Since the snow last week , the highway is covered with so much mud , rocks and debris , it looks like a dirt road . I feel this amount is debris is excessive and dangerous . As of about 2 : 00 Wednesday ( 2/ 24/ 10 ) afternoon , it appeared someone ran a blade down the westbound side acceleration lane , to try to remove some gravel . This was useless ( highway too rutted ) and did nothing other than scratch up the road . I was told by you about a week ago , that you personally contacted the landfill manager , and you were told by him , Waste was in the process of seeking permission from CDOT to sweep the highway . Also , I was told , you instructed a staff person to check the permit Waste had for the landfill as to how they must deal with this public safety issue ? What is the status of both of your requests ? It appears nothing has been done as of to date . I hope you understand Waste Management ' s willful negligence effects hundreds of drivers a day and sooner or later someone is going to get in an accident . I drove by the landfill yesterday (westbound ) and had to slow down and pull to the far right side , to avoid being sprayed with gravel and rocks from the east bound traffic . There were several other drivers were forced to do the same . The dust cloud kicked up by vehicles is also of concern and a possible violation of the Clean Air Act regulated the the EPA . This dust cloud also impacts the nearby residents that exposed to this 24/7 . When will this be addressed and cleaned up ? The landfill operators are liable for this dangerous situation they are exposing the public to . �! SCI This section of highway needs to be swept or washed by the landfill 120 g° g operator immediately and the landfill operators need to start a program to keep this clean permanently. Some of the mud on the roadway appears to be residual material originally placed on the road during snow events. Subsequent applications and repeated run-off back onto the roadway, redepositing the material, appears to have caused at least part of the problem. Bill Hedberg/Waste Management called me to say he had been in contact with CDOT personnel and that they were in the process of arriving at a solution to the problem. I have attached the Development Standards for the approved landfill facility (USR-895). I am wondering if development standard #10 (and to a lesser extent) #8 1 would apply. We also have Standard #33 that states the applicant needs to meet County and State Health requirements. In regards to Dave's question below (as I have not specifically dealt with a situation like this before) - do you happen to know if we have turned any previous landfills into the state in regards to this issue? I am also wondering if our development standards would allow us to proceed with the probable cause procedures (or at least at a minimum sending them a 5-day letter that they would need to respond to). I am not sure how easy it is to prove that water leaving the site has been in contact with the working face of the landfill (per Development Standard #8). Any thoughts/suggestions? Garcia and the person are correct about the mud on the road and its source - the landfill. I was there. 25 is paved I think the mud I'd from the trucks leaving after dumping their loads. This morning's snow was to blame. So will be the next precipt event. We can turn them in to the State for a stormwater vjolation?
