood stud of 10-12 feet in length with about 4 feet in height attach with metal grills. To preserve the privacy of the old house on the corner of the north side, a 6 feet tall wood fence will be installed between the flea market and the house. This section of CR 13 is under Dacono control. Investigations and findings are documented in the following sections of this study. AGENCY DISCUSSIONS Prior to starting this assessment, both Jennifer Krieger (Dacono) and Janet Carter (Weld County) were contacted to define the appropriate level of traffic investigation for this project. Weld County yielded to Dacono concerning the traffic study and Jennifer asked for a minor effort to determine whether or not auxiliary lanes will be needed at the site access to Colorado Boulevard. CURRENT CONDITIONS Current conditions were field reviewed and traffic counts were undertaken as part of this study. In the area of the site, Colorado Boulevard is a two lane paved roadway with a 45 MPH posted speed limit. Traffic counts were taken on Friday, Saturday, and • 1 • Sunday, August 13, 14, and 15, 2010. Daily traffic ranged from 111 on Sunday to 147 on Saturday with Friday having 134 vehicles. Hourly total traffic in both directions peaked at 21 vehicles between 9:00 PM and 10:00 PM on Saturday night. Normal morning and afternoon peak hour traffic totaled 12 - 14 vehicles in both directions. Saturday is expected to be the busiest site traffic day and therefore, current Saturday morning and afternoon peak hour traffic during flea market hours is shown on the following figure. Consequently, an intermittent seasonal use is proposed. Vendors will typically enter between 7:00 AM and 10:00 AM and leave between 5:00 PM and 9:00 PM. Up to 70 vendors are expected with approximately 50°k entering between 7:00 AM and 8:00 AM and the rest entering between 8:00 AM and 10:00 AM. Most customers are expected to arrive at the site between 8:00 AM and 12:00 PM and leave the site sometime between 12:00 PM - 4:00 PM. Sports fields might also be available for families and athletes. Dirt or sand fields for playing Asian sports and volleyball are anticipated. Sports will be limited to individuals and teams with up to six players per team. No soccer fields are planned. Athletics will be an auxiliary use to the flea market and will likely be used mostly by members of the Asian community attending the flea market. Site traffic is expected to arrive and depart the flea market in a 60% - 40% distribution favoring the south on Colorado Boulevard. These timeframes represent the short term (opening year) and the widely accepted long term planning horizon twenty years in the future. Background traffic was estimated to grow 5% per year for the next 20 years to approximate 2030 conditions. This is higher than normal historic traffic growth on arterial roadways. Section 3.5(5) of the Access Code was applied since this section addresses low volume roadways where the number of turning vehicles may meet numeric thresholds but other traffic is low enough that turning vehicles will not adversely impact other traffic. This section reads as follows: (5) The auxiliary lanes required in the category design standards may be waived when the 20th year predicted roadway volumes conflicting with the turning vehicle are below the following minimum volume thresholds. The right turn deceleration lane may be dropped if the volume in the travel lane is predicted to be below 150 DHV. The left turn deceleration lane may be dropped if the opposing traffic is predicted to be below 100 DHV. The right turn acceleration lane may be dropped if the adjacent traveled lane is predicted to be below 120 DHV. The left turn acceleration lane may be dropped if the volume in the inside lane in the direction of travel is predicted to be below 120 DHV. Based on traffic 20 years in the future, CDOT's Access Code allows dropping any numerically warranted turn lane when traffic in the travel lane is below certain levels or, • in the case of left turn deceleration lanes, opposing traffic is below a certain level. Consequently, auxiliary lanes will not be warranted at the site access intersection with Colorado Boulevard. • 7 • FUTURE OPERATING CONDITIONS Operating conditions for the morning and afternoon Saturday peak hours were evaluated using highway capacity procedures. Short term and long term operations were evaluated. These represent the years 2011 and 2030, respectively. A single lane approach was used in all capacity analyses. Resultant intersection levels of service (LOS) are shown below for the site access - Colorado Boulevard intersection. 2011 Level of Service 2030 Level of Service Control Movement(s) AM Pk Hr. SUMMARY Based on the above documented analyses and investigations, the following are concluded: • Current conditions in the area of the Asian flea market site are acceptable. • The proposed project will generate an estimated 40 site trips during the morning and afternoon site peak hours and 400 trips per day. These trips will be seasonal and occur only on weekends and holidays. • Auxiliary lanes will not be warranted at the site access to Colorado Boulevard. • 8 • • Operating conditions at the site access to Colorado Boulevard will be excellent (LOS 'A') through the long term time frame. Mary and Megan Ogden 2230 WCR 13 Complaint/Concern: Mary strongly complained that she worked 12 hours a day in Denver and her home is where she comes to get peace on the weekends and she did not want an Asian Flea Market near her home, port-o-potty being unsightly and securement to premise so that it does not become a kite, removal of the bodily waste in a timely manner, noise volume of the flea market customers, and trash containment and removal from premises. Mary and Megan Ogden stated that if the flea market was moved further west that they would be okay with it, but not at current site. Mary asked me, "Why don't you put your land for sale?" Mary and Megan also asked, "Why we live in the town, how come we did not put our flea market in the town where we live?" Response/Answer: • In response to Mary's complaint that the flea market will prevent her from enjoying her weekends at home, I informed Mary that my flea market would not be as noisy as the motorcycle company. I informed Megan Ogden that I have a contract with the port-o-potty company as to the rules and regulations with regards to the proper installation and maintenance of the port-o-potty. I will have someone to pick up the trash on the premises and there will be trash cans located throughout the premises. In response to Mary's question about putting my land for sale, I told her that I have a for sale sign right there, and I pointed to the sign on the premises. To answer Mary and Megan's question on why we live in the town and how come we did not put our market where we live. We answered that our land is here and we do not own land in the town. We also asked Mary and Megan if they like or had any concerns about the motorcycle field, which creates noise, dust and devalues the surrounding property values. And they replied, they like and have no concern about the dust and the noise from the motorcycle field.They are happy to have the motorcycle field. • • Brett Wolken (present),John Wolken (not present) 2465 WCR 13 Complaint/Concern: He stated that he is the third generation that has lived at his property, therefore, "it hits a nerve" to have an "Asian Flea Market" next to this property. Also, he wanted to know if Yia and Ying would be bothered by his desire to shoot his shotgun/rifle, etc. on his premises since he enjoys doing such things and also would this cause a problem for their Asian Flea Market customers. Brett stated that if the flea market was moved further west that he would be okay with it, but not at the current site. Response/Answer: I responded that moving the flea market further west would not make any difference because I am not the one making the noise and dust and making the property value go down. Mainly, my flea market is only a parking lot which is only operational on the weekends and in the summer season only. I also responded to Brett that I needed my flea market to be visible to the public and which will help my business to be successful. I told Brett that he is free to do as he wishes on his property. He has the right to do as he wants on his property and the flea market does not restrict his rights on his property. We also asked Brett how he likes the motorcycle field,which creates dust and noise, and he responded that he likes the motorcycle field and has no concern about the dust and noise. He enjoys and is happy with the motorcycle field, because sometimes he takes his children to ride the motorcycle. • Jordan Gutirrierez 6045 WCR 6 Complaint/Concern: Jordan commented that he envisioned luxury/million-dollar homes on the west side of CR 13 and not an Asian Flea Market since he built a million-dollar home on his property, noise volume of customers at Asian Flea Market, and increased traffic on CR 13, also he suggested if access could be requested on CR 8 instead of at CR 13, and lastly he strongly suggested that Via and Ying relocate the Asian Flea Market further west away from CR 13 and place the flea market closer to the Motocross. He stated at that if the flea market was moved further west, he would be okay with it, but not at the current site. Jordan commented that the flea market would be unsuccessful. Response/Answer: I told Jordan that initially when my wife and I purchased this lot, we have a very nice spot to put a million-dollar house on it. However, our dream died when the motorcycle company moved in next to our lot. In response to his comment that the flea market would be unsuccessful, I told Jordan that we don't know but we are taking a risk. • • We also asked Jordan if he like or had any concerns about the motorcycle field, which creates noise, dust and devalues the surrounding property values. Doane Linkus 2600 WCR 13 Complaint/Concern: Increased volume on CR 13 to the point where he won't be able to enter or exit his property Response/Answer: Regarding the amount of traffic concern I don't know, I will only follow the county and city traffic regulations. I also mentioned that Colorado Boulevard (CR 13) will get busy not because of my flea market but the future growth that will be coming to Colorado Boulevard. Brad Linkus • 5074 Summit Complaint/Concern: No comment. "All above are questions, concerns and complaints from our neighbors." Below are my wife Ying Lo and my evaluation and judgment from our neighbor's questions, concerns and complaints. Everybody commented to me and my wife about the noise and the dust from the motorcycle company. So we asked them if they are happy about the dust and the noise. They answered that they were happy and have no concerns regarding the noise and dust from the motorcycle company. So we asked them why they would not be concerned about the health risks from the dust. Our flea market is basically an empty parking lot and operational only on the summer weekends and why are they against out flea market. They answered that they just do not like the flea market. Especially, Brett Wolken and Mary Ogen and Megan Ogden commented over and over again that they like the motorcycle company, and they have kids that like riding the motorcycles. Plus they also said that the motorcycle company generates a lot of income for the city of Dacono. • • Overall,from every neighbor's comments and questions to me and my wife and my translator, we feel that our neighbors are not being honest and fair with us. The reason why we feel this is because the motorcycle company is the dust and noise maker every day and all year round for more than 10 years, however, all my neighbors are all happy and enjoy the motorcycle company. My flea market is mainly an empty parking lot, it has no building and no power. We only operate it on the weekends and summer season, therefore, I asked the question why do they complain? The neighbors said that we are the two that bring the property value down. We feel that this is not because of us. It may or may not require more detailed studies for drainage; it would definitely change your site plan because you would have to adjust your parking spaces and it may or may not require other items by the planning department. WCR 13 is classified by the County as a Strategic Roadway, which requires a 140-foot right-of-way at full build out. The City of Dacono has jurisdiction over this portion of WCR 13 and access requirements will be determined by the City. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. 1. The internal road shall enter onto WCR 13 at a 90° angle, for a minimum of one vehicle length to provide adequate sight distance in both directions. • 2. The applicant is showing the access as paved from the access point to just past the parking area entry. The applicant has indicated through phone conversations that this will be a gravel drive, not asphalt. The site plan should be updated to reflect this. Gravel is acceptable due to the maximum number of 200 vehicles per day accessing the site but an increase in traffic would trigger a traffic study and possible improvements. 3. The applicant has indicated that there will be fewer sports fields than originally shown. Please update the site plan to reflect this. 4. Public Works would like to see parking layout and circulation on the site plan. The 2 acre parking area shall be fully fenced; parking outside of the approved area would indicate a higher number of vehicles utilizing the site and would trigger the need for a traffic study and an amended USR. 5. The emergency access easement should be a minimum of 20' wide. The site plan needs to be updated to show the 20' access easement. Traffic Study: The applicant has stated that the maximum number of people coming to the site per day will be 500 and the maximum number of vehicles will be 200. A traffic study is not being required for 200 vehicles because the use is seasonal and restricted to weekends and holidays. If more traffic than the allotted 200 vehicles per day is found to be utilizing the site, a traffic study and an amended USR will be required. Preliminary Drainage Report: The applicant has provided a description of how water flows across the site. 6. A water quality feature is required for this site. The site is approximately 19 acres. A separate area is dedicated for vendors to come to the site to sell various items such as vegetables, food, crafts, clothing, music, etc. Adjacent to this area there would be recreational fields. There is also a defined parking area. Health Department The applicant is envisioning the vendors to set up tents or booths to sell various items such as vegetables, food, crafts, clothing, etc. (similar to a farmer's market). Staff stated that to sell prepared food the vendors would need to have a licensed mobile unit. No prepared food items would be allowed from personal vehicles or tents. The vendors may obtain these licenses from any municipality or county. No license is needed for pre-packaged items such as candybars or chips. The applicant intends to provide portable toilets and handwashing stations. According to staffs policy portable units are allowed for up to 6 months. Staff requested that the applicant submit an estimated number of people they expect would attend and that will determine the number of • portable units. Public Works The applicant indicated that the parking area would be chained/roped off from the recreational fields. Staff suggested placing signs for areas designated for parking. • The applicant initially proposed an additional access for this site; however the City of Dacono will require only one access. Therefore the applicant has proposed another option of accessing through the existing dirt road. The applicant indicated that he would like to gravel the road and parking area; however he may pave areas in the future as it becomes feasible to do so. No Drainage Report is required; however the applicant shall provide a short description of the historic stormwater flows across the property and how their application will affect those flows. The description shall include but not be limited to: 1) where the water originates if it flows onto the property from an offsite source, 2) where it flows to as it leaves the property, 3) the direction of flow across the property, and 4) if there have been previous drainage problems with the property. The application shall also provide flow arrows on the map showing where the stormwater starts, how it goes across the property, and where it leaves the property. The applicant will still be responsible for providing a water quality feature that conforms to the methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage Criteria manual. A traffic study will be determined after the applicant has provided an estimated number of trips per day. The applicant indicated that he does not know but is wishful that hundreds may attend these events. Staff stated that a good rule to follow is 1 acre of parking equals 100 cars and cautioned the applicant when submitting his proposal.
